Telangana HC junks plea challenging Harish Rao's election win
Hyderabad: The Telangana high court on Tuesday dismissed an election petition challenging the election of T Harish Rao as MLA from Siddipet Assembly Constituency, calling the allegations vague, baseless and lacking material facts.
Justice K Sarath pronounced the order while allowing an interlocutory application filed by Harish, who urged the court to reject the election petition filed by his political rival, G Chakradhar Goud, who had contested against Harish in Siddipet. Chakardhar had alleged malpractices, including improper acceptance of nomination, suppression of criminal cases and discrepancies in property disclosures.
The court noted that Chakardhar failed to raise objections during scrutiny or provide evidence of improper nomination acceptance.
The MLA had disclosed pending criminal cases and convictions in his affidavit (Form 26), while the petitioner provided no specifics on alleged suppression. The complainant's claims that agricultural land was misrepresented as non-agricultural land lacked authenticated revenue documents, the court said.
Though he made allegations against Harish's poll expenditure, he did not submit records or demonstrate violations.
The judge also looked at allegations of manipulated voting percentages (45% to 85% in an hour) and said that there was no booth-wise data or copies of the complaints made to the authorities to substantiate these allegations.
The election petition lacked concise material facts as required under the Representation of the People Act, 1951, the judge said. He also said that Chakaradhar's reliance on unverified WhatsApp audio and video clips without corroborative evidence was insufficient.
Citing Supreme Court precedents in Kanimozhi Karunanidhi, Harishankar Jain cases, the judge said bald allegations without triable issues warrant summary dismissal.

SC refuses to quash cheating case against senior advocate: 'Shocking! you acted like a broker', it says; rejects plea to refund
NEW DELHI: The Supreme Court on Wednesday expressed shock and dismay over a 69-year-old senior advocate cheating a person of 1.68 crore rupees by acting as a land broker and dismissed the plea for quashing the criminal case against him in lieu of his undertaking to refund the swindled amount. Tired of too many ads? go ad free now A partial working day bench of Justices Prashant Kumar Mishra and Manmohan said, 'It is not a case for settlement. You may be a lawyer, but your conduct is outrageous. You should face trial and get convicted.' 'A senior advocate is doing brokering. He is doing land transactions through his clerk. He collected Rs 1.68 crore and refused to refund. This is shocking. He even got his intern, a law student, involved in this act. And all this is happening in a senior advocate's chamber,' the bench said. The senior advocate, R Manickavel, posing as the agreement holder of the original owner of a property, promised to offer that property for a sale consideration of Rs 3.25 crore. On various occasions, a sum of Rs 1.68 crore was received by the senior advocate without introducing the title holder to the complainant. Smelling a rat, the complainant insisted on meeting the original owner. Manickavel told the complainant to pay the balance amount if he had confidence in him. If not, he could take back the advance payments of Rs 1.68 crore. The complainant sought a refund of the advanced amount. Manickavel repaid only Rs 40 lakhs. On verification, the complainant came to know that the original landowner had settled the said property in favour of her legal heirs. When the complainant demanded return of his money, Manickavel along with co-accused, refused to pay and threatened him with dire consequences. Tired of too many ads? go ad free now He lodged a police complaint in 2011 accusing the lawyer of cheating. The Chennai police filed a chargesheet in 2023, of which the Egmore Magistrate has taken cognizance. The Madras HC on Apr 30 this year dismissed his plea for quashing of the case. Against this order, he had appealed in the SC.

Assam will deport 'foreigners' even if their names feature in NRC: Himanta
Assam Chief Minister Himanta Biswa Sarma has said that the State government's current policy is to push back foreigners even if their names are found in the National Register of Citizens (NRC). The way the NRC was carried out in Assam leaves a lot of scope for doubt, and it cannot be the only document for determining a person's citizenship, Mr. Sarma said. The NRC, an official record of bonafide Indian citizens living in Assam, was updated under the supervision of the Supreme Court and released on August 31, 2019, leaving out more than 19 lakh applicants. However, it has not been notified by the Registrar General of India, leaving the controversial document without any official validity. ''Many people had entered their names in the NRC by using unfair means. So we have adopted the policy of pushing back (foreigners) if the authorities are absolutely convinced that the persons concerned are foreigners,'' the CM said on the sidelines of a programme in Darrang on Wednesday. 'Doubtful' citizens A large number of people have been picked up from across Assam since last month on suspicion of being doubtful citizens, as part of a nationwide drive, and many of them were pushed back to Bangladesh. Some of them returned after the neighbouring nation refused to accept them as their citizens. ''Personally, I am not convinced that the presence of a name in the NRC alone is enough to determine that someone is not an illegal migrant,'' he said. Asked whether a section of officials did not carry out the NRC exercise with due diligence, Mr. Sarma said that is a possibility. Harsh Mander Mr. Sarma alleged that social activist and author Harsh Mander had camped in Assam for two years, and sent some youths from the state to America and England for education and encouraged them to manipulate the NRC. "These matters came to my knowledge after I became the chief minister,'' he said. Mr. Sarma, speaking on detection and deportation of foreigners, during a special assembly session on June 9, had said the state government will implement the Immigrants (Expulsion from Assam) Act, 1950, for the purpose, which allows the district commissioners to declare illegal immigrants and evict them.
