4,000 Applications for Outdoor Dining. 39 Licenses Issued.

During the worst of the coronavirus pandemic, desperate New York City restaurants found a financial lifeline by expanding seating outdoors. Dining sheds began popping up without much city oversight, somewhat haphazardly reshaping the city's streets.
At outdoor dining's peak, there were nearly 13,000 sheds outside restaurants — some costly and elaborate, others dingy huts that served as many rats as people. Most sat on the roadway in spaces where cars used to park.
While the al fresco dining options were popular with many New Yorkers, some complained about sheds becoming eyesores and oversized trash bins, and some politicians expressed concern about the sheds' impact on street parking.
Last year, after wrangling involving the mayor, the City Council and the restaurant industry, the city ordered all the sheds to be taken down as it formalized a permanent outdoor dining program to begin this spring.
Some 4,000 applications have been submitted for roadway and sidewalk licenses. But as Grub Street first reported, many angry restaurant owners say they are stuck in a bureaucratic maze ahead of the busiest dining season. With the start just weeks away on April 1, only 39 licenses have been approved.
'Without roadway dining, I don't want to continue in this business,' said Philip Guardione, the chef and owner of Piccola Cucina Osteria Siciliana. 'You need outside dining, or you kill restaurants.'
Faced with such an extensive backlog, the Department of Transportation, which initially reviews and approves the applications, announced on Thursday that businesses could open their outdoor structures — on either the sidewalk or roadway — on April 1 without a license. As long as the restaurant had submitted a completed application and was following the program's rules, it would not be subject to fines.
The backlog has angered the New York City comptroller, Brad Lander, whose office issues the licenses after the Department of Transportation reviews them. Mr. Lander said the program was important for the city's finances, providing nearly $10 million in annual sales-tax revenue during the pandemic.
'Spring is almost here, and restaurants owners are running out of time to design new outdoor seating and obtain liquor licenses,' Mr. Lander, who is running for mayor, said in a statement. The Department of Transportation, he added, needed to speed up its work and 'start sending their permits to this office.'
On Thursday, the Transportation Department said that staff members had finished reviewing more than a thousand applications for outdoor dining structures on roadways and expected to approve hundreds of them before April 1.
'We are proud that outdoor dining is now a permanent part of our city's streetscape and have reviewed every roadway application we have received,' said Vincent Barone, the department spokesman. 'As required by the law passed by the City Council, reviews are underway by community boards, council members and the comptroller. The comptroller should take up his concerns with the City Council.'
Even before the reprieve was announced on Thursday, some restaurants awaiting approval had planned to still open on April 1 despite the risk of fines. They are hiring additional staff and have already paid for the sheds to be designed and fabricated, which can cost tens of thousands of dollars.
Many restaurant owners were reluctant to speak openly about their frustrations with the city's slow approval process, saying they did not want to jeopardize their applications.
They said that as the costs to operate restaurants soars — from personnel to food to rent — al fresco dining had become essential for survival, allowing them to expand their footprint, serve more customers and bring in more money.
Mr. Guardione said his payroll costs have jumped 50 percent since before the pandemic, while some produce has increased 40 percent. His 700-square-foot restaurant in SoHo must generate $7,000 to $8,000 in revenue every night to survive, he said.
Mathias Van Leyden, who owns the French restaurant Loulou in Manhattan's Chelsea neighborhood, said he expected the city would sign off on his outdoor dining space before April 1.
'We spent a lot of money to do it,' said Mr. Van Leyden, whose restaurant had a shed made of reclaimed wood and colorful bouquets. 'And it's beautiful for the community.'
Under the bill the City Council passed in August 2023 to make outdoor dining permanent, sheds can only stay up from spring to early winter and must share basic design guidelines, including limitations on size, proximity to the street and the materials allowed.
Restaurants were required to submit their applications for the new outdoor dining program in August to the city's Department of Transportation, which is overseeing outdoor dining on both sidewalks and roadways. About 3,000 restaurants applied.
While the department had said that final approval would then take about five or six months, it took the department several months just to read through them before the formal review could begin, several people involved in the process said. The department has hired more employees to handle all of them and is now nearly fully staffed.
Hundreds of applications have been sent back to restaurants because they were incomplete. The most common issue has been restaurants not providing full details on their site plans, which must include a drawing of the outdoor dining setup and identify its distance to nearby objects like mailboxes and fire hydrants.
But sign-off from the Department of Transportation is just one step in the lengthy process before a restaurant can move tables outdoors. Restaurant owners also have to present their proposals to local community boards and advisory groups made up of activists and civic leaders.
While those groups do not have an up-down vote on the plans, their recommendations are submitted to the Transportation Department for consideration before approval. Some boards have sought large-scale changes, such as reducing the dimensions of sheds, restaurant owners said.
Even after the comptroller office issues a license, restaurants then need to seek approval from the State Liquor Authority to serve alcohol outside.
So far, just four restaurants with outdoor-dining licenses have been authorized to serve alcohol outside, the authority said.
