
New York corrections commissioner defends early release plans for some with nonviolent convictions
Apr. 2—ALBANY — State leaders are defending their decision to offer early release to people held in state prisons, and their approach to rebuilding the state prison security staff ranks after losing more than 2,000 corrections officers over a strike that ended in mid-March.
On Wednesday, Department of Corrections and Community Supervision Commissioner Daniel F. Martuscello III, told reporters in the state Capitol that the decision to offer early release to nonviolent offenders between 15 and 110 days from their judicial release date was a targeted move to try to right-size a prison system running with at least 4,000 fewer COs than it is supposed to have.
Martuscello said he doesn't have a target for the number of incarcerated people to release early, but review of prisoner rolls is ongoing. He said there are about 700 names being considered, and there will be fewer than 700 released.
"We've taken a very narrowly focused approach to this to make sure we're balancing the staffing crisis with preserving public safety by eliminating certain crimes like A1 and A2 offenses, other than non-drug, violent felony offenses, and any sex offenses are not eligible for this whatsoever, so it's really just non-violent felony offenses that are already approved to go out the door within the next 90 days," he said.
Martuscello has clear authority to extend these early releases, under the terms of Corrections Law 92. He could expand the early release terms to include a number of offenses and incarcerated people with up to a year left on their sentences.
The conditions within the state prisons are suboptimal — 34 of the 42 open state prisons still have a contingent of National Guard troops stationed to pick up shifts left open by a lack of staff. Roughly 8,200 National Guard troops have been mobilized for prisons since the strikes, with a peak of 7,000 troops deployed at one time. Currently, more than 2,400 National Guard troops are stationed in state prisons, and 3,400 are deployed in total for all purposes.
The National Guard troops are being transitioned to a "voluntary mission" wherein individual troops can request to be spun down from their deployment, but there is an expectation that there will be at least some contingent of National Guard troops in the prisons for the next few months at least. The state has also authorized extra pay for those who continue to work in the prisons.
There are about 10,000 security staff working in the state prisons as of today, down from the nearly 14,000 that were at work as recently as February. The state prisons need about 16,000 officers to run the facilities safely, the department has said.
Martuscello didn't have a timeline for when the National Guard will be pulled from the state prisons. That is ultimately up to the governor, and until the prisons have hired enough security staff without asking COs to work 24 hour shifts, they will remain.
There is also a plan to close up to five state prisons this year, to consolidate the incarcerated population and also consolidate security staff headcounts. Martuscello said that decision came after the strike began and it became clear the state would be losing more COs this year.
The commissioner said he has not weighed sending prisoners to out-of-state prisons to right-size the population with the security staff available, but has moved people between state facilities for that purpose.
And the state prisons are still not accepting new inmates from county jails. It has been more than a month since someone held at a county jail has been sent to a state prison, and Martuscello kept the door open to extending that moratorium for much longer.
"We recently just extended the moratorium to April 21, so we will be doing that," he said. "We'll take a look at that as we approach that date."
REPUBLICAN REACTION
The state Republican conference is overwhelmingly critical of Democratic Gov. Kathleen C. Hohcul and DOCCS for the decisions they've made in the past few weeks and months. On Wednesday, a handful of upstate Republican Assembly members who represent prison communities or sit on the Assembly Corrections Committee hosted a press conference where they denounced the early release order.
"The corrections department seems to be focused on the problems, not the solutions," said Assemblyman Scott A. Gray, R-Watertown.
He said the prisons have undergone a rapid decline, and worker safety has been rapidly degraded with apparently little action from the state.
"We work hard to make sure all our employees have workplace safety, we work hard to make sure that they are safe, troopers at work with the Move Over Law, we make sure that our DOT people are safe with work-zone safety measures, but what happens when our corrections officers ask for workplace safety? We tell them 'no.'" he said.
Gray and his GOP colleagues said there are other ways to solve the staffing issues without releasing people early from the prisons . They asked the governor to reconsider the ban on rehiring any of the 2,000 COs fired after the strike ended in mid-March, and especially to reconsider the firm rules applied to who was fired.
