The Kerala High Court recently upheld a widow's right to reside in her matrimonial home, rejecting objections raised by her in-laws, who had attempted to evict her.
The bench of Justice MB Snehalatha dismissed a revision petition filed by the relatives of the deceased husband of a 41-year-old woman who had approached the courts seeking protection from harassment and forceful eviction from the shared household after her husband's demise in 2009.
The high court affirmed the decision of the sessions court in Palakkad, which had granted protection and residence orders in the woman's favour after overturning the findings of the judicial magistrate, who had initially dismissed her plea.
The woman alleged that following her husband's death, her in-laws began to harass her and obstruct her and her children's entry into the family home. She approached the court under Section 12 of the Protection of Women from Domestic Violence Act, 2005. However, the magistrate's court held that she had no existing 'domestic relationship" with her in-laws and therefore wasn't entitled to relief under the Act.
The sessions court took a different view and granted her the relief sought. The in-laws challenged this before the high court, arguing that the woman owned separate property and had been living at her parental home, thus disqualifying her as an 'aggrieved person" under the Act.
Rejecting these arguments, the high court noted that the woman, being the wife of the deceased and having resided in the shared household, fell squarely within the definitions under Sections 2(a), 2(f), and 2(s) of the DV Act. The court reiterated that the right to reside in the shared household does not depend on ownership or continuous residence at the time of the dispute.
Quoting extensively from the Supreme Court's 2022 ruling in Prabha Tyagi vs Kamlesh Devi, the judgment emphasised that women's right to shelter and security within a domestic setting is fundamental and cannot be undermined merely because they possess alternate accommodation or temporarily reside elsewhere.
'This right is crucial for a woman's safety and dignity, ensuring that she is not forcibly removed or homeless due to domestic abuse," the court observed, while also stressing that the DV Act should be interpreted liberally in favour of victims, keeping its beneficial and protective purpose in mind.
Finding no merit in the arguments of the in-laws, the high court refused to interfere with the sessions court order. The revision petition was, accordingly, dismissed.

The Supreme Court on Thursday allowed the National Board of Examinations (NBE) to conduct the NEET-PG 2025 exam on August 3, stating it was satisfied that the reasons cited by the board for the proposed date were bona fide. This comes after the apex court, in its May 30 order, had disallowed the conduct of the exam in two shifts and directed that the examination be held in a single shift only. Following this, the NBE had sought additional time to restructure the process accordingly, which the court has now approved. On May 30, A bench comprising Justice Vikram Nath, Justice Sanjay Kumar, and Justice N.K. Anjaria passed the order while hearing a batch of petitions challenging the NBE's decision to conduct NEET-PG 2025 in two shifts. 'Conducting the exam in two shifts results in arbitrariness and fails to ensure a level playing field. The question papers across the two shifts can never be of the same difficulty level. While last year it may have been held in two shifts due to specific circumstances prevailing at the time, the examining body should have made efforts to conduct the examination in a single shift this year," the Court observed in its order. Last year, the National Board of Examinations in Medical Sciences (NBEMS) announced the NEET-PG results on August 23. Shortly after, numerous candidates raised concerns about discrepancies, claiming that flawed normalisation in the multi-shift exam had resulted in unexpectedly low ranks. Many aspirants compared their responses with unofficial answer keys released by coaching institutes and highlighted inconsistencies, which further intensified dissatisfaction with the multi-shift format. NEET PG (National Eligibility cum Entrance Test for Postgraduate) is a national-level entrance exam in India conducted by the National Board of Examinations (NBE). The Supreme Court on Friday granted extension to the National Board of Examination (NBE) for holding of the NEET PG (post graduate) examination on August 3, 2025. The exam was initially scheduled to be held on June 15, 2025. A bench of Justices Prashant Kumar Mishra and Augustine George Masih clarified that no further extension will be granted to NBE in this regard. On May 30, the Supreme Court had ordered that the NEET PG examination be held only in a single shift. Subsequently, the NBE had moved an application in the top-court seeking an extension of time to reschedule the examination on a later date as fresh arrangements would have to be made to comply with the single-shift order.
