
Lawyers unveil shocking new theory about Florida honor roll student, 13, 'who murdered mom as she slept'
Attorneys for an honor roll student who allegedly admitted to murdering his mom when he was 13 have said he may not be the killer.
Derek Rosa, 14, has pleaded not guilty to first-degree murder after his mother Irina García was stabbed to death with a kitchen knife in their Florida home in 2023.
But his attorneys have now said they're exploring 'evidence of an alternative suspect', according to court records seen by NBC South Florida.
Lawyers for the teenager have said they would like to investigate Frank Ramos, who is Rosa's stepfather and García's husband.
According to records, Ramos provided detailed descriptions about the killing in his Facebook messages, including how the victim screamed for help and fought back.
'The messages are exculpatory because they raise the possibility of an alternate theory, that of course includes the culprit not being Derek Rosa,' attorneys wrote in a motion.
'The stepfather having such specific details of the incident while at the same time claiming that he did not witness the incident, raises the possibility that he was in fact present during the incident, at the very least watched it.'
Ramos is currently set to appear in Rosa's trial as a witness in June 2025.
Bodycam footage showed the moment police stormed García's Hialeah home and arrested the honor roll student.
'Hands up! Hands up, come here, get on the ground!' One cop yells as Rosa emerges in pajamas.
He is forced to the ground and placed in handcuffs while officers rush into the apartment.
'There's a knife in my room,' Rosa tells the cop, who then shouts the information to his colleagues. 'There's a baby,' the teen adds.
'How's the baby? Did you do anything to the f***ing baby?' the cop demands, but Rosa says he left the infant unharmed.
Police said once they entered García's room they found the 39-year-old mom dead in her bed next to the crib containing her 14 day old baby.
So far there has been no indication of a motive. Rosa's lawyers has recently indicated that they may seek an insanity defense.
In other bodycam footage, Rosa's devastated grandmother can be heard explaining in Spanish to a cop of her grandson never appeared to have any issues.
'I've never seen him with any mental problems or anything like that, he's a normal kid, intelligent,' she said in Spanish. 'I don't know what happened…all I know is I don't have a daughter anymore.'
The teen entered a not guilty plea in December 2023 after his arrest in October.
However, interrogation footage showed the teen describing the size and color of the knife he allegedly used to commit the crime.
He was further questioned by detectives who asked: 'Your mom was sleeping?'
Rosa went on to confirm: 'Yeah, she was sleeping.'
The video showed the teenager showing detectives his bloody hands and pointing to his neck when asked where he stabbed his mother.
He also told the detective that his mother screamed when he attacked her, before he then asked for an attorney.
On December 15, 2023, a pre-trial hearing saw prosecutors playing a recording of Rosa allegedly speaking to a detective directly after the stabbing, where he said: 'I woke up, I grabbed one of the kitchen knives and I went to her room... I killed her.'
After hearing the disturbing tape, Miami Dade Circuit Judge Richard Hersch ordered the teen to be held in an adult jail until his trial commences.
At a separate hearing, baby-cam footage showed Rosa standing over his sleeping mother in her bed, moments before he allegedly stabbed her 46 times.
The 13-year-old was seen in eerie black-and-white images looming over his mom with a time stamp at 11 pm. Rosa called 911 to report the murder around 11:30 pm.
Rosa is also accused of taking a smiling selfie to a friend directly after the killing, where he was sticking his tongue out with what appears to be blood smeared on his hands.
Police said after taking the pictures, Rosa asked a dispatcher if the move was 'bad'.
He also allegedly claimed that he found two guns owned by his stepfather after the stabbing and planned to commit suicide but didn't go through with the plan.
Rosa's family expressed shock over the charges and said he was a 'good kid' and that 'no one could imagine this would ever happen'.
The detective who interviewed Rosa after he allegedly carried out the murder, Hialeah Police officer Joseph Elosegui, said that investigators found additional evidence after looking through Rosa's internet activity.
He claimed the 13-year-old researched the best way to kill someone and whether a small knife would be able to cut through bone.
Rosa will stand trial as an adult and has had multiple requests for transfers to a juvenile prison denied.

