Until President Donald Trump confirmed that the United States carried out "very successful" strikes on Iran's nuclear facilities at Fordow, Natanz, and Isfahan, he remained non-committal and ambiguous about America's involvement in Israel's war with Iran.
" I may do it. I may not," Trump said on Wednesday when asked whether he planned to join the conflict.
That uncertainty vanished Sunday when US military jets launched precision strikes on key Iranian nuclear sites. Shortly after the operation, Trump declared, "Now is the time for peace."
This has led to debate over presidential war powers. Critics argue that Trump bypassed Congress, which, under the US Constitution, holds the sole authority to declare war.
What Is The War Powers Act?
The War Powers Resolution of 1973, commonly known as the War Powers Act, is a federal law intended to check the president's authority to commit US military forces to armed conflict without Congressional approval. It was enacted by Congress as a direct response to the Vietnam War (1955-75) and, more specifically, President Richard Nixon 's secret bombing of Cambodia, which killed thousands and sparked mass protests across the US.
Who Can Declare War In The US?
The US Constitution divides war powers between the legislative and executive branches. Under Article I, Section 8, Congress holds the power to declare war, raise and fund armies, and regulate the armed forces. Article II designates the president as Commander-in-Chief, granting the executive authority to lead the military and respond to emergencies. This division was meant to prevent unilateral decisions about war by any one branch of government.
Can A President Strike Without Congressional Approval?
Under the War Powers Act, if the president sends US troops into combat or near conflict, they must tell Congress within 48 hours.
After that, the president can keep troops there for up to 60 days without approval. If Congress doesn't give the green light, the president has 30 more days to pull the troops out, making a maximum of 90 days without official authorisation.
When Did The US Last Declare War?
The last time the US formally declared war was in 1942, during World War II, against Bulgaria, Hungary, and Romania.
Since then, the US has engaged in some deadly wars, including Korea, Vietnam, the Gulf War, Afghanistan, and Iraq, without formal declarations. It has also carried out military interventions and airstrikes in countries like Libya, Serbia, Somalia, and Yemen, relying instead on congressional authorisations or presidential powers.
How Does The US Go To War Without Declaring It?
The US has often bypassed formal war declarations by using Authorisations for Use of Military Force (AUMFs), laws passed by Congress to allow specific military actions. After 9/11, the 2001 AUMF gave President George W Bush broad powers to target al-Qaeda and its allies.
In 2002, a second AUMF-authorised action against Iraq led to the 2003 invasion. Both laws remain in effect and have been used by later presidents to justify military operations far beyond their original scope.
For instance, President Donald Trump cited the 2002 AUMF to justify the 2020 drone strike on Iranian General Qassem Soleimani.

1 2 Berhampur: Eight men were arrested on Tuesday and a minor detained for their alleged involvement in torturing two dalit men in Ganjam district on Sunday, suspecting them to be cattle smugglers. The men were assaulted, allegedly tonsured and made to crawl on their knees for a kilometre. The accused also forced them to eat grass and drink water from the drain, the two men claimed in their FIR at Dharakote police station. Those arrested were identified as Siba Shankar Mohapatra (25), Satya Sahu (20), Bainath Bisoyi (23), Om Gouda (23), Ganapati Polai (36), Santosh Dakua (30), Shankar Das (25) and Narayan Dakua (30). "Some others were also involved in the case and search is on to nab them," said Santosh Kumar Jena, SDPO, Aska. The incident resulted in widespread protests with Congress leader Rahul Gandhi seeking immediate action against the culprits. Describing the incident as inhuman, Rahul, the opposition leader in Lok Sabha, said it is a mirror for those who claim caste is no longer an issue. "Each incident that tarnishes the dignity of the Dalits is an attack on Baba Saheb's constitution and a conspiracy against equality, justice, and humanity," Rahul posted on X. Close to the village, he was stopped by a group of men, who accused Babula of being a cow smuggler. They demanded Rs 30,000 from him. When he refused to pay, the accused started assaulting him. The Mahasabha submitted a memorandum to chief minister Mohan Charan Majhi through the commission's office. "The govt should issue guidelines about the transportation of cattle. Farmers are afraid while transporting cattle for their own use due to the fear of miscreants," said Bhala Chandra Sarangi, a dalit leader who participated in the demonstration. BJD has also condemned the incident. "This incident has defamed Odisha and every Odia. The law and order machinery has collapsed. There is no semblance of administrative efficiency," BJD spokesperson Lenin Mohanty said, demanding strong action against the perpetrators. Responding to the allegations, senior BJP leader Ram Chandra Panda said the govt has been very alert to such incidents. "Police took prompt action against the perpetrators by rounding up the main culprits," Panda said, advising opposition parties not to politicise the issue and let police investigate the matter.

She said that Gandhi's remarks were indicative of his 'lack of knowledge and understanding of the electoral process'. 'Rahul Gandhi should be happy when more people register their names in the voter list and when more and more people come out to vote... The work done by the Election Commission is to register new voters. Your (Rahul Gandhi) repeated baseless allegations make one thing clear: you lack the knowledge and understanding of the electoral process and how it works in a democracy.' Her remarks come after Gandhi claimed earlier in the day that the voter list in CM Fadnavis's constituency grew by eight per cent in just five months and labelled it 'vote theft.' The former Congress President claimed that Booth Level Officers (BLOs) reported unknown individuals casting votes in Nagpur South West, where Fadnavis won last year by over 38,000 votes. He also pointed out that the media have also uncovered thousands of voters with no verified address. 'In Maharashtra CM's constituency, the voter list grew by 8% in just 5 months. Some booths saw a 20-50% surge,' Gandhi said on X. 'BLOs reported unknown individuals casting votes.
