Commerce man sentenced in death of 10-week old baby

TULSA, Okla. — A Commerce man was sentenced to 20 years in a federal prison for the beating death of a 10-week-old girl.
Michael David Gregory, 30, pleaded guilty in March to reduced charges of voluntary manslaughter and assault resulting in serious bodily injury, in the death of 10-week-old Amaya Mae Robison and the assault of her twin sister, both in Indian Country.
Robison, of Vinita, died Dec. 3, 2022, from blunt force trauma to her head, according to her autopsy. The other twin sister also had a small brain bleed; however, she has made a full recovery, court documents show.
U.S. District Judge Sara E. Hill sentenced Gregory to three years of supervised probation following his release.
The girls were two of four children whose mother had abandoned them. Child Protective Services took one daughter, according to court records, the other girls were left with a neighbor and Gregory's girlfriend at the time, Shanna Kimbro. The twins were just 10 days old when the mother left them with Gregory and Kimbro, court records show.
Court records show Gregory 'had no idea how to care for a baby, much less two of them.' In his plea agreement, Gregory said he was responsible for the twin infants while his girlfriend went to work. Gregory confessed, 'I was often forceful when I picked up or laid down' the twin girls, 'which is not proper care for newborn infants.'
On Dec. 1, 2022, he called his girlfriend, saying one of the infants had stopped breathing.
Gregory is not a member of a federally recognized tribe. However, the apartment in which Gregory cared for the twins is located on the Quapaw Nation reservation, and both infants are considered 'Indian persons' because they are eligible for membership in the Choctaw Nation.
Gregory will report to the United States Bureau of Prisons facility on July 22, court records show.
Online court records show the biological mother has not been charged.

According to BBC, the survivor is a British national whose full name is sometimes spelled as Vishwash Kumar Ramesh. Indian media outlets quoted the miracle passenger as telling reporters, according to BBC: "Thirty seconds after take-off, there was a loud noise and then the plane crashed. It all happened so quickly." 'Cannot say anything about the number of deaths yet. The death toll may increase as the flight crashed in a residential area," the police official said, according to India TV News. Photos of the man with injuries to his face circulated on social media. Malik told reporters that the miracle passenger's "seat number was 11 A in the flight," according to India TV News, which shared a photo of Ramesh's plane ticket. That site reported that Ramesh was "returning to London after Gujarat visit" and told News 18, "There were bodies all around me, there were pieces of the plane all around me. Someone took hold of me and put me in an ambulance." The lone survivor suffered 'impact injuries' on his chest, eyes and feet, the site reported, adding that he was traveling with his brother Ajay Kumar Ramesh, 45. Within 30 seconds after takeoff, the issues started, he told Indian media, according to India TV News. Video emerged of Ramesh walking around. Reuters is also reporting that one man survived. Authorities believe there might be survivors of the crash, which killed at least 200 people, including five students eating lunch at a medical college cafeteria on the ground, according to The New York Times. A senior Indian police official told the country's national news agency ANI on Thursday that one person — a man who was in seat 11A on the doomed Air India flight to London that crashed soon after takeoff in the city of Ahmedabad — survived the catastrophe. Indian media outlets spoke with a man in a local hospital who said he was U.K. citizen Vishwash Kumar Ramesh, the person who had been listed in that seat on flight AI171, according to the flight manifest shared by Indian authorities. Ahmedabad Police Commissioner GS Malik, who initially told ANI there were no known survivors from the Boeing 787-8 Dreamliner that crashed into the city, was later quoted by the same news agency as saying "the police found one survivor in seat 11A." He said the person was "in the hospital and is under treatment." A dinner date at a Coweta restaurant led to the arrest of a couple. When the deputy arrived, he met with a manager who pointed out a man in the parking lot, saying he was giving the baby in the back seat beer at the bar. The manager informed the deputy he had video of the incident. The deputy made contact with the man, later identified as 34-year-old Craig Banks. According to the report, Banks had a strong odor of alcohol coming from him. Banks told the deputy that he had been at the restaurant for about an hour. According to the report, while speaking with Banks, he asked why the deputy was talking to him and when the deputy responded, Banks said, 'My baby is one, why the [expletive] would I do that?' Banks told the deputy he and his wife, identified as Paetyn Gregory, 30, went to the restaurant to have one drink. The bartender said Banks ordered a 23-ounce Yuengling Beer. While holding the child, Gregory explained to the deputy, they hadn't been drinking, and she gave the child a sip of her tea, and she knew nothing about the child drinking beer. Gregory gave the baby to the father to get a high chair and continued to give the child beer, authorities said. Once Gregory came back with the chair, Banks put the child in the chair, looked over to see if anyone was looking, and continued to give the child beer out of his glass as the child's mother was still watching and laughing, according to the report. Deputies said Gregory was seen on video laughing the whole time Banks was giving the kid the beer, after telling officers she didn't think about it. She told deputies the child turned one last month. She was then arrested. Both parents were charged with contributing to the delinquency of a minor. They were booked into the Coweta County Jail. The child was picked turned over into the care of a grandparent.
