
KZN IEC official accused of stealing voting material acquitted
DURBAN - The IEC official accused of stealing voting material in KwaZulu-Natal has been acquitted on all charges by the Pietermaritzburg Magistrate's Court.
Musawenkosi Mnikathi was an area manager in Imbali during the 2024 general polls.
He faced charges linked to transporting voting ballots without police supervision.
The Umkhonto Wesizwe Party laid charges against him, accusing him of rigging the votes.

Although the court earlier this year said he had a case to answer, IEC official Musawenkosi Mnikathi is now a free man.
The court has found him not guilty of contravening some provisions of the Electoral Act.
IEC Chief Officer, Sy Mamabolo, welcomed the ruling.
"We think that they should have listened to the event organiser, which is the electoral commission, who have appointed these officers and given them the responsibility to move material,s because the absence to move materials - the electoral process would collapse at certain voting stations."
He adds that it was part of Mnikathi's role to supply voting material.
"It's sad that we've had to put an individual through such a solid experience; it should have never been the case."

Tensions erupt: Magistrate and litigant clash in White River court
A chance meeting in the corridors of White River Magistrate's Court on Monday, led to a tense confrontation between Magistrate Thomas Sibuyi and Barend Byliefeldt, a central figure in an ongoing assault case. Byliefeldt was in court to testify in an assault case he had opened in March 2021, following an incident in which he and his wife, Delia, were allegedly threatened, and he assaulted, at White River Police Station. ALSO READ: Couple seeks sanctuary in police station away from mob of alleged assailants The incident reportedly stemmed from a roadside altercation, after which the Byliefeldts were followed to the police station, where Barend was allegedly assaulted by individuals linked to MAMRA Security Solutions and VIP Protection. The case gained further attention when AfriForum became involved, assisting the couple in their legal battle against the alleged assailants. The Private Security Industry Regulatory Authority (PSIRA) launched an investigation into MAMRA Security, revealing that the company was not properly registered. Meanwhile, the owner of MAMRA Security Solutions and VIP Protection, Mathlatse Maroga, filed a counter-case against Barend for malicious damage to property and crimen injuria. ALSO READ: Petition against White River Police Station gains traction The controversy surrounding the case intensified when questions were raised about the police's handling thereof, with allegations that officers failed to intervene during the assault. The matter was referred to the Independent Police Investigative Directorate (IPID) for further scrutiny. ALSO READ: Investigation into White River Police Station results to be released next week In the recent altercation, Barend, who is facing separate criminal charges of assault and crimen injuria – one stemming from allegations that he assaulted a Mozambican citizen with a wheel spanner – admitted to Lowvelder on Tuesday that he had directed a racially charged remark at Sibuyi. The remark reportedly escalated the confrontation between them. According to witnesses, chaos erupted when Barend approached Sibuyi to ask a question, but Sibuyi refused to engage. A video of the altercation, recorded by Barend, was later circulated on social media. Court staff intervened to separate the two men, preventing the situation from escalating further. In the footage, Sibuyi can be heard reacting angrily, shouting: 'You called me a racist!' to which Barend responded, 'Yes, you are, but you are!'. He also alleged that Sibuyi attempted to assault him with a brick and used profane language. In April 2025, an application was filed requesting Sibuyi's recusal due to alleged racial remarks made in court. Adv Johan de Necker presented the application, and Sibuyi subsequently stepped down from the matter. Following Monday's altercation, police requested that Barend leave the court premises. He later stated that he is considering legal action against Sibuyi, pending legal advice. Meanwhile, Delia confirmed that she has launched a crowdfunding campaign to cover her husband's legal expenses. She disclosed that she had sold her car to pay for De Necker's legal fees, amounting to R35 000, and has raised $3 459 (± R61 000) so far. Phumlani Mfeka emerges as front-runner for MKP Secretary-General position

