
Business owners chew on how FDA dye restrictions will affect them
One local business owner seemed moderately concerned at how dye changes could affect her operations. Others expected less impact.
In a statement issued by the U.S. Food and Drug Administration on Tuesday, the Health and Human Services Department announced initiatives to remove six petroleum-based artificial dyes from the food supply. The administration is aiming to remove the dyes by the end of 2026 with a broader plan to 'Make America Healthy Again.'
'Today, the FDA is asking food companies to substitute petrochemical dyes with natural ingredients for American children as they already do in Europe and Canada,' FDA Commissioner Marty Makary said in the statement. He outlined concerns including childhood diabetes, obesity, depression and attention-deficit/hyperactivity disorder by 'doctors and parents' who fear a potential connection to petroleum-based food dyes. 'We should not be taking risks and do everything possible to safeguard the health of our children.'
Initiatives include revoking authorization for two synthetic food colorings, Citrus Red No. 2, used to color orange peels, and Orange B, used to color sausage casings, 'within the coming months.'
The government also intends to remove six remaining synthetic dyes — FD&C Green No. 3, FD&C Red No. 40, FD&C Yellow No. 5, FD&C Yellow No. 6, FD&C Blue No. 1 and FD&C Blue No. 2 — from the food supply by the end of next year, remove FD&C Red No. 3 sooner than previously requested, and authorize 'four new natural color additives in the coming weeks,' including 'calcium phosphate, Galdieria extract blue, gardenia blue, and butterfly pea flower extract.'
Galdieria extract blue is made from algae, gardenia blue is a powder made from a gardenia flower extract, and butterfly pea flower extract results in a blue coloring.
Schronda White, of Scranton, the owner of Sturdy Candy and Consignment Shop for the past 2½ years, said she had no idea that the dyes, some commonly used to color popular candies, had any connection to health issues, and has concerns that the changes might affect her business.
'I'd probably lose a lot of business because I'm a candy store,' she said, adding that in time, with research, she could find candy that uses 'the right dye' so that her business could recover, and that she has concerns about selling products that could 'harm anybody's health.'
'I would never put anybody's health or situation at risk, I would never do that,' she said. 'I would probably have to close and regroup and take the candy where they say dye is not recommendable and have to do a whole sweep. I wouldn't sell that candy.'
In a candy ingredient and nutritional declaration dated from 2022, issued by Mars Wrigley, colors listed in the ingredients in M&Ms and Skittles include 'Blue 1,' 'Yellow 5,' 'Yellow 6' and 'Red 40.'
Joe Fasula, owner of Gerrity's Supermarkets, doesn't expect the FDA's actions to cause big changes in the grocery industry.
'As far as the grocery stores themselves, it should be seamless for us,' he said, explaining that the stores 'don't really use any dyes' in their production. 'There may be some in our ingredients, as far as our bakery icings and such. I would think those would just transition over to whatever the alternative dyes are,' he said, adding he is uncertain about how new dyes may affect prices.
He said over the years, things have changed in the grocery industry in general, citing examples including more avocados and off-season fruit in the produce aisle, fat percentages listed on beef packaging, and added sugar being included on food labels, and said he believes 'more information is better.'
'Sunlight is the best disinfectant,' Fasula said. 'I'm always opposed to more regulations, but I'm always in favor of more information, and I think that information is the best way to replace regulations. You don't need regulations, necessarily, as long as people are informed.'
Kelly Baker, the manager at Everything Natural, a healthy food supermarket in Clarks Summit, said they support the changes.
'Oh, gosh, we're definitely on board, we don't carry anything in our store that has any artificial colors or flavors,' said Baker. She said if they happen to accidentally order an item with an ingredient that they don't feel is safe for customers, they 'don't put it out.'
'All our colors are based on fruit — like say if something needed red colors, it'd use beet for that,' Baker explained.
She said she's seen a lot of change in the last 20 to 25 years in what people want to eat, and she expects the rest of the food industry will 'catch up' to her store's exacting standards, in time.
