Now, insolvency resolutions exceed liquidations

Time of India22-05-2025

NEW DELHI: The
Insolvency & Bankruptcy Code
(IBC) has resulted in two cases being resolved under the new law for every one that goes into liquidation. This is a sharp contrast to 2017-18, when for every one resolution, five companies went into liquidation, latest data showed.
This improvement is partly because the legacy cases related to liquidation have come down and also due to better quality of assets when they are admitted for
corporate insolvency resolution
.
A number of initiatives are being taken to improve the outcomes of the Code (IBC). These include monitoring of cases pending for admission and ongoing CIRPs (corporate insolvency resolution processes). Further, the Insolvency & Bankruptcy Board of India (IBBI) revised its mechanisms for real-time sharing of information, regarding applications for the initiation of CIRP with the information utility (IU), IBBI said.
Besides, according to the latest numbers, nearly 25 times more cases are being settled even before they are admitted, as the promoters are keen to settle the dues, fearing losing control over their companies. Since the law was enacted, 30,310 cases with underlying default of Rs 13.8 lakh crore were settled pre-admission. Post-admission, IBC resolved 1,194 cases through resolution plans, 2,430 cases were closed through settlement, withdrawals and appeal, and 878 liquidations have closed, IBBI said.
So far, 8,308 cases have been admitted for resolution, with decision pending in case of 1,926 companies. Separate data released in a study showed that there is a marked improvement in borrower behaviour, resulting in fewer delays in repayment of loans availed from banks. In fact, the number of days for which a loan remained overdue has come down significantly between 2018 and 2024, the study said.
In recent years, there is also a marked improvement in the number of cases being disposed of as resolution plans have been approved. The big worry, however, is the time taken in completing the resolution process.
The latest data pegs the time taken at 597 days - more than twice the extended deadline of 270 days provided under IBC. In fact, 78% of the cases that are pending have dragged on for over 270 days.
Another 9% have been going on for 180-270 days. The law provides for deciding cases in NCLT within 180 days, with an extension of 90 days allowed, but extensions have now become the norm.

The agreement was for a period of five years with a maturity dated in November 2026 for the term loan under the GLAS issued a notice of default and sought to accelerate the term loan on March 2023 within 15 months of the Credit Agreement and 3.5 years prior to the maturity realising that certain lenders had stepped into the shoes of the initial investors in violation of the specific terms of the Credit Agreement, Think and Learn exercised its rights under the agreement to protect itself by issuing letter of disqualification on June 5, 2023, to Redwood to the petition, GLAS claims to be the administrative and collateral agent for the lenders under the Credit Trust, which had also filed insolvency plea, claimed that 72.2 per cent of the lenders consented to filing of the same."It is submitted that out of these 72.20 per cent, 61.43 per cent are disqualified lenders. Therefore, from the lenders who consented (or voted "yes"), only about 10.77 per cent are not disqualified lenders. The percentage of disqualified lenders who consented in proportion to non-disqualified lenders is 6.61 per cent. This would, perforce, mean that GLAS has the authority to represent only 17.38 per cent of the term loan," he said.

Sindhu Bhavan multilevel parking: AMC opts for sale deed to bypass 18% GST

Ahmedabad: The civic body's policy making body has opted to sell 16 offices and 29 shops in the Sindhu Bhavan Multilevel Parking Complex through sale deeds, bypassing the 18% GST applicable on 99-year lease deeds. Tired of too many ads? go ad free now The standing committee approved the proposal on Thursday. An official announcement is expected shortly. Previously, the AMC leased out properties for 99 years, but the GST had prompted a change. In July 2023, AMC attempted to sell 68 shops floor-wise in the same complex, offering 12,868.62 sq m of office-type space on the ground, first and fifth floors at a base price of Rs 197 crore. The auction failed to attract buyers for the first and fifth floors. Only one bidder emerged for the 4,158.33 sq m ground floor, bidding Rs 80 crore, though payment remains pending. AMC has now extended the deadline and will now auction the remaining units via sale deed. Standing committee chairman Devang Dani confirmed, "If the property is sold through a 99-year lease deed, GST is applicable. So now, the shops/offices will be sold via sale deed."