When the strike ended, COs were given a deadline of 6:45 a.m. on March 10 to return to work or start the termination process. Some officers returned to work on Monday but after the morning deadline, and others were unable to because they were taking pre-scheduled time off. Those fired were fired whether or not they were on approved time off on the March 10 deadline, but Republicans said they think Hochul and DOCCS should weaken the terms of that firing and allow at least some of the fired COs back to work.
"The solutions are right in front of us, and it's inept that we cannot arrive at some meaningful solution to these problems," Gray said.
The Republicans were largely critical of a recent package of legislative language that Hochul has started to push regarding prisons.
Sources with knowledge of ongoing negotiations between Hochul and the legislature's leaders have confirmed that the governor is now seeking a new proposal to boost CO headcounts, reduce workloads and increase the number of people released from prison. According to those sources, Hochul is seeking a legislative change to allow people as young as 18 to be hired as COs, expand virtual court hearings to limit inmate movements and expand good behavior time credits to get well-behaved inmates out of prison faster.
Sen. Mark C. Walczyk, R-Watertown, said there are a number of reasons he is opposed to that push. Firstly, this proposal is coming after the state budget is already officially late, and is being pushed with none of the usual review, hearings or public input that budgets and state laws are supposed to get.
"We have public hearings on the governor's presentation of the budget, the Senate and Assembly answer the governor's budget with their own budgets, there's public dialogue about the proposals in the budget," he said. "You're talking about things that are added in, possibly late after all the process, after the budget has been late, not negotiated in public, not seeking feedback from the public or all the interested parties here. We've seen every single time they do this, it has disastrous impacts."
Walczyk said he is also opposed to the idea of 18-, 19- and 20-year-old people working in state prisons.
"There's good reason corrections officers have to be 21, it takes a certain level of maturity and physical stature to be a corrections officer," he said.
He said he hasn't yet had a chance to consult the state CO union, the New York State Correctional Officers and Police Benevolent Association, or other stakeholders on the issue, but he knows that the union and other prison safety advocates have not previously asked for a lower hiring age for COs.
"I have a lot of concerns about sending teenagers in with convicted felons," he said.
Walczyk said he is open to expanded virtual court hearings, which advocates including NYSCOPBA union members have asked for in the past. The idea is that virtual court hearings would reduce extraordinary movements of incarcerated people and would allow more COs to focus on prison-centric tasks rather than security for transportation.
But the expanded good behavior time rewards aren't a good idea in Walczyk's book. He said it's another attempt to reduce criminal penalties in New York.
"We've seen in the past, criminals who are released early, who are out on parole and supposed to be supervised, who violate their parole, they passed Less is More, which means they can violate their parole and not go back to prison," he said. "They continue to re-criminalize and re-victimize our communities."

As news broadcasts and social media have proliferated with scenes of violence and mayhem on the streets of southern California, Newsom alleged in an interview with MSNBC on Sunday evening that it is the U.S. President who 'created the conditions you see on your TV tonight.' Newsom condemned the violence, calling it 'unacceptable' and 'wrong.' He added that there were 'a lot of great people out there, doing the right thing,' but that 'insurgent groups' and 'anarchists' were infiltrating the demonstrations 'to create real problems.' 'They're just playing right into Donald Trump's hand. And they need to be called out and they need to be arrested,' Newsom said of the bad actors. 'They're doing more than damage to buildings and to property. They're potentially damaging the very foundation of our republic. Democracy is in the balance.' When asked if he supports the peaceful protesters, Newsom responded emphatically: 'Of course I support them. Protest is the foundation of this democracy. It's what makes this country great. And that needs to persist. And right now people need to come out. But we need to be mindful of the toxicity of this moment, and then we have to deal with these elements that are coming in that are intentionally trying to take advantage of this in a way that only aids and abets Donald Trump.' Newsom added that his priority is to keep peaceful protesters as well as 'those that are enforcing the laws in a respectful and responsible way' safe. Newsom, whose second and final term as Governor ends in 2027 and who is speculated to be a 2028 Democratic presidential contender, repeatedly focused his blame for the escalation of the situation in California on Trump: 'He's exacerbated the conditions. He's lit the proverbial match. He's putting fuel on this fire,' Newsom said, calling the mobilization of the National Guard 'an illegal act, an immoral act, an unconstitutional act.' 