'People are more geared to the natural foods, and we have people coming in looking for natural and organic items that don't have artificial flavors and colorings,' Baker said, explaining she believes it's because people 'want to be healthier.'
She said she believes it's possible that artificial colors and red dye may cause health issues.
'I'm not saying that's true, but they're saying a lot of things can cause autism, can cause this, can cause that,' she said, adding she understands that Secretary of Health Robert F. Kennedy Jr. is spearheading the initiative to 'ban all that kind of stuff,' including 'the coloring, the dyes, everything artificial.' Kennedy's 'Make America Healthy Again' website at Kennedy24.com invites supporters to purchase merchandise like a 'Make Frying Oil Tallow Again' hat.
In Pennsylvania, House Bill 1130, introduced March 17, aims to 'prohibit the sale of products containing Red 40, Yellow 5, Yellow 6, Blue 1, Blue 2 and Green 3 in any public school in the Commonwealth,' citing research pointing to the improved academic and behavioral performance by students who eat healthy, and to problems with brain development, hyperactivity and more for those who do not.
'There is a growing body of evidence that links artificial food dyes to many negative health effects on children including hyperactivity, inattention, irritability, as well as other behavioral and developmental issues,' the bipartisan bill memo states. 'Artificial food dyes serve no nutritional purpose whatsoever. We do not believe these dyes have any place in our schools.'

Egg recall over salmonella warning spans across nine states
Almost two million eggs have been recalled in the United States over concerns of salmonella contamination. The recall, announced on Friday by the U.S. Food and Drug Administration, affects products distributed in nine states and is associated with various grocery store chains. According to the FDA, California-based August Egg Company of Hilmar is recalling 1,700,000 dozen brown cage-free and brown certified organic eggs due to potential contamination. The eggs were distributed from February 3 through May 15, with sell-by dates from March 4 to June 4, within California and Nevada. Products were distributed at locations including Save Mart, FoodMaxx, Lucky, Smart & Final, Safeway, Raleys, Food 4 Less, and Ralphs. Eggs were also distributed from February 3 through May 6 with sell-by dates from March 4 to June 19 to Walmart locations in California, Washington, Nevada, Arizona, Wyoming, New Mexico, Nebraska, Indiana, and Illinois. The recalled eggs will have the plant code number P-6562 or CA5330 printed on the carton or package, with Julian Dates between 32 and 126. The recalled retail eggs will be in fiber or plastic cartons, with the above codes printed on one side of the carton. Salmonella can cause serious and sometimes fatal infections in young children, the frail or elderly, and others with weakened immune systems, according to the FDA. Healthy persons infected with Salmonella often experience fever, nausea, vomiting, abdominal pain, and even bloody diarrhea. In rare circumstances, infection with Salmonella can result in more severe illnesses. A statement from August Egg Company read: 'It is important to know that when our processing plant identified this concern, we immediately began diverting all eggs from the plant to an egg-breaking facility, which pasteurizes the eggs and kills any pathogens. 'August Egg Company's internal food safety team is also conducting its own stringent review to identify what measures can be established to prevent this situation from recurring. 'We are committed to addressing this matter fully and to implementing all necessary corrective actions to ensure this does not happen again.'

