
Bombay HC orders BMC to pay Rs 50 lakh each to kin of 8 Kurla hotel fire victims, cites ‘gross negligence'

Bombay High Court
on Tuesday directed the
Brihanmumbai Municipal Corporation
(BMC) to pay ₹50 lakh each to the families of eight individuals who died in a devastating fire at
Hotel City Kinara
in Kurla in October 2015.
The bench, comprising Justices B.P. Colabawalla and Firdosh Pooniwalla, held the civic body directly responsible for failing to act on known safety violations, calling its conduct a 'gross breach' of statutory duties.
Seven of the victims were young students aged between 18 and 20, while the eighth was a 31-year-old engineer from Virar. The fire broke out on October 16, 2015, when the hotel was operating without mandatory fire safety clearances.

Hotel ran illegally, BMC failed to act
The court noted that the hotel violated multiple licensing conditions—most critically, running a public service area on a mezzanine floor designated only for storage and lacking a no-objection certificate (NOC) from the fire department. The victims were seated on this floor when the blaze erupted.
Despite multiple complaints and inspections, the BMC failed to shut down the establishment. The court said this inaction was directly linked to the loss of lives and amounted to a violation of the victims' fundamental right to life under Article 21 of the Constitution.

The civic body attempted to deflect blame onto the hotel owners, stating that internal disciplinary action had been taken against four officials. The court, however, rejected this argument and underscored that when public safety is involved, the authorities are held to a higher standard of accountability.

'Had the BMC taken prompt action, the incident would not have occurred,' the court observed, ordering that the compensation be paid within 12 weeks. It described the civic body's role in issuing a licence without fire safety approvals as one of the 'most egregious' breaches in the case.
The judgment sends a strong message about institutional accountability in matters of public safety and reaffirms the judiciary's stance on the State's responsibility in preventing avoidable tragedies.

Work on at synagogue despite notice: Plaint to civic chief
Mumbai: The standoff over "illegal repair work" at the Magen David Jewish synagogue in Byculla continues despite the stop work notice issued by BMC. Complainant Moshe Shek who has been pursuing the alleged illegal restoration of the heritage structure met BMC chief Bhushan Gagrani on Thursday. Shek, himself a Jew, revisited the synagogue on June 6 and found that labourers were continuing "heavy repair work" behind closed doors despite lack of requisite permissions. Police were called to the site. Synagogue trust chairperson Solomon Sopher said no violations were being committed and that everything was in consonance with the law. "Propping work is on to safeguard schoolchildren who are only about 50ft away. No additional repair work is undertaken until the necessary permission is obtained." Arun Chavan, designated officer from BMC's E ward, said the trust has appointed an architect and a structural consultant. "We have been informed that scaffolding made of mild steel has been erected to support the ceiling. Army jawan swept away while trying to save friend
Dehradun: A 25-year-old Army personnel drowned in the Nandakini river in Chamoli while trying to save his friend who had fallen into the river while taking bath on Wednesday. Sunil Rawat, who was attached with the Army's Garhwal Rifles regiment and was currently posted in Punjab, had come home in Nandanagar in Chamoli district on leave for a religious event. Nandanagar SHO, Narendra Rawat, said, "Around 2pm, Rawat had gone for a bath with three friends from the same area at the confluence of Punera rivulet and Nandakini river. While bathing, one of his friends slipped and went deep into the water. To save him, Rawat jumped into the water. But sadly, he was swept into a whirlpool at the confluence and drowned. His three friends couldn't save him as there were large boulders in the river." He added that "the Army jawan's body was found by rescue teams stuck between boulders, under the water." "The body was sent to a nearby hospital for postmortem," he said. In a separate incident in Chamoli, two men from Haryana, working as labourers in a factory, were killed after their motorcycle was hit by a landslide near Jyotirmath on Wednesday. Police said the incident took place near Sarot temple. It involved the Haryana-registered van and a UP-registered car with the seven injured occupants.
