Killer of Met sergeant Matt Ratana loses conviction and sentence appeal bids

De Zoysa, 27, was told he would die behind bars in July 2023 after being convicted of Sgt Ratana's murder the previous month.
Sgt Ratana died in hospital after being struck by two bullets in a holding cell in Croydon, south London, in September 2020.
At a hearing on Thursday, De Zoysa's barristers told the Court of Appeal that he should be allowed to challenge his conviction and sentence, on the grounds that he was wrongly deemed fit to plead and stand trial, and that his sentence should not have been a whole life order.
In a ruling, Dame Victoria Sharp, Mr Justice Goss and Mrs Justice Cheema-Grubb dismissed the appeal bids.
Dame Victoria said: 'All applications will be refused, for reasons which we will give in writing.'
The judge added that the written reasons for their decision will come at a later date.
New Zealand-born Sgt Ratana was hit in the chest by the first of three shots discharged within three seconds, with a second striking the 54-year-old in the thigh before De Zoysa was wrestled to the ground by other officers.
A third round hit the cell wall at Croydon's Windmill Road custody centre, before De Zoysa fired a fourth shot while on the cell floor 16 seconds later, which hit an artery in his own neck and caused brain damage.
De Zoysa, formerly of Banstead, Surrey, claimed diminished responsibility but was found guilty after the jury decided he pulled the antique weapon's trigger deliberately to fire homemade bullets, and had not suffered an autistic meltdown.
Before his trial, two High Court judges ruled that De Zoysa was fit to enter pleas, despite his injuries.
One judge was told that the former University College London student was given a whiteboard and pen to communicate with medical experts due to speech difficulties.
He also had part of his skull removed during life-saving emergency medical treatment, and suffers weakness in his right arm and leg due to his injuries.
Imran Khan KC, representing De Zoysa, who has been diagnosed with autism spectrum disorder, said in written submissions: 'The judge fell into error in finding that the applicant was fit to plead (and) to be tried. He was not.'
Referring to the sentence, he said in court: 'This case, looking at it in the round, is not one which by any stretch of the imagination falls anywhere near the evil end of the spectrum and therefore we say it should not have been a whole life order.'
The Crown Prosecution Service (CPS), opposed the appeal bids, but were not required to make submissions in court.
De Zoysa was arrested in London Road, Norbury, in the early hours of September 25 2020.
At his trial at Northampton Crown Court, jurors were shown CCTV footage of the former tax office data analyst, firing a legally bought revolver while handcuffed in a holding cell.
A bag containing seven bullets and cannabis were found during a search of De Zoysa's clothing and body, but officers did not discover a .41-calibre revolver loaded with six rounds.
As he was being transported to a police station in Windmill Road, Croydon, in a police van, De Zoysa 'retrieved' the weapon from a holster under his left arm while handcuffed.
CCTV evidence suggested he managed to get hold of the gun with his right hand around 16 minutes before the shooting and then took advantage of a vent at the back of his overcoat to hide the weapon until the incident.

A serial pervert football coach has been found guilty of raping a youngster and sexually assaulting two other boys - taking his total number of confirmed victims to seven. Russell Conn coached football teams for over 26 years and worked as a carer in a boys' residential school, a bus driver, a delivery driver and a painter and decorator. But he was secretly a serial sex offender who targeted teens when they were alone. He abused boys at locations across Scotland over a 26-year period, carrying out the sexual assaults in his work vans and in properties, and abusing one boy so badly he tried to kill himself. He was convicted of abusing three more boys at the High Court in Glasgow last week, having previously been convicted of child sex offences in 2022. His latest trial heard he repeatedly abused a boy when the youngster was aged 14 and 15. The abuse took place in Conn's vehicle, while it was parked near Ibrox Stadium. Between 2004 and 2005 he repeatedly abused another boy at Geilsland House School, a church-run residential centre in Beith, Ayrshire, which housed troubled youngsters. Conn worked at the residential school and the youngster, who was aged 15 and 16, was a resident at the time. Conn indecently assaulted him on a number of occasions. He repeatedly sexually assaulted another boy and raped him between 2013 and 2018 within vehicles and at addresses in Glasgow and across Ayrshire. The boy was aged between 15 and 19 at the time. And he raped the same boy when he was in his 20s, after forcing his way into his home in Saltcoats, Ayrshire, clamping his hand over his mouth and restraining him. Conn is due to be sentenced for the offences next month. His address was listed on court papers as Low Moss Prison, in Bishopbriggs, where he is serving the sentence was was given in his previous case. In 2022 he was jailed for nine years after being found guilty at the High Court in Paisley, Renfrewshire. The court was told he repeatedly targeted four teenagers. The court heard Conn, who was placed on the Sex Offenders' Register for life over that case, "groomed and abused boy after boy after boy after boy", leaving them "deeply damaged".. He was initially arrested and charged in 2010 - over abuse carried out on boys between 1995 and 2014 - after another teen reported abuse to police. His first trial heard Conn, of Stevenston, Ayrshire, knew one boy, who lived in a home, through the care system and tried to sexually assault him in Livingston after giving him £10 and a 10 pack of cigarettes. The boy said the incident happened on a bus which Conn had driven there. Conn admitted meeting the boy but denied he'd done anything wrong. ‌ He earned the trust of his victims and had sexual conversations with them before abusing them and often gave his victims money and cigarettes. The court heard he was guilty of "the grooming and manipulation and sexual abuse of teenage boys". His first victim said he blamed himself for the abuse and said he had planned to die without ever revealing what had happened. He said he "buried" what happened to him and "withdrew" into his "shell". ‌ He added: "I had made peace with myself and thought I'd take it to my grave with me. I put it in a wee box at the back of my head but there's barely been a day gone by where I've not thought about it." His second victim tried to kill himself within seconds of being forced on to a couch and abused in Conn's home. The dad of three said he is unable to hold down a job because of mental health problems and struggles to go to the toilet due to the abuse. And his third victim was discharged from the Armed Forces and spent time in a mental hospital after revealing the abuse he'd suffered at Conn's hands. A fourth victim had died before the case got to trial.

