Kerala shipwreck: State govt looks for insurance compensation instead of immediate criminal case against shipping company
Though the sinking of the container ship MSC Elsa 3 off the Kerala coast sparked significant environmental concerns, including potential oil spills and the spread of hazardous chemicals, the Kerala government is of the view that there was no need to file an immediate criminal case against the shipping company in connection with the accident in the waters off Kochi.
Instead of pursuing a criminal case against the company, the State is looking for adequate insurance compensation through negotiation. A decision in this regard was taken during a meeting between Chief Minister Pinarayi Vijayan and the Director General of Shipping recently.
According to a note prepared by the Chief Secretary, accessed by The Hindu, ahead of the meeting between the Chief Minister and the Director General of Shipping soon after the accident, the general consensus in the State was that a criminal case need not be filed immediately and that the entire focus at this time should be on collecting evidence of damages so that evidence-based claims can be raised, the note said.
'The MSC is also a reputed company which patronises the Vizhinjam International Sea Port, and the company requires the goodwill of Kerala for their operations here. It is also in their interest to cooperate with Kerala and settle the claims through the insurance agency. Considering all these aspects, our claim should be raised based on strong evidence and without any compromise,' the note said.
The nearly three-decade-old ship carrying more than 640 containers sank off the coast of Kerala on May 25. As per the cargo manifest, the ship had 13 containers with hazardous goods, and twelve of them had calcium carbide, a reactive compound.

Exalogic case: CM Pinarayi Vijayan files affidavit in Kerala high court opposing CBI probe
Kochi: Chief minister Pinarayi Vijayan has filed a counter-affidavit before high court opposing the public interest litigation (PIL) seeking a CBI probe into the controversial Exalogic-CMRL transaction, terming it a 'politically instigated litigation'. In his affidavit, he denied all allegations, including the claim that Exalogic Solutions, a now-defunct company owned by his daughter T Veena, is his 'benami company,' and that he received illegal gratification from CMRL. The PIL filed by senior journalist M R Ajayan alleged that Exalogic received Rs 1.72 crore from Cochin Minerals and Rutile Ltd (CMRL) as illegal gratification. He also sought an investigation into the alleged political nexus involving the CM and the companies concerned. During the last hearing, the court had directed the respondents, including the CM, to file their counter-affidavits. The matter is posted for further consideration on June 17. In his 19-page affidavit, Vijayan submitted that the petitioner had failed to produce any material to substantiate the allegations, terming the PIL a "textbook case of a fishing expedition", an attempt to prompt a roving inquiry without foundational facts. He contended that the prayer for a CBI probe was devoid of genuine public interest and was instead driven by personal and political motives, targeting him and his daughter based on a single private commercial arrangement. Vijayan stated that, as per his understanding, Exalogic was engaged to provide software and marketing consultancy services to CMRL under a legitimate agreement, and that all transactions were duly accounted for through banking channels. He disclaimed any knowledge of or involvement in his daughter's business affairs, stating that she acted independently. He also denied the allegation that he was the 'kingpin' in the transfer of Kovalam Palace to a private businessman, asserting that he had exercised no undue influence in the matter. He pointed out that he assumed office well after the transfer took place. Further, he submitted that the petitioner had neither alleged any bias or collusion on the part of the vigilance and anti-corruption bureau (VACB) nor challenged the decision of the vigilance court, which declined to direct registration of an FIR in the case. Vijayan also contended that the petitioner had failed to implead the state govt as a respondent and that entertaining a petition in the absence of any evidence of bias or inaction would undermine the constitutional framework of federalism. Additionally, he submitted that an investigation by the Serious Fraud Investigation Office (SFIO) is already in progress, and therefore, parallel investigations by other agencies into the same allegation cannot be undertaken.

The meeting also noted that a damage liability desk has been set up at Kochi by the Protection and Indemnity (P&l) Insurance Agency. Deputy Nautical Advisor Captain Anish Joseph is the nodal officer who is in contact with this agency. It was also decided that the oil in the hull of the ship will be extracted by experts on July 3. Therefore, till the oil is extracted or the buoys are placed around the sunken ship, it is best not to permit fishing within 20 nautical miles of the ship. The removal of the shipwreck and containers near the ship can be undertaken only after the monsoon in Kerala. The government decision has invited sharp criticism from various corners, with a section alleging that the State and the Centre are deliberately dragging their feet in the case, as the opposite party was global shipping giant MSC (Mediterranean Shipping Company) and the port in question in the incident was Vizhinjam. According to maritime law expert V.J. Mathew, an FIR should have been registered in Kerala apart from arresting the owner or master of the ship. The damage to the marine ecosystem is beyond the scale and size of the initial analysis. The cost to retrieve the ship along with containers should be extracted from the shipping company. Moreover, the long-term impact of the incident on the marine ecosystem should be assessed scientifically, and the company should be held liable for fixing the damage by providing sufficient compensation, he said. The State government has not even formally released the cargo manifest of the ship, while the cargo manifest of another ship that caught fire off the coast of Kerala was in the public domain soon after the incident. Kerala shipwreck: Plastic pellets from sunken Liberian vessel found in Rameswaram coast
More than 20 bags containing plastic pellets and other unidentified materials were found in the 12-km stretch of coastal areas of Dhanushkodi, Arichalmunai and near Kothandaramaswamy temple in Rameswaram on Monday (June 9, 2025). They were similar to the nurdles which were found in the coastal areas of Kanniyakumari about a week ago, Police sources believe that the bags must have been washed ashore from the Liberian container ship MSC Elsa 3, that sank off the Kochi coast on May 25. Containers and cargo from the ship initially washed ashore along Kerala's coastline, but strong winds and ocean currents soon carried them to the waters of Kanniyakumari and other areas. Police said they found 23 such bags filled with plastic pellets in the coastal stretch, but they believe that many more could reach the shore in the coming days. As few of the bags were damaged, the plastic pellets got scattered around the area. The revenue administration has warned against handling the bags and pellets, cautioning fisherfolk and tourists due to uncertainty over the chemical properties of the materials.