'Donald Trump needs to pull back. He needs to stand down. Donald Trump is inflaming these conditions. This is Donald Trump's problem right now, and if he can't solve it, we will.' Here's what to know. Mass protests and demonstrations have taken place across Los Angeles county since Friday in response to Immigration and Customs Enforcement (ICE) raids targeting undocumented residents and laborers. While local officials, including Los Angeles Mayor Karen Bass and the city council, sided with peaceful protesters in opposition to the immigration enforcement actions, demonstrations grew increasingly violent, as clashes intensified between some demonstrators and law enforcement officials. Rocks and molotov cocktails have been thrown; police vehicles and self-driving Waymo cars have been vandalized; and authorities have used tear gas, 'flash bang' grenades, and rubber bullets to attempt crowd control, according to reports. 'Everyone has the right to peacefully protest, but let me be clear: violence and destruction are unacceptable, and those responsible will be held accountable,' Bass said in a post on X on Saturday. In a White House memorandum on Saturday, Trump said the anti-ICE protests 'constitute a form of rebellion' against the U.S. and ordered Defense Secretary Pete Hegseth to deploy 2,000 National Guard personnel in response. In a post on X, Hegseth said the National Guard would be mobilized 'IMMEDIATELY.' Hegseth added that 'if violence continues, active duty Marines at Camp Pendleton will also be mobilized—they are on high alert.' To mobilize the National Guard, Trump invoked Title 10, Section 12406 of the U.S. Code, which allows for the federalization of the National Guard in cases of an invasion or a rebellion, or if the President is unable to execute the country's laws with 'regular forces.' Section 12406, however, also states that 'Orders for these purposes shall be issued through the governors of the States.' Newsom confirmed that he did not request the deployment of the National Guard, making it the first time since 1965 that the National Guard has been activated to a state without a governor's request. In an open letter to Hegseth, Newsom's office called the mobilization 'a serious breach of state sovereignty' and requested that the Pentagon chief 'immediately rescind' the order and 'return the National Guard to its rightful control by the State of California, to be deployed as appropriate when necessary.' The Democratic Governors Association backed Newsom in a statement, saying: 'It's important we respect the executive authority of our country's governors to manage their National Guards.' Moreover, an 1878 law, the Posse Comitatus Act, limits federal military personnel from being used for civilian law enforcement within the U.S., which means in Los Angeles the National Guard forces mobilized by Trump can protect federal agents, such as ICE officials, and federal properties, such as detention centers, but they cannot arrest protesters. The Posse Comitatus Act 'prohibits troops from being used domestically unless the Insurrection Act is invoked,' constitutional scholar and dean of UC Berkeley Law School Erwin Chemerinsky tells TIME, 'and the President has not done that.' According to Reuters, Trump still could invoke the Insurrection Act, but doing so would enter 'riskier legal territory.' The last time the Insurrection Act was invoked was when President George H.W. Bush mobilized the National Guard to quell riots in Los Angeles following the acquittal of the police officers involved in the beating of Rodney King. But a key difference between 1992 and now is that then-Governor of California Pete Wilson had requested federal assistance. Calling in troops to suppress protests has also raised First Amendment concerns. The American Civil Liberties Union said in a statement on Saturday that it also plans to file a lawsuit against the Trump Administration, calling the mobilization of the National Guard an 'abuse of power.' Earlier on Sunday, Trump's 'border czar' Tom Homan, who has previously threatened arrest for anyone who obstructs immigration enforcement, told MSNBC that he would not rule that out even for officials like Newsom and Bass. 'I'll say it about anybody,' Homan said. 'It's a felony to impede law enforcement doing their job.' 'Governor Newsom is an embarrassment to the state,' Homan added. 'Criminal aliens are walking the streets of this state every day because of him and his policies.' In his interview hours later with MSNBC, Newsom responded, saying: 'That kind of bloviating is exhausting.' Newsom challenged Homan to arrest him but to 'lay your hands off' law-abiding, tax-paying undocumented residents. 'He's a tough guy. Why doesn't he do that? He knows where to find me,' he said. 