
HC directs Madurai Corporation to demolish temple constructed unauthorisedly on OSR land
The Madurai Bench of the Madras High Court has directed Madurai Corporation to demolish a temple constructed unauthorisedly on an Open Space Reservation (OSR) land in Madurai.
The court was hearing the petition filed by R. Mayilsamy of Madurai who had sought a direction to the authorities to remove the unauthorised construction under the provisions of Tamil Nadu Town and Country Planning Act. The petitioner complained that a temple was constructed illegally by some residents of an apartment complex on the OSR land in New Vilangudi.
A Division Bench of Justices S.M. Subramaniam and A.D. Maria Clete observed that OSR land cannot be allowed to be encroached upon even by the residents of the apartment complex. The OSR lands are to be maintained in the manner contemplated under the Act and the Rules in force.
The court observed that it is clear that the temple had been constructed without permission and was unauthorised. The OSR land had been utilised for construction of a temple in violation of the Act and the Rules.
The Supreme Court and the High Courts have time and again reiterated that OSR lands cannot be encroached upon by the resident or any other person. It is to be maintained by the authorities in the manner contemplated under the Act and the Rules, the court observed.
Since the temple has been constructed unauthorisedly in the OSR land of the apartment complex and in violation of the Rules, the structure has to be demolished and the OSR land is to be maintained scrupulously in accordance with the provisions of the Act and the Rules.
The court directed Madurai Corporation to demolish the unauthorised construction and restore the land to its original position as per the approved building plan in four weeks. The matter was posted for reporting compliance on July 2.

Spl bill to curb ‘urban naxalism' diluted; draft to be tabled in July
Mumbai: A revised diluted draft of the Maharashtra Special Public Security Bill 2024, which seeks to curb the rising influence of Naxalism in urban areas, is set to be tabled during the monsoon session of the state legislature in July. The bill, which was initially tabled in July 2024, was termed "repressive" and "anti-people" as it gave state govt sweeping powers to crack down on Naxal or leftist activities. In Dec 2024, a 26-member joint select committee, headed by BJP minister Chandrashekar Bawankule and comprising legislators from all political parties, was set up to review and scrutinise the bill. Bawankule said changes were also made with regards to investigations. "Investigation will be done by an assistant commissioner of police in urban areas and a deputy superintendent of police in rural areas, instead of a police sub-inspector as mentioned in the initial draft," he said. "Also, the advisory board, which will give a go-ahead for the probe, will be headed by a retired high court judge and include a district judge and a govt pleader. Kochi: Kerala high court on Friday pulled up the Union govt for its delay in taking a definitive stance on granting loan waivers to those affected by the landslides at Chooralmala and Mundakkai in Wayanad, citing the omission of the relevant section in the Disaster Management Act. The court was hearing a suo motu petition on rehabilitation of the landslide victims. A bench of Justices A K Jayasankaran Nambiar and P M Manoj observed that the Centre cannot take the position that it lacks the power to waive loans for the landslide-affected due to the omission of Section 13 of the Act, which had earlier empowered the National Disaster Management Authority (NDMA) to recommend relief in the repayment of loans. "We want to know categorically, through an affidavit filed by someone responsible in the Union govt, whether they are stating that they do not have the power to direct banks to waive loans. We can understand a reluctance to act, but at least have the courage to say so. The decision must be taken by the Union govt. Let the Union take a decision," it said.
