Nagpur: Chief Justice of India Bhushan Gavai on Saturday said one of the most defining moments of his judicial career was Supreme Court's recognition of the need to apply the "creamy layer" principle within Scheduled Castes (SC) and Scheduled Tribes (ST), describing it essential to refine the concept of social justice.

In an exclusive interaction with The Times of India at Raj Bhavan during his Nagpur visit, the CJI said, "Treating children of high-ranking SC/ST officers at par with those from truly disadvantaged families dilutes the purpose of affirmative action. Identifying the creamy layer ensures that benefits reach the most deserving." The observation was part of a PIL-based ruling in which the apex court allowed sub-categorisation within SC/ST groups to ensure equitable distribution of reservation benefits.
Justice Gavai, the second Dalit and first Buddhist to serve as CJI, also cautioned against judicial overreach, emphasising that all institutions must function within constitutional boundaries. "Judicial activism will stay, but it should not turn into judicial adventurism or judicial terrorism. Parliament enacts laws, the executive implements them, and the judiciary ensures compliance with the Constitution.
Overstepping by any branch disturbs this balance," he said. "The Constitution is not just a legal document, it is a tool for social transformation. It has withstood global and domestic upheavals due to its strong foundation," he said.
Appointed as the 52nd Chief Justice on May 14 for a six-month term, Gavai made it clear he will not accept any post-retirement assignments. "It's a matter of personal principle," he said, adding his focus remains on reducing case pendency — over 81,000 in the Supreme Court alone — and improving infrastructure in rural courts to enhance access to justice.

Justice Gavai authored nearly 300 judgments, including landmark rulings on Article 370, electoral bonds, demonetisation, and freedom of speech. He was also part of the five-judge bench that upheld the abrogation of Article 370, which he called consistent with Dr B R Ambedkar's vision of "one nation, one Constitution."
He underscored the gravity of another path-breaking ruling in which the court ruled that an arbitration clause in an unstamped or insufficiently stamped contract remains valid — a significant decision for commercial law.
Similarly, he was part of the bench that unanimously annulled electoral bonds scheme, calling it inconsistent with transparency in political funding.
Justice Gavai also recalled how the apex court under his watch stayed the Allahabad High Court's insensitive remarks in a sexual assault case, calling it "inhuman" and reflective of judicial insensitivity. In another crucial decision, Supreme Court declared the arrest of NewsClick founder Prabir Purkayastha illegal due to procedural lapses by Delhi Police.
In his role as judge, Gavai often criticised the controversial practice of "bulldozer justice," where properties of accused individuals are demolished before a conviction. "Such actions go against constitutional protections. Punishment without trial violates every tenet of justice," he said. His views helped guide the Nagpur bench of Bombay High Court to stay demolition of properties during the Nagpur riots probe.
Gavai also granted bail to former Delhi Deputy CM Manish Sisodia in the liquor policy case and was part of several benches that strengthened environmental law, wildlife conservation, and tree protection. Among the pending matters before the Court under his leadership is the challenge to the Waqf (Amendment) Act, 2025 — a politically sensitive issue with implications for property rights and minority law.

