Quick-thinking woman and DNA solve cold case sexual assault, NM officials say
A man accused of sexually assaulting a woman more than a decade ago has been convicted, New Mexico prosecutors said.
Omar Navarro-Flores was convicted in the 2014 cold case sexual assault of a woman, the Bernalillo County District Attorney's Office said in a May 30 Facebook post.
Navarro-Flores pleaded not guilty at his June 2019 arraignment, court documents show.
In a June 2 email to McClatchy News, Assistant Public Defender Graham Dumas, Navarro-Flores' attorney, noted that his client's conviction came during a retrial 'after he was acquitted in November of a number of very serious offenses.'
'The Defense stand by our argument that he was denied a fair trial by the incredibly poor police investigation into the case. The police, who allowed this case to lie dormant for five years, did not even try to locate critical witnesses or surveillance footage from the street corner where Mr. Navarro-Flores first allegedly encountered (the woman),' Dumas said. 'By the time this case was indicted in 2019, no amount of defense investigation could address that issue.'
As a woman was walking to a bus stop May 6, 2014, a man grabbed her and 'threw her in his car,' prosecutors said.
The man drove around Albuquerque with the woman, threatening 'she would never see her children again,' prosecutors said.
He sexually assaulted and physically attacked her, 'hitting her head against the steering wheel, and slapping her,' according to prosecutors.
During the alleged attack, the woman managed to write down the man's license plate number on her wrist, prosecutors said.
After being dropped off at the State Fairgrounds area, the woman contacted security, who 'called police and an ambulance,' prosecutors said.
The woman gave police the license plate number from her wrist, prosecutors said.
Days later, officers pulled Navarro-Flores over, then 'his car was towed and searched,' prosecutors said.
DNA ultimately linked Navarro-Flores to the alleged sexual assault, according to prosecutors.
He was arrested in June 2019, court records show.
On May 30, a jury found Navarro-Flores guilty of criminal sexual contact and false imprisonment, prosecutors said.
'We will continue to fight for Mr. Navarro-Flores at sentencing, and on appeal if he so chooses,' Dumas said.
Navarro-Flores' conviction comes after the city of Albuquerque established a project to test a backlog of rape kits per the direction of Mayor Tim Keller's 2018 executive order, the city says on its website.
'The implementation of The Sexual Assault Evidence Kit Backlog Reduction Project is the first step to correcting oversights and changing the course of action for the future,' the website says.
Between 2017 and 2020, more than 4,500 backlogged sexual assault evidence kits were tested, data on the city's website shows.
'As part of a coordinated effort to address Albuquerque's backlog of untested, Sexual Assault Kit cases,' the Sexual Assault Kit Initiative was also formed, according to the district attorney's website.
'The SAKI Team, a dedicated group of attorneys, investigators and victim advocates, is tasked with reviewing, testing and prosecuting rape kit backlog cases and working with victims to build cases and provide them with supportive services and resources,' the website says.
The district attorney's office SAKI unit, which has had 24 cold case rape convictions in two years, prosecuted Navarro-Flores' case, prosecutors said.

A 46-year-old man is heading to prison in connection with a revenge killing in New Mexico, prosecutors said. Theodore Toney was sentenced to life behind bars after being convicted of first-degree murder in Kenneth Ellis' April 2024 death, the Bernalillo County District Attorney's Office said in a June 3 post on Facebook. The fatal shooting during an Albuquerque dance event came about eight years after Ellis gave testimony against Toney's son during a homicide trial, prosecutors said, adding that 'Toney threatened Ellis and his family after Ellis testified.' Toney's attorney, Jonathan Schildgen, said in a June 4 email to McClatchy News that 'Mr. Toney is innocent and looks forward to his appeal.' Schildgen added, 'We object to the imposition of a life sentence as cruel and unusual punishment.' In an online obituary, Ellis was described as 'a die hard New England Patriots fan' and a Christian with 'a very good relationship with the lord and savior.' He played semi-professional football for years and coached youth sports, the obituary said. The 40-year-old married father 'touched so many peoples lives in such positive ways,' the obituary said. '(He) was so full of life, he always had a smile on his face and would tell people life is too short to be angry all the time.'

12-year-old boy and dad die after car crashes into water, Florida police say
A father and his 12-year-old son died of their injuries after a collision with another vehicle sent their Mustang crashing into water, Florida police said. The 43-year-old dad and his son were driving on Veterans Memorial Parkway shortly before 2:30 p.m. June 2 when their vehicle was involved in a crash with another, according to the Cape Coral Police Department. The impact of the collision caused their Mustang to veer off the road into a retention pond, where the car sank underwater, police told McClatchy News over the phone. The father and son were both pulled from the vehicle but later died, police said. 'We are deeply saddened to report that both the child and adult injured in this traffic crash have succumbed to their injuries,' Cape Coral police said in an update June 4. 'Our thoughts are with their loved ones during this incredibly difficult time.' The School District of Lee County confirmed to WFTX the boy was a student of Gulf Middle School. 'We are deeply saddened to share the news that one of our students passed away today,' school officials wrote in a statement obtained by the outlet. 'We know that some of you may have already heard about this tragic incident, and our hearts go out to all affected. Please don't hesitate to reach out if your child needs assistance in coping with this loss.' The passengers in the other vehicle sustained minor injuries, police told McClatchy News. The investigation into the crash is ongoing. Cape Coral is part of the Fort Myers metropolitan area in southwest Florida.

Former GA deputy accused of attacking 3 women, 2 of them are police officers
A former Walton County Sheriff's Deputy is accused of attacking three women. Two of the victims are Georgia police officers. Police said Alex Ross assaulted the women at the Georgia Peace Officer Standards & Training (POST) Council Office because he was upset about information he received regarding his post certification. 'We heard someone yelling, 'Help, help, help,'' Lt. Tim Allen with Austell Police Department told Channel 2 Cobb County Bureau Chief Michele Newell. Those cries came from the office, which is located in the same building as the Austell Police Department. 'When (officers) got there, the gentleman had his hand on the officer's gun, trying to get it out the holster. They were able to subdue him,' Allen said. 'He had been there at Georgia Peace Officer Standard Training Council inquiring about his post certification. According to the warrant, Ross continued his attack by striking another Georgia peace officer and punched a civilian employee in her eye, causing bruising and swelling. All three victims were hospitalized. 'One of the police officers had a fractured bone in her face from the punch,' Allen said. Ross is facing numerous felony charges, including violation of oath by a public officer. 'It was definitely that took us all by surprise, but we were very grateful for the reaction from everybody cause it definitely could have gone the wrong way,' Allen said. Ross resigned from the Walton County Sheriff's Office in 2022, rather than be fired. Newell contacted Georgia POST to learn more about this incident and is waiting to hear back.