Steven Abramowitz, who co-owns three well-known Manhattan restaurants, Cafe Cluny, Cafe Luxembourg and the Odeon, said he had been trying to get answers from the city on the status of their sidewalk and roadway applications. He questioned whether it was worth opening on April 1, as the Department of Transportation will now allow, if the State Liquor Authority will not issue alcohol permits without licenses.
'They presented it as a very simple process but it absolutely is not,' Mr. Abramowitz. 'The whole thing is pretty arduous.'

The 30-second ad started running Monday on streaming, digital and social media. The ad from Affordable New York attacking three other candidates in the race serves to benefit the front-runner, Andrew Cuomo, and puts him in the enviable position of getting support from both sides of the bitter lobbying battle between Airbnb and the hotel workers union. The former governor has been endorsed by the Hotel and Gaming Trades Council, and its super PAC plans to boost Cuomo with $1 million in spending on his behalf. Airbnb could spend even more in the mayoral race — a spokesperson for the super PAC said it could spend as much as another $1 million before the June 24 Democratic primary. HTC Political Director Bhav Tibrewal said he's confused by Airbnb's strategy. 'As governor, Andrew Cuomo took action against unregulated short-term rentals and he's promised to continue to stand up for tenants and workers as mayor,' he said in a statement. 'If Airbnb thinks it's a flex to publicly light their money on fire, we're happy to not stand in their way on this one.' Airbnb has been pushing the City Council to exempt one- and two-family homeowners from the city's short-term rental crackdown — an effort fiercely opposed by the influential hotel union. The multibillion dollar industry is all but illegal in the city due to state law that prohibits rentals for fewer than 30 days when a host is not present. The city ramped up enforcement of those state rules in 2022, under a law requiring short-term rental hosts to register with the city, which effectively weeded out illegal listings. Council Member Farah Louis, with support from Speaker Adrienne Adams, introduced a bill last November that sought to make way for Airbnb in one- and two-family homes. The council quietly amended that legislation in February, axing key parts of the bill after discussions with the hotel union — and, Louis said, 'significant legal concerns' by the council. Adams is also running for mayor, and Airbnb is refraining from attacking her. Mamdani, an assemblymember representing western Queens, and Lander, the city comptroller, have opposed the legislation. New polls show a Cuomo-Mamdani face off in a tightening New York mayoral race

NEW YORK — The Democratic primary for New York City mayor is effectively a two-person race between Andrew Cuomo and Zohran Mamdani, two new internal polls show. A survey conducted by Data for Progress on behalf of a super PAC for Mamdani found Cuomo up by just two points, while a poll from the ex-governor's camp showed Cuomo with a 12-point lead. Data for Progress, which conducted its text and web poll of 819 likely Democratic voters between May 30 and June 4, found Cuomo starts the ranked-choice race with a seven-point edge. He wins it in the eighth round by a 51-49 split — within the three-point margin of error. It was conducted on behalf of the super PAC New Yorkers for Lower Costs, as well as the national PAC for the Working Families Party — whose local arm is backing the democratic socialist state lawmaker. The findings indicate Mamdani's message of combating income inequality is resonating with voters who routinely rank housing and inflation as leading concerns, despite his rivals' hits on the 33-year-old lawmaker's inexperience. Cuomo's more recent poll of 600 likely Democratic primary voters, conducted between June 3 and 7 by Expedition Strategies, shows him beating Mamdani by 12 points — 56 to 44 — in the eighth round of voting. While it was being conducted, the candidates faced off in their first televised debate on June 4 and Rep. Alexandria Ocasio-Cortez selected Mamdani as her top choice the following day. Cuomo resigned from office in 2021, following reports from the state attorney general that he sexually harassed female staffers and under counted nursing home deaths during Covid — all of which he denies. His pollster offered a different take on the findings. 'With five days to go until early voting begins in New York City, our latest poll shows Governor Cuomo with a durable lead and significant advantages over the rest of the field when it comes to critical qualities such as the ability to solve the city's problems,' Pete Brodnitz, founder and president of Expedition Strategies, wrote in a poll memo. His team reached likely voters by phone, including landlines, and text-to-web interviews. It has a 3.9 percent margin of error. The polls are solidifying the shape of the race as it enters its final weeks: Early voting begins Saturday, and the primary is June 24. Most voters' minds are made up by now, but the surveys each found some room for movement, with 8 percent of likely voters in Data for Progress' poll claiming to be undecided about the candidates, compared to 9 percent in the Expedition poll. More than one-quarter of likely voters, 28 percent, told Data for Progress they hadn't heard enough about Mamdani to form an opinion. Those who know him like him, giving him a 58-15 percent favorability rating. Cuomo's was even at 48-49, and just 3 percent of voters didn't know enough about the three-term New York governor to form an opinion. These polls reflect the continued trend in this race to replace Mayor Eric Adams, who is running as an independent following the fallout from his federal indictment: Cuomo is leading, Mamdani is gaining and no one else has found a foothold to climb. 'We're confident in our methodology and these results — we have a strong track record here, and believe this snapshot reflects the state of the race as it stood in early June,' said Ryan O'Donnell, deputy executive director of Data for Progress. The firm was accurate in its 2021 mayoral poll just before primary day. The Cuomo campaign survey reached voters through phone calls, including landlines, while the Mamdani poll was on the web only. The samples — the pollsters' expectation of the demographics of voters who will show up to vote — varied only slightly. The Cuomo poll's respondents were 41 percent white, and 30 percent under the age 45, for example, while the Mamdani poll's sample was 42 percent white and 33 percent under 45. Cuomo polls best with Black voters and older voters, while Mamdani leads the field with white voters and younger voters. The most notable difference was how much support each of the leading two candidates picked up when ranked-choice votes were distributed. In Cuomo's poll, the ex-governor maintains his 12-point lead over Mamdani the whole time — suggesting voters who ranked other candidates first are fairly evenly split between the leading contenders. The Mamdani supporters' poll, meanwhile, demonstrates Mamdani picking up 16 percentage points from the first to the eighth round, while Cuomo gains 11. That suggests the anti-Cuomo DREAM strategy — an acronym for Don't Rank Evil Andrew for Mayor, promoted by the Working Families Party — is reaching more voters, who are choosing to leave Cuomo off their ballots entirely. Meanwhile, Cuomo and the main super PAC backing him have started going after Mamdani, who told NBC New York on Monday that indicates his rise in the polls. 'His decision to start focusing on me in the final weeks of this race shows the fact that he is scared,' Mamdani said. 'Scared of the fact where he once had a 40-point lead, it is now in single digits.'