How thousands of unreviewed ingredients got into our food — and what FDA can do about it
At least 1,000 ingredients in food products on our grocery store shelves have never been checked for safety by the Food and Drug Administration. Dozens have raised serious safety concerns among experts. How did the FDA allow this? The answer can be found in the agency's lax interpretation of a little-known legal designation that lets companies decide for themselves if ingredients in their products are safe. Fortunately, there are steps the agency can take right now to stem the flow of potentially unsafe ingredients into our food supply. Environmental Defense Fund outlined these steps in a letter we recently sent to the agency, but first let's take a closer look at how we got here. 'Generally Recognized as Safe' is a designation Congress created in 1958 to allow commonly used food ingredients to bypass the FDA's pre-market safety review process. It was meant for food substances — such as oils, vinegar, baking soda and common spices — that were widely considered safe due to their long history of everyday use. Since 1958, this status has been coopted to cover a universe of foods that extends far beyond its original intent. According to FDA regulations, a chemical can receive the designation if experts widely agree that scientific evidence shows its use to be safe. But because 'Generally Recognized as Safe' wasn't meant for newer ingredients, Congress allowed ingredients so designated to skip the FDA's premarket approval process — despite requiring similar evidence for other additives. Under the agency's current interpretation, companies can designate the use of a substance as safe and take products with that substance to market without informing the FDA or the public of its decision. While companies may voluntarily submit a notice to FDA offering safety evidence, they are not required to — and often don't. Our organization estimated that manufacturers have notified FDA of fewer than half of the ingredients they market as safe under the 'Generally Recognized' standard. Companies that do bother to submit a notice to the FDA are free to withdraw it at any point and take their product to market, provided they can cite evidence of its safe use. But this 'evidence' is often far from independent. Companies can, and often do, enlist their own employees or handpicked consultants to conduct their safety assessments. The result is a process riddled with conflicts of interest that lets unsafe foods into Americans' homes. We analyzed 'Generally Recognized as Safe' notices received by the FDA, obtained via a Freedom of Information request, and found that of the 1,163 submitted by companies between 1997 and April 2024, 192 were later withdrawn, with safety concerns cited in at least a dozen cases. We also identified 31 ingredients that companies have advertised to be recognized as safe, such as in press releases, trade publications and on their own websites (see the Appendix of our letter). However, we were unable to find the scientific evidence required under this standard to demonstrate these ingredients are commonly regarded as safe among experts. This raises red flags that FDA should be taking seriously. Although a comprehensive fix to the 'Generally Recognized' standard will require legislation from Congress, there are significant steps the FDA can take right away to ensure a more rigorous determination process that better protects Americans' health. Starting today, the FDA can use existing authority to remove safe designations from ingredients it deems unsafe and take them off the market. It can also notify manufacturers, importers, distributors and retailers that the substance is no longer recognized as safe. In addition, the FDA can enforce the requirement that companies base safety designations on publicly available data. Although this won't curtail companies' ability to self-declare substances as safe, it will require those who do to be transparent in citing their evidence. Third, the FDA can enforce the requirement that safety assessments consider vital health information such as a substance's dietary sources, potential cancer risks and the cumulative health effects of similar substances. Finally, the FDA can make companies revise and resubmit their data for review when they submit 'Generally Recognized as Safe' notices that fail to comply with the criteria. The 'Generally Recognized as Safe' designation is far from a perfect system, but it can work better if it is interpreted and enforced more comprehensively. If the FDA is serious about protecting public health, it should start by fully exercising the tools already at its disposal. When you're considering delicious meals, stuffed peppers can offer a pleasurable mix of comfort and creativity. In today's recipe, we stuff peppers with an American mixture of ranch-flavored chicken, vegetables and quinoa, a whole-grain with a slightly nutty flavor. Bell peppers are green when they start growing. As they ripen and change colors, their nutrients and cancer-fighting properties change. In green peppers, lutein and zeaxanthin are important for eye health. In yellow and orange peppers, lutein and violaxanthin also can help to protect vision. Red peppers — the sweetest ones — contain lots of lycopene for heart health and bone health. They may also improve fertility in men. Although they are low in calories, bell peppers are high in vitamin C, an essential nutrient that helps the body heal wounds and absorb iron. Potassium in peppers is important for regulating fluid balance and lowering blood pressure. Vitamin A supports vision and the immune system, while vitamin B6 helps metabolism and improves brain function. Vitamin E protects against cell damage, and vitamin K aids in bone health and blood clotting. Whether you're looking for a cozy weeknight dinner, a make-ahead meal or a colorful main dish for a party, these stuffed peppers provide flavor, flair and lots of nutrients.