Image: Supplied As speculations gather momentum on who the uMkhonto weSizwe Party (MKP) supreme commander Jacob Zuma was considering to appoint as the new party Secretary-General following the axing of Floyd Shivambu, Phumlani Mfeka has emerged as the front runner for the position. The position became vacant after the party axed Shivambu on Tuesday following his unsanctioned trip to Malawi, where he attended a church service of a fugitive pastor, Shepherd Bushiri, who skipped bail in South Africa in 2020. Mfeka, the leader of socio-economic group Injeje yaBenguni, which advocates for African nationalism, was expected to hold a meeting with Zuma in Durban on Thursday. Sources within the party said the discussion will be followed by Mfeka's announcement as the new Secretary-General. Mfeka commands a lot of support from traditional leaders, something that Zuma regards as an important constituency for his party. Mfeka confirmed earlier on Thursday that he would meet Zuma in Durban but refused to be drawn on what they would discuss in their meeting, saying it was a private meeting between himself and the party leader. Mfeka's name had always been mentioned as a possible successor to Shivambu after rumours of his (Shivambu's) future in the position started circulating. The rumours were fueled by Shivambu's fallout with Zuma's daughter Duduzile Zuma-Sambudla, who publicly insulted him and questioned his leadership, as well as Mfeka himself, who, when resigning as both a party member and a member in the KwaZulu-Natal Legislature, cited issues with Shivambu as one of the reasons. Other names that emerged on Tuesday after Shivambu's fall were former ActionSA member and founder of Xiluba Party, Bongani Baloyi, who joined the MKP in September last year, and Advocate Busisiwe Mkhwebane. However, sources in the party said Zuma will opt for Mfeka because of his support among traditional leaders and traditionalists, particularly in KwaZulu-Natal, which is the party's stronghold. It is believed that Zuma convinced Mfeka to return to the MK Party because he (Zuma) felt he needed Mfeka and his constituency in the party. Mfeka has been Zuma's strong backer before the founding of the MK Party and immediately joined after it was launched in 2023. He was on the national list to parliament during last year's general elections, however, he was deployed to serve in the KwaZulu-Natal Legislature and sat in various portfolio committees. He was among the dissenting voices within the party who were unhappy that senior positions were given to the newcomers while overlooking the founding members. The city has hailed the arrest as a significant breakthrough in the ongoing investigation into the theft. This comes three months after the city reported the suspension of a finance department employee amid internal investigations linking him and two colleagues to a R10 million-plus fraud scheme that allegedly occurred between May 2021 and January 2022. The alleged scheme involved collusion between city officials and the public to manipulate user debit balances by transferring funds into municipal accounts controlled by the syndicate. 'The employees would collect what the user had intended to pay and, instead of paying that amount into the city's account, the user's account would be credited through the fraudulent transfer of the debit balance into the ghost account. They would then pocket the amount that the user had intended to pay,' the city said. This week, municipal spokesperson, Lindela Mashigo, said Abbort, a former director and accountant, who had been evading arrest, was finally apprehended after an intensive tracing operation led by the city's Forensic Services Division, in collaboration with Lyttleton SAPS. During her court appearance, Abbort applied for bail of R5,000, which was opposed by the National Prosecuting Authority, who requested bail be set at R200,000. The court ultimately granted Abbort bail of R50,000 with strict conditions, which include surrendering her travel documents, reporting twice weekly to her nearest police station, and residing at her current address unless she notifies the investigating officer. The investigation is ongoing, and the city said it will now probe potential collusion between Abbort and the account holders who benefited from the unauthorised transfers. Mashigo said the city's Revenue Management Division is reviewing the affected accounts and will initiate reversals where necessary. He warned residents to be vigilant against individuals or groups posing as agents claiming to 'clear' municipal debt, stating that these schemes are fraudulent and may result in criminal charges and financial loss. Residents in debt are encouraged to visit one of the city's customer care walk-in centres to make legitimate and sustainable arrangements. City Manager Johann Mettler praised the Forensic Services Division team for their outstanding work in combating corruption within the city, highlighting their commitment to identifying and reporting criminal conduct and ensuring accountability. He also called for forensic investigators to be designated as peace officers under the Criminal Procedure Act, stating that this would enhance the city's capacity to act decisively and in real-time against financial crime. 'We believe the city's fight against financial crime would be significantly strengthened by designating forensic investigators as peace officers under the Criminal Procedure Act, a move that could enhance our capacity to act decisively and in real time,' he said.