Lake Forest residents who prefer to watch city meetings on cable television will continue to have that option as the City Council did not approve a staff recommendation to suspend the channel. Council members received an overview of the state of the local cable TV channel at their June 2 meeting with staff suggesting it should at least be temporarily discontinued. However, a split emerged among the aldermen, and no vote was taken. The cable channel airs over channel 17 for local Comcast subscribers, and the city receives it at no cost through its franchise agreement with the cable provider, Assistant to the City Manager Keri Kaup said. The city airs City Council, Finance Committee, and Plan Commission meetings on the channel that has been available to residents since the late 1980s, according to a city spokeswoman. The rest of the time, informational slides are supposed to be aired. City staff cited a lack of use in the channel, plus technical reasons for why the city should move away from the channel. Regarding viewership, Kaup said Comcast did not keep statistics on how many residents watched the meetings, but she pointed to a 2023 community-wide survey where only one percent of respondents, translating to 14 people, used the channel to get information. She contrasted that with 54 % of residents using the city's website and 59% reading the electronic newsletter, which has approximately 12,000 subscribers. She added the city did not receive any complaints from residents after the city did not broadcast the May 19 City Council meeting. Kaup added the city is responsible for the costs of maintaining and upgrading the equipment associated with the channel and mentioned a December 2024 upgrade of the audiovisual system at the City Hall's Council Chambers. Still, technical issues remain in place. 'What it didn't do was improve the quality that goes out on the cable broadcast,' Kaup said. That is because we don't have control of the quality that goes out on the broadcast. That is a Comcast issue.' She added that some connection issues have now emerged, and the city would have to replace some equipment to keep the channel going. That was a reason why the city has not aired the informational slides recently. The equipment replacement costs would be about $3,360, according to city documents. Kaup added the city staff would assist residents in demonstrating how to access the livestream of meetings through a computer, either from the city's website or its YouTube channel. 'We believe that making this change would enable us to direct our resources to communication mediums that are most utilized by our residents and maintain transparency while we are eliminating that redundancy,' she said. However, JoAnn Desmond, a member of the Lake Forest-Lake Bluff Senior Citizens Foundation Board, advocated for the city to keep the channel in place. 'I am aware of many seniors whose only access to watch city meetings is through cable TV,' she said. Desmond added that some older residents are not comfortable using computers. 'I know there are many seniors unable to enjoy active lives and do not have adequate technology skills,' she said. 'Many of these seniors enjoy the company of cable TV and would feel further disenfranchised from our city government if they did not have access to these meetings in a way they are most comfortable. This is a small price to pay for our seniors.' City Council members differed among those wanted to keep the channel in place and those who agreed with the staff recommendation. Alderwoman Nancy Novit, 1st, labeled the channel as an important tool, and she watches it personally. 'I think it is easier for people who know how to turn on Channel 17, to turn on Channel 17 than to go to the website and look for the stream and take extra steps that are not intuitive steps,' Novit said. 'Especially for the seniors who know the way they know and don't want to have to go through the machinations of learning a new way to do it.' Alderman John Powers, 2nd, also preferred to keep the channel in place. 'If there are a handful of people that still use this and want to stay connected, I think it is worth the investment,' he said. Seeing it differently, Alderman Edward 'Ted' Notz, 1st, supported a discontinuation, stating he liked the staff proposal to train people to use the livestream. 'I think that is a great solution to bridge that gap,' Notz said. That sentiment was echoed by Alderman Richard Walther, 4th. 'This will allow us to train our community to use the livestream solution,' he said. With the differing viewpoints, City Manager Jason Wicha indicated the cable TV broadcasts would continue. 'This is not a strong staff recommendation so if there doesn't seem to be a strong consensus on the council to remove it, it is a fairly immaterial expense,' he said. 'This will effectively keep the lights on.'