Today in the last of our four part series on the feuding Lyons and Daniel crime clans the Daily Record looks at the tangled web of allies and enemies of murdered gangland king pins Eddie Lyons jnr and Ross Monaghan. Both men were shot dead by a mystery gunman on May 31 at Monaghans Bar, owned by Monaghan, in the Spanish holiday resort of Fuengirola prompting fears of further violence and retribution back home in Scotland.. At the time Lyons jnr was on a golfing holiday with friends from Dullatur Golf Club in Cumbernauld, Lanarkshire, and Lyons gang member Monaghan is believed to have been the main target of the Costa Del Sol killer. A major investigation has also been launched by Spanish Police but today the person responsible for the two deaths remains at large. Who killed Lyons and Monaghan remains a mystery but their list of enemies - and friends - will be a key part of the police investigation. Eddie Lyons jnr Eddie jnr is the son of Eddie Lyons snr who formerly ran the controversial Chirnsyde Community Initiative in Milton, Glasgow. The centre was closed in 2006 following the murder of Eddie jnr's cousin Michael Lyons at an MOT station in nearby Lambhill run by their uncle David Lyons. Eddie jnr and younger brother Steven Lyons - alongwith Ross Monaghan - were both members of the infamous Club Boys group based at the centre. Eddie Lyons Jnr had been targeted twice by the Daniel family prior to his murder on May 31. In April 2006 the crime figure survived a shooting attempt outside his home in Cumbernauld in Lanarkshire and again in November that year in Bellshill, Lanarkshire. Both he and Ross Monaghan were cleared in 2017 at Glasgow Sheriff Court of assaulting a man outside a pub in Bishopbriggs. In the double assassination last month at Monaghans Bar in Fuengirola, Spain, Eddie jnr was shot first before the gunman turned his weapon on Ross Monaghan. The 46 year old Lyons family member had been on a golfing holiday with friends from Dullatur Golf Club in Cumbernauld, Lanarkshire, when the fatal Saturday night shooting took place. Ross Monaghan Monaghan, 43, first came to the attention of the police more than 20 years ago. At the time he was one of the notorious Club Boys - a group of young criminals working for the Lyons family - who based themselves at the Chirnsyde Community Initiative in Milton, Glasgow, run by Eddie Lyons snr. The centre which received more than £1.4 million of public money was alleged at that time to be a front for organised crime. Monaghan first came to public attention when he stood trial at the High Court in Glasgow in 2012 for the murder of Daniel enforcer and family member Kevin 'Gerbil' Carroll. However Monaghan walked free after a judge ruled there was no case to answer. Carroll had been shot dead at point blank range while sitting in his Audi car outside an Asda supermarket in Robroyston, Glasgow in January 2010. Seven years later Monaghan was shot and injured while dropping his daughter outside St George's Primary school in Penilee, Glasgow. After the shooting he moved to Fuengirola in Spain and opened his own bar Monaghans where he was murdered at the end of last month. It is believed that he, not Eddie Lyons jnr, was the main target of the gunman. Enemies of Eddie Lyons jnr and Ross Monaghan Steven 'Bonzo' Daniel: The 45 year old has been the target of several attacks in the past eight years as part of the long running feud with the Lyons. The most recent was in April at his luxury home in Bishopbriggs, near Glasgow, when the front door was set on fire. He was also left with horrific facial injuries after being attacked with knives and machetes by Lyons gang members in Glasgow in 2017. Properties of his mum Annette, uncle Norman Daniel and cousin Kelly 'Bo' Green have also been targeted in the past three months. Francis 'Fraggle' Green: Green is the son of feared crime boss Jamie Daniel who died from cancer in 2016. In 2010 the 42 year old was one of the first on the scene following the murder of his brother-in-law Kevin 'Gerbil' Carroll outside an Asda supermarket in Robroyston, Glasgow. Green later admitted in court eating the sim card from two phones he was carrying at the time. In 2017 a gunman opened fire on his home in Milton of Campsie, near Glasgow. A motor company in Kirkintilloch, East Dunbartonshire, previously connected to Green, was set on fire in April. Mark Richardson: A key associate of the Daniel family. The 38 year was jailed for eight years and nine months in 2018 for possession of a Glock handgun. He was said at the time to be part of the most sophisticated organised crime operation 'encountered' by Police Scotland that saw nine men jailed for a total of 87 years. The Edinburgh gangster was previously sentenced to ten years in 2010 following a £2million cocaine and heroin seizure by police. Robert Daniel. Cousin of Steven Daniel: Two workers were attacked with a machete and seriously injured at a garage owned by Daniel in East Kilbride last month. However Daniel was believed to be the intended target. The 50 year old was shot and seriously injured in 2017 outside his home in Stepps, Glasgow as he reversed his car. Zander Sutherland: The 36 year old is the son of late crime boss Jamie Daniel and younger brother of Fraggle. Zander was sentenced to 13 and half years in prison in 2016 for heroin dealing. Last year he fled to Norway while on leave from Caste Huntly open prison, near Dundee, after death threats. He was then extradited back to Scotland in December. Sutherland got an extra 10 months added to his sentence in April at Perth Sheriff Court. Craig Gallagher. The 45 year old's carpet factory business in Bishopbriggs, near Glasgow, was set on fire in early April and video footage posted online featuring the song Firestarter by Prodigy. Gallagher, a long time Daniel associate, was jailed for 32 months in March after admitting an assault on Lyons gang members in Glasgow and being in possession of an offensive weapon. Allies of Eddie Lyons jnr and Ross Monaghan Daniel Kinahan: The 47 year old is head of the Irish Kinahan organised crime group now based in Dubai and one of the world's most wanted men. A bounty of $5 million has been put on his and other family members heads head by US Treasury officials for alleged drug trafficking. Has built up a close relationship with the Lyons family in recent years. Ross McGill: The 31 year old former Rangers ultra and Union Bears leader is alleged to have orchestrated a recent series of fire bombings and other attacks on Daniel family members and associates from his base Dubai since March with information supplied to him by Lyons family members. Eddie Lyons snr: The 67 year old father of Eddie Lyons jnr is the most senior member of the Lyons crime clan. In 2012 he was was ordered to hand over £75,000 of his assets after admitting a £259,000 mortgage fraud and having £150,000 of illicit earnings. Lyons snr first came to public attention in 2003 over his running of a community centre in Milton, Glasgow, alleged to have links to organised crime. Steven Lyons: Younger brother of Eddie jnr. The 44 year old spends time between Spain and Dubai. He is said to have forged the current relationship with the Kinahan crime clan. Now seen as head of the Lyons family. Robert Pickett: The long time Lyons associate was among six men jailed in 2019 for a total of 104 years for the attempted murders of five men from the Daniel crime clan including Steven 'Bonzo' Daniel. Pickett was also shot and seriously injured when two men murdered Lyons family member Michael Lyons at an MOT garage in Lambhill, Glasgow in 2006. Robert Kelbie: The 41 year old convicted fraudster has survived three attempts on his life including two outside his home in Edinburgh and one outside a health club in the city. Kelbie has a long running feud with cocaine baron and Daniel ally Mark Richardson. They once fought in front of mourners after a funeral in the capital in 2016. In 2021 Kelbie helped to set up a gym on the Spanish island of Fuerteventura for MTK Global, a now defunct boxing promotion firm linked at the time to the Kinahan crime clan.

