The Uttarakhand High Court on Monday stayed the upcoming panchayat elections in the state over disputes in reservation.Acting on petitions against the reservation rotation process for the three-tier panchayat polls in the state, a division bench of Chief Justice Guhanathan Narendar and Justice Alok Mehra stayed the polls scheduled to take place in two phases on July 10 and 15, respectively.According to the dates announced recently by the state election commission , the counting of votes was to be done on July 19.The stay will remain in force till further directions, the bench saidThe stay comes at a time when the model code of conduct for the upcoming elections were in force in the urban areas in the 12 districts slated to go to polls. State Election Commissioner Sushil Kumar had issued the notification for the panchayat elections in the state on June 21 along with a detailed poll schedule according to which nominations for the polls were to begin on June 25.Panchayat polls were eagerly awaited in Uttarakhand as the administrators appointed in the panchayats after had completed their term.Secretary Panchayati Raj Chandresh Kumar said the process of notification (gazette notification) of rules related to reservation system in three-tier panchayat elections was in progress.The high court's interim stay order on the reservation process in panchayats is being properly complied with, he said.The copy of the gazette notification of Reservation Rules 2025 is being sent to the Government Press Roorkee for printing, which will be issued soon and presented before the high court so that proper judicial guidance can be obtained, Kumar added.He clarified the state government was committed to operate the Panchayati Raj system in a constitutional and legal manner while respecting fully the dignity and instructions of the court.

HYDERABAD: The Telangana high court, which heard a batch of petitions filed by sarpanches seeking timely conduct of elections to the gram panchayats, on Monday concluded its hearing and reserved its judgment The term of the sarpanches ended in Jan 2024. The sarpanches, opposing rule by special officers, are urging the court to direct the state to either conduct the polls or to continue them till the elections are conducted. Justice T Madhavi Devi, who heard the matter, sought to know from the state why it could not hand over the required statistics and information to the State Election Commission (SEC), which would conduct the polls. Arguing the case of the state, additional advocate general T Rajanikanth Reddy sought 25 days. Senior counsel G Vidya Sagar appeared for the SEC and said they need two months from the time the state furnishes them the details of voters, etc. Gummalla Bhaskar Reddy, the counsel for the petitioners, said that the term of the current sarpanches was ended on Jan 31, 2024. Though the state is under an obligation to conduct it within six months, it has not been done so far. The non-conduct of poll is violative of the Articles 243E and 243K of the Constitution, besides being contrary to the provisions of the Telangana Panchayat Raj Act, 2018, he said. The judge reserved her orders.

Under the reservation rotation system, constituencies are reserved for various categories for three terms, after which the quota goes to other seats. With the existing rotation being nullified and a new rotation starting this year, Kandpal, represented by Advocate Shobhit Saharia, said a seat that had been reserved for the last three terms will again be reserved this year. This, Kandpal argued, has prevented him from contesting the election. The petitioner argued that the High Court had already issued guidelines on this matter in the past. The petition was filed on Thursday and the Division Bench of Chief Justice G Narender and Justice Alok Mahra heard the matter on Friday. On Monday, the court stayed the election proceedings until the state furnishes the notification for the new rules for panchayat polls. The state has also been asked to present its policy on reservation. Following the stay order, Panchayati Raj Secretary Chandresh Kumar said, 'The High Court has currently stayed the panchayat elections as there is no gazette notification issued for Reservation Rules 2025 yet. In this connection, I have spoken to the Government Press, Roorkee, to make a copy of the gazette notification available to the state government, which can be submitted in the High Court to lift the stay.'
