Opinion - Congress and the Supreme Court are trying to undermine lower court judges
Both Congress and the Supreme Court seem poised to kneecap what may be the only meaningful remaining constitutional check on the presidency: lower federal court judges.
Last week, the House of Representatives passed the absurdly named 'One Big Beautiful Bill Act,' a hodgepodge of controversial tax breaks for the wealthy, spending reductions and increased work requirements for food aid and Medicaid programs and huge funding increases for President Trump's mass migrant removal program, among other provisions.
Buried in its 1,000 pages is also this poison pill: 'No court of the United States may use appropriated funds to enforce a contempt citation for failure to comply with an injunction or temporary restraining order if no security was given when the injunction or order was issued.'
As law professor Erwin Chemerinsky explained for Just Security, the bill effectively requires payment of a bond before a federal judge can issue an injunction against the government or a private party. Yet 'those seeking such court orders generally do not have the resources to post a bond, and insisting on it would immunize unconstitutional government conduct from judicial review. It always has been understood that courts can choose to set the bond at zero.'
Injunctions have been used to force the government's compliance with federal law since at least 1913. By mandating the pre-payment of a bond as a prerequisite to injunctions, Chemerinsky writes, 'the House bill would make the court orders in these cases completely unenforceable.'
This is a shameless gift to the Trump administration, which is facing down hundreds of lawsuits in the lower federal courts that seek to vindicate constitutional rights as basic as due process and free speech.
Meanwhile, the Supreme Court's far-right majority is also taking steps to undermine the lower courts' authority.
Consider the case challenging Trump's executive order invaliding the constitutional right to birthright citizenship. At the Trump administration's invitation, the justices have detoured into the question of so-called 'universal injunctions' — admonishing their district court colleagues for acting too big for their britches while sidestepping the president's blatant disregard of the 14th Amendment itself.
The implications of that case are stark. If the majority sides with Trump by banning judges from issuing orders that stop illegal government behavior nationwide, it could mean that every individual affected by an unconstitutional executive order — including the millions of children whose citizenship is tied to birth — must hire a lawyer and file a separate case to enforce the Constitution's express language, effectively giving Trump a practical 'win' on technical grounds.
In the meantime, Trump would be free to impose his unconstitutional ban against the vast majority of people affected through a procedural maneuver that sidesteps the heart of the problem: his own overreach. For the high court to seriously entertain this argument on the facts of this particular case is a swipe at the lower courts' relative authority to uphold the Constitution against government abuses, too. (The Supreme Court only takes approximately 1 percent of appeal petitions per year, so it can't do it all.)
On Thursday, in Trump v. Wilcox, a 6-3 majority overruled a 90-year-old precedent upholding Congress's ability to require presidents to show cause before firing the heads of certain agencies — in that case, the heads of the National Labor Relations Board and the Merit Systems Protection Board. As Justice Elena Kagan noted in her dissenting opinion, by firing the agency heads without providing a reason, 'Trump has chosen … to take the law into his own hands' in a way that no president has attempted 'since the 1950s (or even before).' And the majority handed Trump his win 'on an emergency docket' which, wrote Kagan, 'while fit for some things, should not be used to override or revise existing law.'
The conservative majority's snub of the work of the lower courts without full briefing and oral argument in its own capacity as an appellate court once again ignores its similarly restrained role under the system of separated powers.
Article III of the Constitution creates 'one Supreme Court,' but is silent on the number of justices or the scope of their authority to hear appeals. Congress gets to determine both by statute. Congress is also responsible for establishing the 'inferior courts,' which it did in the first Judiciary Act of 1798.
The power of all federal judges — both on the Supreme Court and the courts of appeals (the intermediate federal courts) and in the district courts (the trial-level courts) — is confined to deciding 'cases,' meaning distinct disputes brought by feuding parties over a concrete injury claimed by the plaintiff. No federal court, including the Supreme Court, is supposed to make laws out of whole cloth. That is Congress's job.
In other words, there is nothing magically different about Supreme Court justices as compared to lower federal courts regarding their power to decide 'cases' under Article III as an initial matter. In Marbury v. Madison, the Supreme Court ruled in 1803 that it has the ultimate constitutional prerogative to review the other branches' actions for adherence to the rule of law. But with rare exceptions, Article III confines its power to hearing appeals from other courts: 'The Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.' An appeals court traditionally operates by carefully reviewing the record from the court below. In the Wilcox decision, the majority perfunctorily cast that part aside.