'Come after me. Arrest me. Let's just get it over with, tough guy. I don't give a damn. But I care about my community. I care about this community.' Newsom criticized the Trump Administration for targeting non-criminal undocumented residents for immigration enforcement and pushed back on the accusation that California does not cooperate with the federal government. 'I have no problem with going after criminals. We coordinate and collaborate with ICE,' Newsom said, pointing to the state handing over more than 10,000 inmates to ICE since he took office in 2019. 'When these guys say we don't go after criminals, again, they're lying, and they're knowingly lying.' When asked if Trump could be putting the spotlight on Los Angeles to take attention away from his recent fallout with Elon Musk, Newsom said 'of course,' also citing Trump's struggles to pass the massive tax and spending package known as the One Big Beautiful Bill Act in Congress as well as ongoing challenges related to Trump's global trade war. 'He's the master of distraction. He's the commander of chaos. That's what Donald Trump does,' said Newsom. Newsom claimed that Trump used 'the guise of immigration' to create a 'manufactured crisis' in order to challenge the Posse Comitatus Act. 'This is about authoritarian tendencies. This is about command and control. This is about power. This is about ego,' said Newsom. 'This is a consistent pattern of practice of recklessness. This guy has abandoned the great principles of this great democracy. He's threatening to go after judges he disagrees with, cut off funding to institutions of higher learning, he's on a cultural binge, he's rewriting history, censoring historical facts. If he did, Noem warned, Biden would be mounting a 'direct attack on states' rights,' and sparking a 'war' between Washington and Republican-led state governments, she said in a Feb. 6, 2024 interview with Fox News host Sean Hannity. On June 8, Noem − now President Donald Trump's Homeland Security secretary − cheered Trump for doing the same thing to the Democratic governor of the state of California. Over the weekend, Trump deployed riot gear-clad National Guard troops to Los Angeles to shut down anti-immigration protests over the objections of California Gov. Gavin Newsom. Trump's memo June 7 invoked a section of federal code authorizing the president to call the guard into service to 'repel an invasion of the United States by a foreign nation' or to 'suppress a rebellion against the authority of the Government of the United States' or to 'execute the laws of the United States when the President is unable to do so with regular forces.' Newsom has vocally opposed Trump's intervention, and on Sunday formally asked the President to rescind the 'unlawful' deployment of the National Guard in Los Angeles. At the time, Democratic lawmakers and immigration-rights activists were lobbying heavily for Biden to federalize the National Guard in Texas to defuse a brewing crisis there over the state's aggressive crackdown on illegal immigration. Activists said the wire was endangering the lives of those trying to cross into the United States, especially via rivers at the border where the wire was installed. The Supreme Court had ruled that the federal government could cut through the razor wire. But the Republican governor in Texas, Greg Abbott, was refusing to take it down. The dispute led to a prolonged standoff between Abbott and the Biden administration, with the Texas National Guard at times blocking Border Patrol agents from accessing certain areas of the border. To resolve the standoff, Democrats and others demanded that Biden federalize National Guard soldiers in Texas and order them to stand down and get out of the way of federal immigration agents. In response, Noem not only sent National Guard soldiers from South Dakota to the border to support Abbott's efforts. She also went there personally, she said at the time, to stand with him in case Biden decided to intervene against Abbott's wishes. A 'direct attack on states' rights' that would spark a 'war' For his part, Biden never said he was even considering the move, which would have been unprecedented in recent history. The last time a President deployed the National Guard over the home state governor's objections was during the Civil Rights protests of the 1950s and 1960s, when Southern governors refused to comply with orders to desegregate schools and other public institutions. 'That would be a boneheaded move on his part, total disaster,' Abbott told conservative host Tucker Carlson on his show 'Uncensored." In her interview with Hannity, the Fox News host told Noem that she and other Republican governors who "stood by Gov. Abbott's side' and opposed federal intervention likely caused Biden to back down from doing something that likely would "have precipitated a real, real crisis down there.' That's why she personally went down to Texas, Noem said, because she recognized 'the real threat that was to states' rights.' 'We will defend our Constitution. We will defend our rights because the last several years, we've seen Democrats take away our freedom of religion, our freedom of assembly, our freedom of speech,' Noem told Hannity. 'We can't let them take away our state's rights too, especially our rights protect ourselves.'
