HC upholds TN law regulating online real-money games
Chennai: A Tamil Nadu law regulating online real-money games like rummy and poker by introducing age, money, time and ad restrictions, besides two-stage Aadhaar-based verification, has been upheld by
Madras high court
.
"In true essence, the online real money games is a trade activity, which, if left unregulated, has immediate implications on health of the public," a division bench of Justice S M Subramaniam and Justice K Rajasekar said on Tuesday.
Bench made the observation while dismissing a batch of petitions moved by online gaming platforms challenging validity of restrictions.
Refusing to concur with the platforms which contended that a state govt lacks power to bring in such restrictions, the court said, "Both the Union and state govts have power to enact laws in their own respective subject matter apart from the common pool as enabled in List III (concurrent list).
This court cannot hold that state is barred from enacting laws regulating online real money games. It is covered under the subject matter of public health and sanitation which comes under List II (state list)," judges said.
The argument that Information Technology Rules, 2021 already prescribe a regulatory framework for intermediaries, including online gaming platforms, and hence the state cannot frame a subordinate legislation is unacceptable, the court said.
"This court views that the state is fully within its competence to enact laws pertaining to online real money games. This court on perusal of the provisions of the Act (state legislation) finds no contradictions or provisions that run contrary to the central rules in force," the bench said.
Moreover, the provisions related to online gaming under IT Rules, 2021 is yet to take effect and remains unenforceable as of today.
So there exists a vacuum in regulating online games, the court pointed out. The judges added that they are of the view that the state govt has rightfully taken adequate steps to fill in the vacuum by framing the legislation.
Rejecting argument that mandatory Aadhaar verification violates privacy of a player, bench said, "Right to privacy carries with it its own limitations and cannot be claimed in absolute. When put on a scale, a compelling public interest outweighs right to privacy."

NIA raids 32 locations in J&K to probe conspiracy by Pak-based terror outfits
The National Investigation Agency (NIA) carried out searches at 32 locations across Jammu and Kashmir on Thursday to probe a conspiracy hatched by Pakistan-based terror outfits, officials said. The locations were residential premises of hybrid terrorists and overground workers associated with these Pakistan-based offshoots, such as The Resistance Front (TRF), United Liberation Front Jammu and Kashmir (ULFJ&K), Mujahideen Gazwat-ul-Hind (MGH), Jammu and Kashmir Freedom Fighters (JKFF), Kashmir Tigers, People's Anti-Fascist Front (PAFF) and others, they said. All of these outfits are affiliated to proscribed terrorist organisations, such as Lashkar-e-Taiba (LeT), Jaish-e-Mohammed (JeM), Al-Badr etc., the officials said. The raids were carried out in Pulwama, Kulgam, Shopian, Baramulla and Kupwara districts, they added. The searches were part of continuing investigations against a terror conspiracy hatched by Pakistan-backed proscribed terrorist organisations and their offshoots to destabilise Jammu and Kashmir, according to a statement issued by the NIA. Live Events "Thirty-two locations in the UT of Jammu and Kashmir were searched as part of today's crackdown," the statement said. The cadres and workers whose premises were searched are under the NIA's scanner for their involvement in supporting terror activities, such as facilitating terrorists, collection and distribution of sticky bombs or magnetic bombs, improvised explosive devices (IEDs), funds, narcotic substances and arms and ammunition, the statement said. According to the NIA investigations, these offshoots, supported by their leaders in Pakistan, have been conspiring to commit acts of terror and violence by radicalising local youngsters and mobilising overground workers to disturb peace and communal harmony in Jammu and Kashmir. The investigations have revealed that Pakistan-based operatives are using social media platforms and online apps to facilitate and promote terror, the NIA said. "Drones were being used by them to deliver arms/ammunition, explosives, narcotics etc. to their operatives and cadres in the Kashmir valley," the probe agency said. Two live cartridges, a fired bullet head and a bayonet were seized during the searches, it added. Besides, several digital devices containing large volumes of incriminating data and documents have been found by the NIA. These will be subjected to a thorough scrutiny by the agency to unravel the details of the terror conspiracy, the NIA said.

