The Islamabad High Court Bar Association has filed a fresh petition in the Supreme Court, challenging the president's authority to transfer judges without public interest justification.
This marks the second major challenge to judicial transfers in recent days.
Filed under Article 184(3) by Bar President Riasat Ali Azad, the petition contends that the president does not have unlimited powers under Article 200(1) of the Constitution to reassign judges between high courts.
It argues that judicial transfers should only occur in the public interest.
The petition follows a similar move by five judges of the Islamabad High Court (IHC) have filed a petition in the Supreme Court of Pakistan, challenging judicial transfers and their impact on seniority.
The 49-page constitutional petition, filed under Article 184(3) through senior lawyers Munir A. Malik and Barrister Salahuddin, argues that the President of Pakistan misused Article 200(1) by overriding the Judicial Commission's authority in transferring judges.
The petition contends that judicial transfers cannot be made without public interest and should not affect the seniority list.
It further states that Article 200 only allows temporary transfers, and the current process violates Article 175(A) of the Constitution.
The judges have urged the Supreme Court to invalidate the Islamabad High Court's current seniority list, citing its inconsistency with Article 194 and the Constitution's Third Schedule.
The petition specifically challenges the appointment of Justice Sarfraz Dogar as acting Chief Justice of IHC, stating that he had only served two weeks in the high court before assuming administrative control.
It also calls for Justices Khalid Soomro and Muhammad Asif to be barred from judicial work.
The President of Pakistan, the federal government, the Judicial Commission, the Supreme Court registrar, and multiple high court registrars have been made respondents in the case.
The five petitioning judges are Justice Mohsin Akhtar Kayani, Justice Babar Sattar, Justice Tariq Mehmood Jahangiri, Justice Saman Rafat Imtiaz, and Justice Sardar Ejaz Ishaq Khan.
The petition also asserts that the failure of transferred judges to take a fresh oath is a constitutional violation.
It claims that seniority begins in the high court where a judge first takes the oath, and altering it through transfers is an unconstitutional interference in IHC's administration.

Rs17.6trn budget to be unveiled today
ISLAMABAD: The federal government Tuesday would present budget 2025–26 with an estimated size of Rs17.6 trillion in the National Assembly for debate and approval. Federal Minister for Finance and Revenue Senator Muhammad Aurangzeb would present federal Budget-2025-26 in the National Assembly. He would also lay the Finance Bill 2024 in the Senate on the same day, as required under Article 73 of the Constitution. Finance Minister Aurangzeb will deliver his second budget speech in the National Assembly. According to official sources, the government is projecting gross federal revenues at record Rs19.4 trillion for next fiscal year, higher by Rs1.6 trillion, while the tax collection target is Rs14,130 billion. The sources said that the proposed breakdown includes direct taxes worth Rs6,450 billion, sales tax revenue of Rs4,900 billion, excise duties of Rs1,150 billion, and Customs duties totaling Rs1,740 billion. Petroleum levy collection is expected to bring in Rs1,311 billion. They said that non-tax revenue is projected at Rs4,000 billion, and the provincial surplus budget is estimated at Rs1,200 billion. According to statement issued by National Assembly Secretariat, Speaker National Assembly Sardar Ayaz Sadiq has approved the schedule for the upcoming sessions of the National Assembly regarding the presentation and discussion of the Federal Budget for the fiscal year 2025–26. The Federal Budget 2025–26 will be presented in the National Assembly on June 10, 2025. The House will remain in recess on June 11 and 12, and the budget debate will commence on June 13, 2025. Speaker Sadiq stated that all parliamentary parties represented in the National Assembly will be given appropriate time to participate in the budget debate in accordance with the assembly's rules and procedures. The general discussion on the budget will continue until June 21, and the debate will formally conclude on the same day. There will be no sitting of the House on June 22. On June 23, the National Assembly will hold a discussion on the charged expenditures for the fiscal year 2025–26. This will be followed by debates and voting on Demands for Grants and Cut Motions on June 24 and 25. The Finance Bill 2025 will be taken up for approval by the National Assembly on June 26, while supplementary grants and other related matters will be discussed and voted on June 27, 2025. FBR recovers Rs600bn as IHC vacates stay orders in 270 cases
ISLAMABAD: In the last few months, the Islamabad High Court (IHC) has vacated stay orders in 270 tax-related cases that had incapacitated Federal Board of Revenue (FBR) to recover more than Rs600 billion. These 270 tax-related cases were pending in the IHC for over two decades. According to the details, three IHC division benches decided these tax-related matters. The division bench of Justice Mohammad Azam Khan and Justice Raja Inaam Ameen Minhas decided an overwhelming majority of 173 of tax cases involving Rs424bn. Another IHC bench comprising Justice Babar Sattar and Justice Sardar Ejaz Ishaq Khan cleared 94 cases in which over Rs150bn recoveries were stalled. A bench comprising acting IHC Chief Justice Sardar Mohammad Sarfraz Dogar and Justice Raja Inaam Ameen Minhas lifted the stay orders and decided three petitions that had in 2023 restrained the FBR to collect Rs36bn. A two-member division bench comprising Justice Mohammad Azam Khan and Justice Raja Inaam Ameen Minhas decided 125 cases related to Income Tax References, Sales Tax References and Foreign Exchange Regulations Act. The government's recoverable Rs290.51bn were stuck in 125 cases related to ITR. 36 STR cases involved recovery of Rs131.55bn while Rs3.16bn were recoverable in 12 cases related to FERA. In February this year the Prime Minister met with Chief Justice of Pakistan (CJP) Yahya Afridi to discuss the agenda of the upcoming meeting of the National Judicial Policy Making Committee. During the meeting, the Prime Minister requested the CJP for expeditious disposal of tax-related cases. The IMF Governance and Diagnostic Assessment teams visited Pakistan to examine the governance structure of several ministries related to fiscal policy, tax policy, corruption, procurement, audits, and anti-money laundering. The NJPMC also advised for swift disposal of the tax-related matters, in its meeting held in April, asking the high courts to constitute special benches for expeditious disposal of tax-related cases. Following NJPMC's advice and directions issued by the apex court in the tax matters, the IHC Judicial Registrar put up a note before the acting CJ for consolidation of all the matters. Gohar confident about PTI founder's bail
BUNER: Pakistan Tehreek-e-Insaf (PTI) Chairman Barrister Gohar, expressed confidence that the party's founder Imran Khan will secure bail, emphasising that June 11 is a crucial date in this regard. Speaking to a private television channel, he extended Eid greetings to all Pakistanis, Palestinian brothers, and soldiers fighting at the borders. He noted that this was the fourth Eid without Imran Khan's presence, yet his ideology continues to guide the party. Gohar announced that PTI will collaborate with opposition parties to launch a movement, which will be led by the party's 'pattern-in-chief' from jail. He urged opposition parties to join PTI for the sake of the country's survival and security. Addressing the detention of Bushra Bibi, he claimed she is being held in jail without any charges to pressure the PTI founder. He said that no deals will be made for the party founder's release. It is important to mention here that the Islamabad High Court (IHC) earlier postponed the hearing of petitions requesting the suspension of sentences for Imran Khan and his wife Bushra Bibi in the 190 million Pound Al-Qadir Trust case until June 11.