After holding scores of protest meetings against the amended Waqf law across Bihar, Jharkhand, Odisha and West Bengal, Imarat-e-Shariah, one of the country's leading Muslim organisations, is set to hold a mega rally in Patna's Gandhi Maidan on Sunday to keep the heat on the BJP-led Centre over the row. Imarat-e-Sharia, headquartered in Patna, has rejected the Waqf amendment legislation, calling for its withdrawal. The legislation was passed by Parliament in April. In May, after hearing multiple petitions challenging the constitutional validity of the Waqf Amendment Act, 2025, the Supreme Court reserved its decision on the prayer for interim directions. Speaking to The Indian Express, Imarat-e-Shariah head Faisal Rahmani said: 'Though we have been protesting against the draconian Waqf Amendment Bill right from the start, we want to keep the pressure on the Centre. We have been creating awareness among public about how the Centre's Waqf amendments are against several provisions of the Constitution and Supreme Court rulings. It is nothing but a bid to take away our places of worship and heritage buildings. This law undermines the spirit of brotherhood in the country.' Rahmani said: 'We accept the 1995 Waqf law. Going by the amendments to it, how can one disallow Hindus to donate their land for a good cause? Our records show that there are thousands of educational, medical and social organisations and institutions being run on Waqf land, some of which even have more Hindu beneficiaries in comparison to Muslims. Take for example Maulana Mazharul Haque University in Patna, which has 88% Hindu students in its courses.' He said, 'The Centre summarily rejected our more than 300 representations against the Waqf Bill – we are also rejecting their amended Waqf law.' Calling the Waqf law 'irrational', the Imarat-e-Shariah chief also said: 'What will happen when someone asks for proof of Ashokan pillars or a whole lot of our historical monuments cutting across religions? This law aims at creating enmity among citizens… Public is a great force. It had made the NDA-led central government withdraw three farm laws. Patna rally is just the beginning, we will keep the pressure on the Centre.' Asked about timing of the Imarat-e-Shariah's protests ahead of the upcoming Bihar Assembly polls, Rahmani said they have been seeking support from all parties. 'We are getting calls of solidarity from various political parties. In fact, some BJP MPs have also been supporting our Waqf stand,' he claimed. In March, during Ramzan, Imarat-e-Shariah had given a call to boycott the 'sarkari' Iftar hosted by Chief Minister and JD(U) president Nitish Kumar in Patna. The JD(U) had termed the Imarat-e-Shariah's boycott announcement 'uncalled for'. This was perhaps the first time that a leading Muslim body had made such a move. The Muslim community accounts for over 17% of Bihar's population and is concentrated in Kishanganj, Araria, Purnia, Katihar and Purnia. Several other districts in the state, including Darbhanga, Madhubani, Patna and Nalanda, also have sizeable Muslim population.

Lashing out at the state government over Majithia's arrest, the SAD chief said the case was registered only because Majithia had been 'exposing' the dispensation over various issues. Sukhbir also challenged the CM to prove the disproportionate assets case, asserting that the entire case was based on a bundle of lies. (HT Photo) The Punjab Vigilance Bureau arrested Majithia on June 25 in a disproportionate assets case allegedly involving laundering of ₹ 540 crore 'drug money'. It was Sukhbir's maiden press conference after the arrest of Majithia. Regarding Saraya Industries Limited, he said, 'The only foreign funding received by Saraya Industries was in March,2006 when it received ₹ 35 crore from United States-based Clearwater Corporation in exchange for 25% shares in the company. Majithia entered politics in 2007.' He also made it clear that all transactions of Saraya Industries were scrutinised and accepted by the Income Tax department. Sukhbir also challenged the CM to prove the disproportionate assets case, asserting that the entire case was based on a bundle of lies. Sukhbir asserted that Mann had pressurised the state DGP to register the case because 'Majithia had been constantly exposing him and his corrupt and immoral cabinet colleagues'. He termed the government action 'vendetta politics'. 'An affidavit which the government had submitted to the Supreme Court in 2023 while appealing for cancellation of Majithia's regular bail and seeking his custodial interrogation in an NDPS Act was used verbatim to register this new case against him. This was done despite the fact that the Supreme Court rejected the affidavit in April this year and refused to overturn the regular bail given to Majithia by the high court or grant the request for custodial interrogation,' Sukhbir said. The SAD chief further said that the apex court even asked the AAP government to complete the probe in two days 'following which it has now taken this new route to engage in political vendetta'. He also condemned the manner in which former DGP Siddharth Chattopadhyaya and ex-deputy director of Enforcement Directorate Niranjan Singh were called by the Vigilance Bureau to share information regarding the drug case. He claimed that his party had conclusive proof of the corrupt activities of the CM and his wife.