On Monday, Badgujar was seen meeting Maharashtra Chief Minister Devendra Fadnavis, a move that triggered an immediate backlash from both the local BJP and the Sena (UBT) that moved fast to suspend Badgujar following the meeting. The BJP, which previously pursued multiple inquiries against Badgujar for his purported underworld connections, now finds itself facing internal dissent. BJP workers and lower-level leaders have expressed strong opposition to the prospect of the Sena leader's induction, viewing the leadership's sudden engagement with him, aimed at bolstering the BJP's position ahead of the civic elections, as a betrayal of its stated principles. * Who is Sudhakar Badgujar? Till this March, the 55-year-old Badgujar served as the Sena (UBT)'s Nashik district unit chief and Deputy Leader of the Shiv Sena (UBT). His political career began in 2007 when he was elected as an independent corporator in the Nashik Municipal Corporation (NMC). At the time, Sena corporator Vinayak Pandey became Mayor with the backing of independents, of whom Badgujar was one. This early alliance marked the beginning of his association with the Shiv Sena. Badgujar formally joined the party on June 14, 2008, in the presence of senior leaders Uddhav Thackeray and Sanjay Raut. He quickly rose through the ranks. From 2009 to 2012, he served as the Leader of the House in the NMC, and after the corporation came under the control of the Maharashtra Navnirman Sena, he served as the Leader of the Opposition from 2012 to 2015. He contested the Nashik West Assembly constituency twice, first in 2014 on a Shiv Sena ticket, and again in 2024 for the Sena (UBT), but lost both times to the BJP's Seema Hiray. Despite electoral setbacks, Badgujar has remained a constant presence in local politics, serving as a corporator for over 15 years. Also known as a successful contractor with substantial financial clout, he has maintained close ties with Sanjay Raut and is one of the few well-resourced leaders in Nashik who remained loyal to Thackeray following the split in the Shiv Sena. * What were the BJP's allegations against Badgujar? In December 2023, BJP MLA Nitesh Rane accused Badgujar of associating with convicted Dawood aide Mohammed Salim Mira Shaikh — known in Mumbai underworld circles as Salim Kutta, he had once urged a TADA court to drop the offensive epithet from court records — who was a key figure in the 1993 Mumbai bomb blasts. Rane alleged that Badgujar had hosted the gangster at his farmhouse in Nashik. Following these allegations, the Nashik Police registered an FIR against Badgujar under the Unlawful Activities (Prevention) Act (UAPA) and a Special Investigation Team (SIT) was constituted to probe the matter. An externment order was later issued against Badgujar, which he legally challenged. In the run-up to the Maharashtra Assembly elections that he contested on a Sena (UBT) ticket, the Sena leader was at the centre of another row when his son Deepak was booked under the Maharashtra Control of Organised Crime Act (MCOCA) in connection with a 2021 murder case. Badgujar lost the election. The veteran leader has been treading cautiously since the Fadnavis-led government came to power, leaving his political future open-ended. With the BJP entrusting Nashik's political affairs to minister Girish Mahajan, a close confidant of the CM, Badgujar began re-evaluating his allegiance to the Sena (UBT). Speculation about his growing proximity to the BJP intensified after reports of frequent backchannel communication with Mahajan. It was his Monday meeting with Fadnavis during the latter's visit to Nashik that signalled a possible realignment. Although Badgujar later downplayed the significance of the meeting, claiming it was solely to discuss issues affecting NMC workers, the political fallout was swift. Within 24 hours of the meeting, Sena (UBT) expelled him from the party. * Why does the BJP want Badgujar, and how has the local unit responded? The BJP is looking for a strategic advantage in Nashik ahead of the municipal corporation elections, where it came to power in 2017 after a strong performance. While Badgujar may not enjoy the stature of a major state leader, he is regarded as a shrewd operator with a strong grasp of the political machinery at the civic level in Nashik. His financial clout and influence on local dynamics make him a potentially valuable asset for the BJP in its bid to retain control of the NMC. However, his potential entry into the BJP has triggered discontent in the local BJP. Nashik West MLA Seema Hiray is among those opposed to Badgujar joining the party. 'There has been no discussion on Badgujar joining our party. I have contested against him twice. He has harassed our workers and made objectionable remarks about our leaders. We have urged our senior leadership not to induct such a person into the party,' she said. Despite the local resistance, the BJP's state leadership appears to be weighing the broader political benefits. Asked about it, Girish Mahajan offered a measured response: 'Every party works towards expanding its base. We, too, are doing the same. However, no final decision has been taken as of now.' As the party deliberates, Badgujar remains in a wait-and-watch mode, awaiting the green light. 'I will decide on my political future soon,' he said.

India commits $20 bn for maritime infrastructure development, says Sarbananda Sonowal
India has committed USD 20 billion for infrastructure development, with a focus on enhancing multimodal logistics , port connectivity and trade facilitation, Union Minister Sarbananda Sonowal said on Thursday. Speaking at the Nor-Shipping conference in Oslo, Sonowal highlighted India's growing maritime capabilities, including favourable policy induced investment environment, proven shipbuilding strength, and innovative financing plans to accelerate sectoral growth. According to an official statement, the Ports, Shipping and Waterways Minister also called for greater partnerships for seafarer recruitment . Sonowal also highlighted strengthening of maritime connectivity and supply chains with strategic corridors like India - Middle East - Europe Economic Corridor (IMEEC), the Eastern Maritime Corridor (EMC), and the International North - South Transport Corridor (INSTC). "India has committed USD 20 billion for infrastructure development focused on enhancing multimodal logistics, port connectivity, and trade facilitation. Live Events "Through policy incentives, ease of doing business, and infrastructure enhancement, we are laying the foundation for India to emerge as one of the top five shipbuilding nations by 2047," Sonowal added. Emphasising the need for a green and sustainable maritime future, he said India is establishing three Green Hydrogen Hub Ports -- Kandla, Tuticorin, and Paradip -- to support the manufacturing of green hydrogen and its derivatives and to pioneer the use of alternative fuels in the maritime domain. Sonowal is on a five-day official trip to Norway and Denmark.