As Professor Chemerinsky — a giant in the world of constitutional scholarship — underscores, House Republicans' stealth effort to disable lower federal courts from enforcing injunctions in deference to a single man is a red-light moment for democracy. If the Supreme Court continues to shrug off its own colleagues' attempts to check the presidency, it could mean a checkmate on the Constitution itself.

Amid President Donald Trump and Elon Musk's bitter online war of words, key posts have been deleted from social media. The most divisive post from Musk alleged that Trump is listed in the files related to the late financier and sex offender Jeffrey Epstein, and that this is why they have not been fully released to the public. Musk made the allegation on Thursday, in a post shared on his social media platform, X (formerly Twitter). Another inflammatory post from Thursday, which saw Musk respond 'yes,' endorsing a message that said 'Trump should be impeached' and that Vance 'should replace him,' is also no longer viewable on X. The deleted posts suggest that the explosive feud between Trump and his one-time ally could be thawing. Musk's original posts came as Trump also lobbed insults and threatened to take away government funding and contracts related to billionaire Musk's Space X company. Although things appear, for now, to be simmering down, Trump has made it clear he does not have plans to reconcile with Musk. When asked on Friday night by reporters if he intends to speak with Musk—who until recently lead the Department of Government Efficiency (DOGE)—the President gave a clear response. 'No I don't have plans… I'm not even thinking about it,' Trump said on Air Force One. 'I'm not really interested in that, I'm really interested in the country, and solving problems.' However, when asked if he plans to take back the symbolic White House key that he gifted to Musk, Trump said that he has no intention of doing that. "I don't take things back, I gave him a key, he tried very hard,' the President told reporters, praising the efforts of DOGE. Trump also appeared to defend Musk against the New York Times' reported allegations that the Tesla CEO regularly consumed ketamine, ecstasy, and psychedelic mushrooms when traveling with Trump on the campaign trail in 2024. 'I don't want to comment on his drug use. I don't know what his status is,' Trump said, when asked by reporters if he had concerns. 'I read an article in the New York Times. I thought it was, frankly, it sounded very unfair to me.'

The top Taliban leader on Saturday slammed President Donald Trump's travel ban on Afghans, calling the United States an oppressor, as Afghanistan's rulers seek greater engagement with the international community. The comments from Hibatullah Akhundzada marked the first public reaction from the Taliban since the Trump administration this week moved to bar citizens from 12 countries, including Afghanistan , from entering the U.S. Trump's executive order largely applies to Afghans hoping to resettle in the U.S. permanently, as well as those hoping to go to America temporarily, including for university studies. Since returning to power in Afghanistan in 2021, the Taliban have imposed harsh measures, banned women from public places and education for women and girls beyond the sixth grade. And though they have so far failed to gain recognition as the country's official government, the Taliban have diplomatic relations with several countries, including China and Russia. A message from the leader Akhundzada released his message on the Islamic holiday of Eid al-Adha , also known as the 'Feast of Sacrifice,' from the southern city of Kandahar, where he has set up base but is rarely seen in public. In a 45-minute audio recording shared by Taliban spokesman Zabihullah Mujahid on X, Akhundzada denounced the Trump administration for imposing 'restrictions on people.' 'Citizens from 12 countries are barred from entering their land — and Afghans are not allowed either,' he said. 'Why? Because they claim the Afghan government has no control over its people and that people are leaving the country. So, oppressor! Is this what you call friendship with humanity?' He blamed the U.S. for the deaths of Palestinian women and children in Gaza, linking this allegation to the travel ban. 'You are committing acts that are beyond tolerance,' he added. The Trump administration says the measure is meant to protect U.S. citizens from 'aliens who intend to commit terrorist attacks, threaten our national security, espouse hateful ideology, or otherwise exploit the immigration laws for malevolent purposes.' It argues that Afghanistan lacks a competent central authority for issuing passports or civil documents and lacks appropriate screening and vetting measures. It also says Afghans who visit the U.S. have a high visa overstay rate. Trump also suspended a core refugee program in January, all but ending support for Afghans who had allied with the U.S. and leaving tens of thousands of them stranded. The Taliban offer amnesty Also on Saturday, the Taliban prime minister said that all Afghans who fled the country after the collapse of the former Western-backed government are free to return home, promising they would be safe. 