SC tells journalist to remove YouTube video containing allegations about judge

The Supreme Court on Friday ordered journalist and YouTuber Ajay Shukla to remove a video in which he made 'scandalous allegations' about a retired judge, Bar and Bench reported.
A bench headed by Chief Justice BR Gavai initiated contempt proceedings on its own motion against Shukla, the editor-in-chief of Varprad Media, and issued a notice to him.
While the court did not explicitly name the judge about whom the allegations were made, Shukla had on May 18 uploaded a video on his YouTube channel 'The Principle' about the retirement of Justice Bela M Trivedi, describing her as a 'godi judge', or a pro-government judge.
While Trivedi is officially slated to retire on June 9, her last working day was May 16.
The term 'godi judge' is similar to 'godi media', or lapdog media – a phrase popularised by journalist Ravish Kumar to describe pro-Bharatiya Janata Party media outlets.
The bench on Friday said that 'such scandalous allegations widely published are likely to bring disrepute to the august institution of the judiciary' and remarked that the freedom of expression is subject to 'reasonable restrictions'.
'A person cannot be permitted to make allegations which are in the nature of defaming a judge of this Court and also contemptuous in nature, which attempts to bring disrepute to the institution of the judiciary,' the court said, according to Live Law.

Contribute now New Delhi: An important witness in the case pertaining to the murder of journalist-activist Gauri Lankesh has complained to the special court about receiving threats from people who told him not to identify the accused. The witness, a resident of Belagavi received the threats over a phone call on May 28 and submitted a written complaint on the same day, reported Deccan Herald. 'The witness received a phone call where he was threatened not to identify the accused. He filed a complaint before the court. Though he was disturbed and upset, he testified before the court on Thursday,' a source told the newspaper. A copy of the complaint and a memo by the special public prosecutor were submitted to the court. The witness who has been threatened was crucial in identifying the accused and the place where the alleged conspiracy was hatched to murder Lankesh. Well-known journalist and editor Lankesh, a household name for readers in Karnataka because of her sharp writing and bold views, was shot dead at her residence in Bengaluru late on September 5, 2017. She was editor of the weekly Lankesh Patrike – a magazine that has been described as an 'anti-establishment' publication – and had come under attack for her views against the communal politics of the Sangh parivar in Karnataka. The chargesheet in her murder case had said that the assassination was an 'organised crime' carried out by people associated with the Sanatan Sanstha, an extremist right-wing Hindutva organisation. The current BCCI president and former Indian all-rounder, Binny, is turning 70 on 10 July of this year and that means he cannot continue to be the head as per the age-cap rule. The BCCI constitution states that any office-bearer, including the president, needs to exit the office upon reaching the age of 70. The age-cap rule was added to the BCCI constitution during the reforms undertaken by the Justice Lodha Committee. 'Shukla, who currently serves as BCCI vice-president, is a veteran cricket administrator and seasoned politician with prior experience as chairman of IPL,' the source added. Who is BCCI vice-president Rajeev Shukla? Shukla dons multiple hats in life. He was earlier a journalist but now a politician. The 65-year-old Shukla hails from Kanpur and is currently a Member of Parliament in the Rajya Sabha from Chhattisgarh. He is also a member of the Congress Working Committee. He was also a Union Minister of State in the Ministry of Parliamentary Affairs and the Ministry of Planning between 2011 and 2014. Shukla also served as the Indian Premier League (IPL) chairman for many years in the past before taking over as the BCCI vice-president in December 2020.
