HMP Berwyn attempted drug smugglers dealt with in court

Karen Harrison, of Kirkby Park in Kirkby, and Perry Ellison, of Kelso Road in Fairfield, Liverpool, appeared before Mold Crown Court for sentencing on Tuesday, April 29.
Harrison, 63, and Ellison, 37, both previously pleaded guilty to one count each of bringing/conveying a prohibited article into prison.
Simon Mintz, prosecuting, told the court that the offence dates back to July 2023, when both defendants attended HMP Berwyn in Wrexham to visit a prisoner there.
The pair had become 'separated' during the admission process and Harrison was searched first.
She was found to have a packaged hidden beneath her waistband which she claimed was 'tobacco' which the inmate she intended to visit 'needed to smoke after and operation'.
Officers then traced Ellison to the visiting room, where he was removed and searched.
When a package was removed from his groin area, he told them 'it's only weed'.
The searches revealed that Harrison had attempted to bring in 42g of cannabis resin into the prison. This would have been worth between £840 and £2,100 inside jail, the court head.
Ellison had attempted to smuggle in 14.1g of cocaine, said to be worth between £2,800 and £5,600 within the prison walls.

Both defendants gave no comment interviews, the prosecution said.
Ellison had 40 previous convictions for 66 offences, including assault and burglary, while Harrison had no previous convictions.
Owen Carville, defending Ellison, said that he was someone who suffers from Schizophrenia.
He argued that, although he has a 'long list of offences', none of those have included the offence of conveying drugs into prison.
Jeremy Rawson, defending Harrison, said that she was a woman with no previous convictions and therefore had a 'reasonable prospect of rehabilitation'.
He added she concedes that she 'made a stupid decision'.
Sentencing the pair, Judge Timothy Petts said: "Bringing drugs into prison is strictly prohibited, it undermines discipline in the prison as it leads to debt and extortion."
Harrison was sentenced to a six-month term, suspended for 12 months. She will need to complete 10 Rehabilitation Activity Requirement days and will be subject to a three month curfew (between the hours of 8pm and 6am).
Meanwhile, Ellison was jailed for three years for his role in the offending.

MP for Wrexham Last week, along with colleagues on the Welsh Affairs Select Committee, we took evidence from a number of witnesses for our enquiry into Prisons, Probation and Rehabilitation in Wales. As MP for the constituency with the largest prison in the UK, HMP Berwyn, this session was particularly relevant to our area. I also wanted to hear the experiences of those representing people working in the prison and probation services. Berwyn faces pressures as it is increasingly being used to house the remand population from North-West England. The dynamics at Berwyn alongside its size is very different to jails like Swansea or Cardiff that tend to house inmates who are more local to the area. Furthermore, there have also been staffing challenges at Berwyn however recently the staffing levels have come close to a full complement. The importance of staffing and leadership was emphasised at all prisons. High recall rates in Wales are also putting pressure on the prison and probation services. There is no women's prison in Wales and we heard about the impact of this on women and their families. Welsh women are held in prisons in England, often meaning significant journeys for relatives wanting to visit them. Women from Wrexham for example, might be taken to HMP Styal near Manchester. A report entitled 'Time to Care' emphasised the importance of keeping close ties with families to support. Following on from this, I welcome the Justice Secretary's announcement on Thursday that the Government will take the recommendations of the Gauke report and introduce a presumption against custodial sentences of less than a year. As 77% of women sentenced to custody received a sentence of 12 months or less, this change should have a significant aspect on women. Having spoken to organisations working in our community like the Wallich and NACRO, I understand the issues around homelessness and reoffending and I am looking to work with them to see how we can strengthen prevention and rehabilitation efforts. Christopher Daniels, of Alyn Road, Buckley, appeared at Mold Crown Court via a video link from HMP Berwyn on Wednesday afternoon. The 51-year-old previously admitted making indecent images of children at category A, B and C. The charges also led to a breach of his SHPO, handed down in 2017. Dafydd Roberts, prosecuting, told the court that after being sentenced for making indecent images in 2017, Daniels was given a six month custodial sentence and a SHPO, which prevented him from using any file shares or anonymity software. In November 2022, North Wales Police searched Daniels' address and found indecent images, leading to his arrest. He was later released under investigation, but searches of his devices led to a total of 324 still images being found and one moving. A total of 147 were Cat A, 74 and the moving image were Cat B and there were 113 Cat C images. The children depicted were both male and female ranging from the ages of four to 12. When interviewed by police, Daniels continued to deny any knowledge of the images that were found on his devices. The defendant had six previous convictions for 13 offences. Myles Wilson, defending, told the court that Daniels has "unresolved personal trauma" from both childhood and adulthood. He was described as an "anxious individual" who has become "isolated in recent years" and has been "targeted by locals" near to where he lives. Mr Wilson also read out the conclusions of a psychiatric report on Daniels, which suggested he would benefit from "therapeutic intervention" and suggested that there was a realistic chance at rehabilitation. Daniels was described as being "desperate to get some help". Sentencing, Judge Rhys Rowlands said that it was "abundantly" clear that Daniels didn't intend to comply with the initial SHPO. Judge Rowlands added that there was "no realistic chance of rehabilitation at this time". Daniels was sentenced to 18 months imprisonment, 12 for the Category A images and six for the breach of the SHPO. A new SHPO has been issued, which will last 10 years from the day of sentencing.

'Depraved' paedophile repeatedly accessed indecent images of children

A sex offender who made indecent pictures of children and installed illegal software was today told by a judge "boredom and loneliness" was no excuse for his "depraved" behaviour. Christopher Daniels, 51, of Alyn Road, Buckley, admitted making the images of children - including a baby girl. The pictures were in the most serious category A as well as categories B and C. Mold Crown Court heard Daniels had been given a sexual harm prevention order (SHPO) for ten years in January 2017. Terms prohibited him from file sharing or using anonymity software on any device capable of accessing the internet. You can sign up for all the latest court stories here However, on November 3, 2022 police searched his home and he was arrested on suspicion of making indecent images of children. Officers examined devices and found 147 indecent images in category A, 74 indecent images and one moving film both in category B, and 113 category C indecent images. Images of boys and girls aged about four to 12 were on a Samsung phone with a protected PIN. His laptop had FrostWire peer-to-peer software - in breach of his SHPO. Prosecutor Dafydd Roberts said one image showed someone committing an indecent act on a baby girl. A man committed an intimate act on another girl aged four to six in another image, the court heard. Myles Wilson, defending, said a psychologist found Daniels has "unresolved, personal trauma" from childhood and adulthood. He is a "particularly anxious individual". He doesn't work and feels targeted by locals. He has little support from family or friends and feels isolated, he added. But Mr Wilson suggested Daniels could be rehabilitated. However, the judge His Honour Rhys Rowlands told the defendant: "I'm afraid it's abundantly clear to me you have no interest in complying with the terms of the sexual harm prevention order. "The purpose and terms (of a SHPO) are important tools to ensure there is no repetition of the unnatural and worrying behaviour on your part." The judge said that there had been some sophistication in storing images during his "depraved" behaviour. He added: "Obsessive behaviour born out of boredom and loneliness is understandable (but) I fail to see how this explains let alone excuses your deliberate and repeated accessing images of young children seemingly whilst affected by drink." Nor does it excuse a deliberate breach of a court order - an order which would have been explained to him repeatedly, he said. For making indecent images in category A Daniels was jailed for 12 months with no separate penalties for the category B and C offences. He was also given six months in jail, to run consecutively, for breaching the SHPO, making a total of 18 months imprisonment.
