Car sharing platform Zoomcar has reported a data breach that compromised the personal information of approximately 8.4 million users. It informed the US Securities and Exchange Commission (SEC) about the June 9 beach on June 13. Zoomcar operates primarily in India, but it is incorporated in the US and listed on the US stock exchange, Nasdaq, after its merger with US-based Innovative International Acquisition Corporation (IOAC). This makes Zoomcar subject to US securities laws and disclosure obligations under the SEC. Initial findings suggest that the breach involved names, phone numbers, email addresses, car registration numbers, and residential addresses. Zoomcar said there is no evidence of any compromise of financial information, plaintext passwords, or other highly sensitive data. In its filing, Zoomcar said it became aware of the breach after employees received messages from a threat actor claiming to have gained unauthorised access to company data. The company activated its incident response plan and launched an internal investigation. 'In response to the incident, the Company has taken immediate actions to contain the threat and enhance its security posture. These measures include implementing additional safeguards across the cloud and internal network, increasing system monitoring, and reviewing access controls,' said the company in the filing. Zoomcar publishes its SEC filings on its investor relations website, but this disclosure was not available there at the time of reporting. Instead, the filing was on the SEC's website. A press release from the company is expected later in the day. According to a 2020 Inc42 report, a security researcher found a database of 9.1 million Zoomcar users sold on the dark web for as little as $1, while the full set was priced at $300. The hacker claimed to have breached the company in 2018. The data included names, emails, phone numbers, IP addresses, and encrypted passwords. In a shareholder document ahead of its planned merger with IOAC in 2023, Zoomcar cautioned investors about potential risks related to its business. Under the section titled 'Risks Related to Zoomcar's Business,' the company acknowledged past cybersecurity issues. 'From time to time, and most recently in 2018, we have experienced security incidents or attempted attacks, and in some instances, individuals have had their personal information compromised. We conduct investigations when we become aware of such incidents and/or attempted attacks (although our investigations may not be able to determine the method of attack) and may notify affected persons, as necessary,' said the document, a copy of which HT has seen.

Defence stocks rallied up to 3% on Tuesday, in intraday trade amid rising geopolitical tensions between Iran and Israel, coupled with the hopes of an increased defence budget by the government. The heightened global uncertainty appears to have renewed investor interest in India's defence and aerospace segment, with several key stocks touching fresh day highs. Among the gainers, Data Patterns (India) shares surged the most, rising 3% to hit a high of Rs 3,049.50. It was followed by Bharat Dynamics Ltd (BDL) shares, which climbed 2.8% to touch Rs 1,940.70. BEML shares also witnessed strong momentum, gaining 2.2% to reach Rs 4,473.00. Meanwhile, Hindustan Aeronautics Ltd (HAL) shares rose 1.6% intraday, hitting Rs 5,130.50. The rise in these stocks may be attributed to the war tensions in the Middle East between Iran and Israel, as investors see potential in the sector along with an expectation of enhanced defence spending by the Indian government. Commenting on the recent spike in defence counters, Sankhanath Bandyopadhyay, Economist at Infomerics Valuation and Ratings, also said, 'Defence stocks look promising due to the ongoing geopolitical tussle between Iran and Israel. Moreover, the Indian government is likely to enhance defence spending from the current 2% of GDP to 3–4% over the next decade.' He added that with the government targeting Rs 25,000 crore in defence exports by 2025–26, the outlook for export-driven defence stocks remains strong. 'In the current scenario, geopolitical tensions will likely be lingering between different countries, especially as being reflected in rising tensions in the Middle East. What are the Indian tax rules for NRIs selling bonds?

I have been a non-resident Indian (NRI) residing in Australia since 2010. In February 2013, I invested in a listed HUDCO bond with a tenure of 15 years. I am now considering selling this bond before its maturity. What would be the tax implications in India arising from the early sale of this bond? If you sell your HUDCO bond before its maturity, the profit will attract capital gains tax in India. Under Indian tax law, the holding period determines the nature of capital gains. For listed bonds, a holding period of more than 12 months qualifies the profit as long-term capital gains (LTCG). Since you've held the HUDCO bond for over 12 years, your gains will be treated as LTCG and taxed at 12.5% plus applicable surcharge and cess. Note that indexation benefit is not available. The India-Australia Double Taxation Avoidance Agreement (DTAA) provides clarity. Article 13(6) of the DTAA, which acts as a residuary clause, applies in your case since gains from bond sales aren't covered under specific clauses. This residuary clause states that in cases not specifically addressed in clauses 1 to 5 of Article 13, the domestic law of each contracting state shall apply. This means that both countries—India and Australia—can tax the capital gains, based on their domestic laws. So while you will be taxed in India, you may also have to report the income in Australia. However, Australia allows you to claim a foreign tax credit for the taxes paid in India. This ensures you're not taxed twice on the same income. You must file an income tax return in India declaring the capital gains and pay any tax balance after TDS (if applicable). You can then use the Indian tax paid as a credit when filing your Australian tax return.