'Afghans who have left the country should return to their homeland,' Mohammad Hassan Akhund said. 'Nobody will harm them.' 'Come back to your ancestral land and live in an atmosphere of peace,' the Taliban prime minister said in a message on X and instructed officials to ensure returning refugees were given shelter and support. He also used the occasion to criticize the media for making what he said were 'false judgements' about Afghanistan's Taliban rulers and their policies. 'We must not allow the torch of the Islamic system to be extinguished,' he said. 'The media should avoid false judgments and should not minimize the accomplishments of the system. While challenges exist, we must remain vigilant.' The return of the Taliban rule The Taliban swept into the capital of Kabul and seized most of Afghanistan in a blitz in mid-August 2021 as the U.S. and NATO forces were in the last weeks of their pullout from the country after 20 years of war. The offensive prompted a mass exodus , with tens of thousands of Afghans thronging the airport in chaotic scenes, hoping for a flight out on the U.S. military airlift. People also fled across the border, to neighboring Iran and Pakistan. Among those escaping the new Taliban rulers were also former government officials, journalists, activists, those who had helped the U.S. during its campaign against the Taliban. Separately, Afghans in neighboring Pakistan who are awaiting resettlement are also dealing with a deportation drive by the Islamabad government to get them out of the country. TIMELINE: Inside the evolving relationship between Trump and Musk from first term to this week's fallout
The fallout between Elon Musk and President Donald Trump is an evolving situation marked by a public blowup on Thursday, but their relationship ties back to Trump's first term and even earlier. A November 2016 CNBC interview with the Tesla CEO, who's now the richest man in the world, took a critical tone of the now president just days before he was elected president in an upset that signified the strength of the populist movement. "Honestly, I think Hillary's economic policies and her environmental policies particularly are the right ones, you know, but yeah. Also, I don't think this is the finest moment in our democracy at all," Musk said. "Well, I feel a bit stronger that probably he's not the right guy. He just doesn't seem to have the sort of character that reflects well on the United States," he later added in the interview. During Trump's first term, Musk was part of some of his economic advisory councils, which often includes CEOs, but ultimately left his post because he disagreed with the president's move to exit the Paris Climate Accords. "Am departing presidential councils. Climate change is real. Leaving Paris is not good for America or the world," Musk posted at the time. The two continued to have an on-and-off relationship, but there were some positive signs in May 2020. "Elon Musk, congratulations. Congratulations, Elon. Thanks, Elon. For Elon and 8,000 SpaceX employees, today is the fulfillment of a dream almost two decades in the making," Trump said at the Kennedy Space Center in May 2020. And at the SpaceX Demo-2 launch, Trump said he and Musk communicate regularly. "Well, I won't get into it. But, yeah — but I speak to him all the time. Great guy. He's one of our great brains. We like great brains. And Elon has done a fantastic job," he said. Fast forward to 2022, when Musk purchased Twitter and renamed it X, and brought back Trump's account that November, after it was suspended after the events of Jan. 6, 2021. In 2022, Musk also announced that he would vote Republican, but indicated he would back Florida Gov. Ron DeSantis if he opted to seek the nomination. DeSantis launched his campaign on X in a "space," a virtual public event forum, with Musk, who also reportedly significantly financially backed the Florida governor, according to The Wall Street Journal. However, a major turning point was in July 2024, after the assassination attempt of Trump at a rally in Butler, Penn. "I fully endorse President Trump and hope for his rapid recovery," Musk posted. Musk then campaigned for the president, including a famous moment when he was jumping on stage at his comeback rally in Butler. "I want to say what an honor it is to be here and, you know, the true test of someone's character is how they behave under fire, right?" Musk said at the rally. "And we had one president who couldn't climb a flight of stairs and another who was fist pumping after getting shot." "This is no ordinary election," the tech CEO continued. "The other side wants to take away your freedom of speech." "Just be a pest to everyone," he added. "You know, people on the street everywhere: Vote, vote, vote!" The tech billionaire spent roughly $300 million through America PAC to boost swing state voter efforts, including Pennsylvania. By the time the presidential election rolled around, Trump and Musk appeared to be close friends as the Tesla CEO was with Trump in Mar-a-Lago on election