DeSantis wants Florida National Guard members to be immigration judges

Governor Ron DeSantis wants approval from the Department of Homeland Security to allow Florida National Guard members to serve as immigration judges. He's looking at pulling judge advocates from the Florida National Guard to help expedite deportation.
This all came up at a news conference in Miramar on Thursday, where officials discussed Operation Tidal Wave.
1,120 undocumented immigrants were arrested within 6 days. Many of them who did not have final deportation orders must appear before an immigration judge.
'If this is approved, we will go off to the races, and we will be able to do really from soup to nuts, from apprehension to detention,' DeSantis said.
This is as state officials call Florida ICE's blueprint for handling mass deportations across the country.
These judge advocates primarily practice in administrative or military law-- not immigration.
Immigration attorney Nayef Mubarak says he would be concerned if one of these appointed national guard members were to be a judge in front of ones of his clients.
'My concern here would be, as they're properly training to understand the law, immigration is one of the largest bodies of law. It's more than removal,' Mubarak said. 'It takes a lot to understand who qualifies for relief and who doesn't.'
There's also concern about whether the move would expedite cases too quickly.
Felipe Sousa-Lazaballet who was undocumented in the U.S. for 15 years says it would.
'It would essentially destroy due process. Our court system exists, so people have a day at court, so they can actually fight their case,' Sousa-Lazaballet said.
DeSantis says there's no issues with deputizing these Florida National Guard members.
'These are not Article III judges. They are executive branch employees, basically. We can absolutely deputize judge advocates from our National Guard units. To serve as immigration judges. We can do other to do that. So we'll help on that piece as well,' DeSantis said.
He had this to say when asked about due process.
'Now, we're in a situation where the federal government is doing, enforcing the law, and the courts are saying, well, no, you really can't do that. People need to have some O.J. Simpson-type trial before they can be deported. It's nuts. And it's a heads-they-win, tails-we-lose for the country, to where people come in unimpeded, and it's virtually impossible for them to go,' DeSantis said.
Now, this has yet to be approved by the Department of Homeland Security.
Immigration advocates and lawyers we spoke to say they believe this would be challenged in court.

On Wednesday, Tricia McLaughlin, the DHS assistant secretary for public affairs, decided to pick a fight with Kim Kardashian after the reality TV star simply exercised her freedom of speech. Amid the ongoing anti-deportation protests in Los Angeles that were sparked by a rash of terrifying U.S. Immigration and Customs Enforcement raids, Kardashian made it clear on her Instagram story Tuesday that her values align with the demonstrators. 'When we're told that ICE exists to keep our country safe and remove violent criminals — great,' Kardashian began her statement. 'When we witness innocent, hardworking people being ripped from their families in inhumane ways, we have to speak up. We have to do what's right.' She continued, 'Growing up in LA, I've seen how deeply immigrants are woven into the fabric of this city. They are our neighbors, friends, classmates, coworkers, and family.' 'No matter where you fall politically, it's clear that our communities thrive because of the contributions of immigrants,' she wrote. The beauty mogul concluded, 'We can't turn a blind eye when fear and injustice keep people from living their lives freely and safely. There HAS to be a BETTER way.' '.@KimKardashian, which one of these convicted child molesters, murderers, drug traffickers and rapists would you like to stay in the county? These are just a few of the convicted illegal criminals who have been picked up in the last 72 hours,' McLaughlin wrote on X, alongside images of a few men who have been detained by ICE in Los Angeles, per some very colorfully worded DHS press releases that include quotes from McLaughlin. Although McLaughlin didn't like Kardashian's statement, plenty of social media users did. In 2023, the president's eldest daughter, Ivanka Trump, was pictured at Kardashian's birthday party, upsetting many of Kardashian's fans. The American Horror Story alum also seemed celebratory on Trump's inauguration day in January, posting a caption-less photo of first lady Melania Trump's outfit to her Instagram story that same day. Judge rules Mahmoud Khalil can't be detained over claims he's compromising foreign policy

A district judge ruled Wednesday that Mahmoud Khalil, a green card holder and former Columbia pro-Palestinian activist, can no longer be detained by the federal government over claims he is compromising foreign policy. District Judge Michael Farbiarz ruled for Khalil to be released by Friday morning, unless the federal government wins an appeal or provides another justification for detaining Khalil besides Secretary of State Marco Rubio's determination he is a threat to the country's foreign policy. Federal officials have also claimed they can deport Khalil because he inaccurately completed his green card application, and the judge acknowledged that may mean Khalil can remain in custody. 'To be sure, it might be argued that the Petitioner would be detained anyway. After all, as noted above, the Department of Homeland Security is seeking to remove the Petitioner based not only on the Secretary of State's determination — but also on a second basis, the Petitioner's alleged failure to accurately complete his lawful-permanent-resident application,' the judge wrote. The Hill has reached out to the Department of Homeland Security for comment. Khalil was the first arrest in the Trump administration's crackdown on foreign students where Rubio argued numerous pro-Palestinian activists on campus were threats to the country's foreign policy. Khalil has been in Immigration and Customs Enforcement (ICE) detention for four months, missing the birth of his first child. Other college pro-Palestinian activists have recently been released as their immigration proceedings play out in the court system under similar allegations, but Khalil's case has been more complicated as the determination over which jurisdiction should preside over the proceedings took months to determine. The preliminary injunction the judge gave to release Khalil and block his deportation would be a big win for activists, but the matter will not be finalized until Friday morning at 9:30 a.m. eastern time. The federal judge presiding over Mahmoud Khalil's case ruled that the Trump administration, for now, cannot deport or detain the Columbia University activist based on a determination by U.S. Secretary of State Marco Rubio. The judge's order will not take effect until Friday, allowing the government time to appeal. Rubio has cited an obscure provision of the Immigration and Nationality Act of 1952 to justify Khalil's removal from the U.S., saying that he poses a national security risk. Rubio had argued that the provision allows the secretary of state to "personally determine" whether Khalil should remain in the country. Khalil was a Columbia University student who played an active role in protests over the war in Gaza on the Manhattan campus last year. He was arrested by federal agents in March and has been held since, as he and his lawyers have challenged efforts to deport him. U.S. District Judge Michael Farbiarz's Wednesday order bars the government from detaining Khalil based on Rubio's determination. It also bars the government from trying to remove him from the United States based on Rubio's determination. Khalil was a Columbia University student who played an active role in protests on the Manhattan campus over the war in Gaza. A spokesperson for the Department of Homeland Security has alleged that Khalil has acted to "glorify and support terrorists." Khalil last week called the claims "grotesque and false."
