‘Patriarchal, condescending': Calcutta high court raps trial court judge

Calcutta HC has in a recent order sharply criticised a trial court judge for his choice of words in matrimonial disputes, describing these as "patriarchal and condescending to women".
It also rapped the judge for "copy-pasting" the order from his earlier judgments and warned if such instances were repeated, it would impact his service record.
On May 22, HC granted divorce to a man on grounds of cruelty, overturning a 2018 order by the additional district judge, first court, at Sealdah. What irked HC was the trial court judge's order rejecting the husband's divorce plea and formulating "auspicious principles" for a successful marriage.
HC: Just stopping short of making adverse comment
The husband had filed a divorce plea in the trial court in 2015 alleging that his wife had not visited her matrimonial home since 2012, was refusing to cohabit and meet her marital obligations since 2014, and threatening to initiate criminal complaints against him. While the wife refuted the claims, the HC noted that no evidence was attached. While allowing the divorce suit, the HC noted that the wife had even skipped mediation as suggested by the HC in 2023.

The judge's four-point formula for a successful marriage included "transcendental efforts to keep a perfect relation based on austerity of the spouse for achieving purity of the relation", "paying honour to our traditional belief", "sincere interest in cultivating fidelity", and "unmotivated and uninterrupted urge to completely satisfy each other".
The HC division bench of Justices Sabyasachi Bhattacharyya and Uday Kumar said in its order: "The entire mindset of the learned trial judge appears to spring from a patriarchal and condescending approach, thereby attributing a condescending role to the husband, to advise his wife properly, and also to condone cruel acts of the wife by trying to 'bridge the gap' between the parties. Such observations have nothing to do with the law on the subject.

The high court judges said they were "just stopping short" of making any adverse comment against the trial judge because that could affect his career.

Does the sight of young lovers or people of different genders hanging out together irk Chennaites? This February, advocate Thilagavati confronted a patrolman who harassed her for being with a male friend at night on Patinapakkam beach. She had recorded the encounter and uploaded it on social media. This led to much discussion on the topic of moral policing in public places in the city. Uproar over Ms. Thilagavati's experience had led to the officer being transferred. But the woman later faced cyberbullying about which she complained to the cyber police. 'More than men, women are targeted by law enforcement officers in such circumstances,' she says. 'Couples, especially teenagers, are easily targetted. They are then threatened and blackmailed into bribing or assault,' says Ms. Thilagavati. 'Healthy interaction between the opposite sexes should always be encouraged,' says advocate and human rights activist Sudha Ramallingam. 'In Western cultures, couples openly engage in public display of affection and this is not looked upon as vulgar. Why should it be vulgar here? Telangana municipal officials booked for Rs 7.2 lakh fraud: Fake bills raised under 'Pattana Pragathi' scheme; ACB names Huzurnagar commissioner, 2 engineers
HYDERABAD: The Anti-Corruption Bureau (ACB) has registered a case against Huzurnagar municipal commissioner Kankati Srinivas Reddy and two other officials for allegedly misappropriating Rs 7.2 lakh of govt funds during their earlier tenure in Tandur municipality under 'Pattana Pragathi' scheme. The ACB action followed a vigilance inquiry after a complaint by Ward 13 councillor of Tandur municipality, Varala Srinivas Reddy, accusing the commissioner and two engineers of creating bills for fictitious development work using benami contractors by falsifying records. The ACB FIR, issued on May 5, said that Srinivas Reddy, Mohd Younus (deputy executive engineer), and Gopala Mahesh (assistant engineer) colluded to siphon off govt funds in the name fake development work. The FIR said that in one instance the complainant personally undertook silt removal in Chilakavagu, a drain flowing through his ward, using his own resources. However, officials sanctioned Rs 3 lakh in the name of another individual, R Santosh Kumar, for the same work. In another case, officials exaggerated the usage of an excavator during the second phase of the scheme. These works were neither executed nor verified on the ground. The inquiry concluded that all three officials abused their official positions and committed offences under Section 13(1)(a) of the Prevention of Corruption Act, 1988 (as amended in 2018), and IPC Sections 409 and 420.