night. Over the next few days, Musk remained in Florida and was reportedly advising Trump on appointments and policy as the transition to a new administration kicked off. A week later, shortly before Musk and the new president appeared at a SpaceX launch together in Texas, Trump announced that Musk and tech entrepreneur Vivek Ramaswamy would be heading up the Department of Government Efficiency in an effort to rid the government of waste, fraud, and abuse. Trump described the pair as "two wonderful Americans' and although Ramaswamy left that post in January and is now running for governor in Ohio, Musk stayed on and quickly became the face of an agency that made him the main target of attacks from Democrats pushing back on spending cuts that they argued were too drastic. Protests erupted nationwide against Musk and DOGE including violent outbursts at his Tesla dealerships that tanked the company's stock and were labeled as acts of "domestic terrorism" by the Justice Department. During the first few months of the year, Musk and Trump were spotted together at several viral events including a UFC fight, an Oval Office meeting where Musk's son "Little X" stole the show, and a cabinet meeting in late February where Musk was the main focus. In March, Trump hosted Elon at a Tesla showcase in front of the White House amid a dip in Tesla stock where the president told reporters he was purchasing a Tesla while touting the company. As Musk's time at DOGE began to wind down, his employee classification allowed him to serve for 130 days, the newly formed agency had become the poster child of anti-Trump sentiment from Democrats who consistently attacked the $175 billion in spending cuts that DOGE estimated it delivered. Signs of fracture in the relationship began showing in late May when Musk took a public shot at Trump's "big beautiful bill" as it made its way through Congress. "I was disappointed to see the massive spending bill, frankly, which increases the budget deficit, not just decreases it, and undermines the work that the DOGE team is doing," Musk said. Two days later, Musk announced his official departure from DOGE. "As my scheduled time as a Special Government Employee comes to an end, I would like to thank President @realDonaldTrump for the opportunity to reduce wasteful spending," Musk said, adding that the effects of DOGE "will only strengthen over time as it becomes a way of life throughout the government." DOGE, which fell short of Musk's initial goal of slashing $1 trillion in spending which Musk said he still remains optimistic will happen in the future, will continue its work without Musk, who said, "I look forward to continuing to be a friend and adviser to the president." That optimistic tone shifted drastically on June 3 when Musk took to X, the platform he owns, and blasted the budget reconciliation bill calling it "a disgusting abomination" and criticizing the Republicans who voted for it. "KILL THE BILL," Musk said the next day. A day after that, on Thursday, the feud hit a fever pitch. While speaking with reporters in the Oval Office, Trump said that he was "very disappointed" by Musk's vocal criticisms of the bill. The president claimed that Musk knew what was in the bill and "had no problem" with it until the EV incentives had to be cut. On X, Musk called that assessment "false." Trump turned to social media to criticize Musk, who he appointed to find ways to cut $2 trillion after forming the Department of Government Efficiency (DOGE). "Elon was 'wearing thin,' I asked him to leave, I took away his EV Mandate that forced everyone to buy Electric Cars that nobody else wanted (that he knew for months I was going to do!), and he just went CRAZY!" Trump said in one post. In another post, Trump said, "I don't mind Elon turning against me, but he should have done so months ago. This is one of the Greatest Bills ever presented to Congress. It's a Record Cut in Expenses, $1.6 Trillion Dollars, and the Biggest Tax Cut ever given." "If this Bill doesn't pass, there will be a 68% tax increase, and things far worse than that. I didn't create this mess, I'm just here to FIX IT. This puts our Country on a Path of Greatness. MAKE AMERICA GREAT AGAIN!" At one point, Musk referenced late pedophile Jeffrey Epstein in relation to Trump as part of the larger tirade in a comment that several Republicans told Fox News Digital went "too far." Other posts from Musk included a claim that Trump would not have won the election without his help while accusing Trump of "ingratitude." In another post, Musk suggested that Trump should be impeached and replaced by Vice President Vance. It is unclear if a resolution to the feud is coming in the next few days. Fox News Digital reported on Friday morning that Musk wants to speak to Trump and that White House aides could possibly broker a meeting. Trump told Fox News on Friday that he isn't interested in talking to Musk, adding that "Elon's totally lost it." Trump also said to Fox News' Bret Baier that he isn't worried about Musk's suggestion to form a new political party, citing favorable polls and strong support from Republicans on Capitol Hill.