Harvey Weinstein has been found guilty of one charge in his sex crimes retrial, after lengthy proceedings in New York. The disgraced film mogul was initially convicted of a criminal sexual act in the first degree and rape in the third degree, in February 2020. However, his 23-year sentence was overturned last year, sparking a three-week retrial in Manhattan. After a second round of hearings, the 73-year-old was convicted of sexually assaulting Miriam Haley. He was also acquitted of a second charge stemming from sexual assault accusations made by Kaja Sokola, with the jury struggling to reach a unanimous verdict on a third count involving Jessica Mann. According to the Guardian, Judge Curtis Farber encouraged them to continue deliberating in the hopes they can find a verdict. Deadline reports that each count of first-degree criminal sexual act carries a maximum sentence of 25 years. Weinstein's previous conviction for sex crimes in New York was overturned last April by the Court of Appeal, after it was ruled that he didn't receive a fair trial in 2020. In September, he was then indicted on new sexual assault charges – but has denied all accusations against him. Earlier today, Weinstein addressed Judge Farber to plead for a mistrial, but was quickly denied. 'This is my life that's on the line, this is not fair,' the former movie producer said. 'I'm not getting a fair trial.' Although the sentencing hearing has not yet taken place, the conviction will be in addition to a 16-year sentence he is yet to serve in LA. Weinstein has been at the center of rape or sexual misconduct allegations from more than 100 people, with some claims dating back to the 1970s. He has been behind bars for the last few years, and filed a lawsuit against Rikers Island at the end of 2024, calling out the conditions and services at the prison facility after suffering a number of health problems. In documents obtained by Deadline, his legal team confirmed they were seeking 'no less than $5,000,000', and demanding 'monetary damages arising from negligence, carelessness, recklessness, gross negligence, medical malpractice, intentional and/or reckless and/or negligent deprivation of medical treatment, deprivation of civil and constitutional rights, and negligent and intentional torts' that he claimed have been 'committed by officers, agents, and employees of the New York City Department of Correction'. Michael O'Lone was stopped on the M74 near junction 10 at Lesmahagow, in Lanarkshire, in April 2024. The 34-year-old had previously been freed from a jail-term for growing cannabis when he was snared again. O'Lone has now been locked up once more after he pleaded guilty at the High Court in Glasgow to a charge of being concerned in the supply of cocaine. Prosecutor Eilidh Robertson told how O'Lone was the only person in the van when it was halted. She then explained: "The vehicle was searched. A total of 10 blocks of powder in bags were recovered from a compartment under the driver's seat which could be operated with hydraulics." A sensor button to open the hideaway was seized. O'Lone's DNA was also found in that area of the van. Police further discovered an iPhone - messages linked O'Lone to the drug trafficking including him discussing the collection of "paper" - slang for money - with an associate. There was also a photo of white powder being weighed on scales. Miss Roberston said the cocaine had a purity as high as 82% with a potential street value of £1,004,000. Thomas Ross KC, defending, stated O'Lone, of the city's Castlemilk, was released from his last sentence in July 2022. He had been jailed for 14 months for being involved in the production of cannabis. Mr Ross: "As far as this (latest) offence is concerned, there is very little to offer other than the value of the cocaine is high, but he would not have benefitted directly from the sale of drugs." O'Lone had got involved to help repay a debt owed by him. The KC stated he was a man "capable of very much better". Lord Cubie cut the jail-term from eight years due to the plea. The judge said O'Lone "knew fine well" what he was getting involved in, stating drugs "corrode, damage and destroy" lives. Referring to O'Lone previous prison stint, Lord Cube told him: "You had your second chance and chose to deal with it with this most serious offending."
