National Green Tribunal
(NGT) issued notices to the chief secretary, secretary, housing & urban development department, collector (Bargarh) and executive officer of Bargarh municipality to show cause within one month as to why they should not face trial for non-compliance of orders regarding removal of legacy waste dumped for the past 10 to 15 years in Bargarh town.
NGT's east zone bench in Kolkata was hearing a petition seeking criminal proceedings against authorities for non-compliance of orders the tribunal issued on March 23, 2023.
The legacy waste dump sites has resulted in huge damage to the environment and posed health hazards to the population in the vicinity of such dump sites.
In the order uploaded on Wednesday (May 28), the bench comprising Sudhir Agarwal (judicial member) and Dr Arun Kumar Verma (expert member) said, "Under these circumstances, we find sufficient justification in this particular matter where action should be taken for prosecution of the authorities who have not complied with the tribunal's order by initiation of prosecution under Section 26 of NGT Act, 2010."
"However, before proceeding further, we find it appropriate to give a last opportunity to the concerned authorities hence we give opportunity to respondents to show cause as to why appropriate directions be not issued for initiation of prosecution against them for committing offence by non-complying and disobeying the directions of tribunal and thereby, attracting the provisions of Section 26 of NGT Act, 2010," the bench added and scheduled the matter for July 28.

Section 26 of National Green Tribunal Act, says that non-compliance of direction of tribunal is an offence for which punishment as prescribed includes imprisonment for a term which may extend to three years, or with fine which may extend to Rs 10 crore.
Ramakanta Rout and six other residents of Purushotam Nagar in ward no. 15 under Bargarh municipality area filed the petition. Advocates Sankar Prasad Pani and Ashutosh Padhy represented the petitioners.
On March 23, 2023, the tribunal disposed of the petition with a direction to Bargarh municipality to ensure complete treatment of legacy waste of over 51,000 metric tonnes through bio-mining/micro composting centres/material recovery facilities by Dec 31, 2023. The tribunal also directed the state govt to immediately deposit Rs 1.84 crore in an ESCROW account to be utilised for the remediation measures by Bargarh municipality.
"More than two years have passed but the concerned authorities have not taken care to take directions seriously and take steps towards their compliance. But it appears that there is a lackadaisical approach adopted by the said authorities with regard to directions issued by tribunal," the bench remarked, adding, "The state of affairs as noticed is very unsatisfactory, particularly, when it relates to serious contamination and pollution of environment i.e.
, contamination of land as well as river water."
"We also do not find any effective explanation or reason in the affidavit of district collector (Bargarh) as to why for the last more than two years, it was not possible to comply with the tribunal's directions. On this aspect, the reply is virtually silent. The only reason, therefore, evident is, lack of sincerity and seriousness on the part of authorities concerned towards preservation of environment and compliance of directions of Tribunal," the bench observed.

BIJAPUR: A day after top Naxal leader Sudhakar was eliminated by security forces in Indravati National Park area in Chhattisgarh's Bijapur district, an encounter broke out in the same area on Friday, an official said. The encounter is part of the same anti-Naxal operation underway since Wednesday by personnel from the state police's Special Task Force (STF) and District Reserve Guard (DRG) as well as the CRPF's specialised unit CoBRA, he added. Intermittent firing between security forces and the Maoist ultras is underway, the official said, adding further details were awaited. Senior Maoist leader Narasimha Chalam alias Sudhakar, who had a bounty of Rs 40 lakh on his head, was killed in an encounter with security forces in Bijapur district on Thursday. Originally hailing from Andhra Pradesh, the 67-year-old Sudhakar was involved in indoctrination and radicalization of youth and also responsible for numerous Naxal attacks in Chhattisgarh, resulting in the death of civilians and security personnel, police said. The killing of Sudhakar, a member of the Maoists' Central Committee, comes a fortnight after CPI (Maoist) general secretary Nambala Keshav Rao alias Basavaraju (70) was neutralised by security forces in the Bastar region. Basavaraju was gunned down in Narayanpur on May 21.

Mumbai: A sessions court here has enhanced the compensation granted to a woman from Rs 5 lakh to Rs 1 crore in a domestic violence case, ruling that her husband was 'rolling in money'. The court observed that the woman's husband, who runs an elevator company, and his family are 'crorepatis'. Besides the compensation, the court also increased the monthly maintenance granted to the woman and her daughter from Rs 1 lakh to Rs 1.5 lakh, holding that the 'physical and mental torture' faced by the complainant while living with her husband can 'scarcely be imagined'. In her order passed last month, Additional Sessions Judge (Dindoshi Court) S J Ansari ruled that the initial compensation of Rs 5 lakh awarded by a magistrate was 'meagre' considering that the woman endured 'torture and humiliation' for 20 years. The victim, a 41-year-old housewife, had challenged a February 2020 compensation order passed by the magistrate under the Protection of Women from Domestic Violence Act. She alleged a long history of physical, emotional, and economic abuse by her husband and in-laws since her marriage in December 1997. The sessions court noted that the woman was forced to seek legal help for maintenance as a last resort after suffering "beatings, severe assaults, taunts and even financial deprivation" in a marriage of almost 20 years. The 'physical and mental torture' endured by the woman while living with her husband can 'scarcely be imagined', the court said. The sessions judge also noted that the magistrate had granted Rs 5 lakh to the aggrieved woman. According to the order, while the woman termed the amount too little, her husband contended that she was not entitled to any money as compensation. The man claimed that he was at the receiving end of his wife's 'behaviour' and his financial situation had now become 'precarious'. The husband said he pays the rent for the premises occupied by him and their twin sons, and he takes care of their educational and living expenses, which leaves him with nothing. The court, however, held that the complainant was subjected to domestic violence by her husband. It noted that the husband and his father had the financial capacity in 2012 to purchase land as well as a flat worth more than Rs 1 crore. The man could not prove that his financial condition was not good despite trying his level best, the court said. 'On the other hand, he being in a position to purchase properties worth Rs 1 crore in 2012, and presently running an elevator company, will surely be rolling in money,' the court said. Citing the material on the record, the court said the man and his family are 'crorepatis'. Noting that he being 'extremely rich', the Rs 5 lakh compensation awarded to the complainant by the magistrate 'is too meagre an amount'. 'The same requires a very substantial enhancement so as to actually compensate the complainant for the 20 years of torture, humiliation, economic abuse, taunts, etc., undergone by her at the hands of the respondent no. 1,' the court ruled. The court said the woman has to now also suffer being estranged from her two sons. The husband appears to have influenced the sons against their mother 'is also something which cannot be ignored', the judge said. After considering all aspects, the court raised the compensation as well as the maintenance granted to the woman and her daughter.