The Department of Homeland Security has revealed that Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP) personnel will provide security at the game. On its Facebook account, CBP posted last week: 'Let the games begin. "The first #FIFAClubWorldCup games start on June 14th in Miami, FL at the Hard Rock Stadium. "CBP will be suited and booted and ready to provide security for the first round of games. #CBPxFIFA #FootballUnitesTheWorld.' The post has since been deleted. However, NBC said the post had prompted questions about whether the presence of federal agents was "just part of the overall security team, which is normal for a big event?" This follows demonstrations nationwide, including Dallas and Austin in Texas, and Chicago and New York, after federal immigration raids arrested dozens of workers in Los Angeles. It also comes as Donald Trump continues his huge immigration crackdown and travel ban. And Vice President JD Vance last month warned World Cup travellers not to overstay their welcome. He told fans, 'Be part of history, football is such an important sport all over the world. we'll have billions of people watching this from home who would love to come and attend.' He replied, 'No I don't have any concerns on anything in the sense that we are very attentive on any security questions. More on the Club World Cup 2025 The Club World Cup 2025 will begin on Sunday, June 15, in the UK and Saturday, June 14, in the US. The tournament will run until Sunday, July 13. It is being held across 12 different cities and stadiums in the United States. The whole tournament will be broadcast by DAZN in the UK and US. But, Thomas Kennedy of the Florida Immigrant Coalition said the federal agents' now-deleted social media warning had caused confusion. He said, 'The messaging that CBP is using is a bit cryptic. "It's sort of alluding that people should have their paperwork in order to attend the games. 'It creates an environment where people are less likely to come watch the games because of just sheer intimidation.' Woman flashes obscene gesture as mob forces accused baby killer out of her home
Nicole Blain is set to appear in court next year after she was alleged to have killed her baby daughter by shaking just three weeks after she was born at a flat in Greenock, Inverclyde A woman was seen making an obscene gesture towards a baying mob as an accused baby killer was forced to leave her home. Police have charged Nicole Blain, 29, over the death of three-week-old Thea June Wilson at a property in Greenock, in Inverclyde Scotland, on July 14 2023. Prosecutors have alleged she shook the child and inflicted blunt force trauma by unknown means before her death. She denies the charges, and is set to appear before the court in a trial scheduled for April 2026, but the case has already caught significant local attention, with police called to her home after a baying mob materialised outside her flat. Footage obtained by the Daily Record outside of the flat in Johnstone, Renfrewshire, shows officers guarding the property as people gather outside, with shouts of "get her out" as the crowd grew. Other chants of "get her into the back of the van" and "you are lucky that the cops are here" could be heard as two women emerged from the home. In response, one of the pair could be seen flipping up their middle finger at the crowd as the they were bundled into the back of a police van. The curbside protest followed a local social media campaign in which residents of Johnstone have called for "support" to remove her from the area. Videos showing her being moved from the home have been hailed by supporters of the fervent campaign, which has built up across multiple social media accounts, mainly on Facebook. A spokesperson for Police Scotland said however that the crowd dispersed a short time after officers arrived to collect Blain. A spokesperson for the service said: "Around 7.25pm on Monday, 9 June, 2025, we received a report of a crowd gathered outside a property in Floorsburn Crescent, Johnstone. "Officers attended and the crowd dispersed a short time later." Blain's legal team has pleaded not guilty on her behalf following an initial hearing at Glasgow High Court on May 8, with a special defence of incrimination lodged as the defence and prosecution agreed to said they were prepared for a trial. The case, when it comes before the court next year, is expected to last around six days, and several "professional witnesses" are set to be allowed to provide evidence remotely. A fundraiser was launched in the wake of baby Thea's death in a bid to raise roughly £1,200 for the three-week-old's funeral costs. But the page has since been suspended, with donations no longer allowed.
