No relief on ban on Bahraich Dargah fair, next hearing on May 19

Lucknow, May 16 (UNI) The Lucknow bench of Allahabad High Court did not grant any relief to the petitioners for the time being on the matter of ban on the Jeth fair of Dargah Sharif in Bahraich on Friday.
The court has fixed the next hearing of the case for May 19. The petitioners said that Jeth Fair is starting from May 18, so the case should be heard at the earliest. Given this, the court allowed the petitioners to make an application to the Chief Justice for an urgent hearing of the case.
The petition filed by six people, including the chairman of the Dargah Sharif Management Committee of Bahraich, was heard before the Division bench of Justice A R Masoodi and Justice Ajay Kumar Srivastava - I.
Chief Standing Counsel Shailendra Kumar Singh opposed the petition on behalf of the state government, whereas, on behalf of the petitioners, their counsel Dr LP Mishra argued for permission to organise the fair.
The petition challenged the order of District Magistrate Bahraich issued on April 26, in which permission was not granted this time for the Jeth fair held every year near the Dargah of Syed Salar Masood Ghazi. The petitioner has requested the DM to direct him to grant permission for the fair, calling it against the intention of the law.
On the other hand, on May 8, the government counsel opposed the petition, calling the DM's order appropriate. The court ordered the application for interim relief in the next hearing and gave time to the parties, including the government, to submit their reply on the points raised in the petition.
The court said that it would not be appropriate to grant any interim relief until the reply of the opposite parties is sought in the case. The state government has filed a reply in the case, to which the petitioners have also submitted a reply.

Sachin Sirohi and Sanjay Samarval were booked by Meerut police under sections 191(2) [rioting], 196 [promoting enmity between different groups and doing acts prejudicial to maintenance of harmony], 197 [imputations, assertions prejudicial to national integration] of Bhartiya Nyaya Sanhita (BNS). As per case of the prosecution, the accused, along with their associates, protested outside a mosque, raised anti-religious slogans and recited Hanuman Chalisa, promoting enmity and hatred on the grounds of religion. They have also been accused of threatening to demolish the mosque, due to which, chaos prevailed in the area tension arose among the people going towards the railway station. The counsel for the accused submitted that allegations levelled against the applicants were false and claimed they had been implicated in the matter for political reasons. It was also argued that contents of FIR and statements of witnesses gave no credible evidence against the applicants, hence they should be granted bail. State counsel opposed their bail plea, arguing that in order to disturb harmony, applicants recited 'Hanuman Chalisa' at a Muslim religious place, thereby inciting enmity on basis of religion. Justice Raj Beer Singh, however, found it a fit case to grant bail, observing that seriousness of the allegation or availability of material in support thereof were not the only considerations for declining bail. "It is well settled that at pre-conviction stage, there is presumption of innocence. The object of keeping a person in custody is to ensure his availability to face trial and to receive the sentence that may be passed. The detention is not supposed to be punitive or preventive," the court remarked as it granted bail in order dated Jun 3. Covid-19 delayed Census 2021; southern states' concerns will be take care of: MHA

New Delhi, June 5 (UNI) Attributing the delay in conducting Census 2021 to the COVID-19 outbreak, the Ministry of Home Affairs on Thursday said the concerns of the southern states regarding the delimitation process will be taken care of with all concerned at an appropriate time. The Ministry said on X that Home Minister Amit Shah had repeatedly clarified that concerns of southern states regarding the delimitation exercise will be taken care of and discussed with all concerned at an appropriate time. "Census 2021 was to be conducted and all preparations for the Census were completed. However, due to outbreak of COVID-19 pandemic across the country, the Census work was postponed. The aftershock of Covid-19 continued for quite some time," the MHA said. The Ministry said that a key challenge was the involvement of approximately 30 lakh enumerators, most of whom are primary school teachers. Conducting the Census immediately after Covid could have severely disrupted primary education. "COVID disrupted all sectors, including education. Around 30 lakh enumerators are needed for the Census. Enumerators, who are primary school teachers, are key persons for conducting Census. Conducting the Census after Covid could have disrupted primary education immensely," the MHA post said. "Countries which conducted Census immediately after COVID-19 faced issues with the quality and coverage of Census data. The Government has decided to commence the process of census forthwith, which will be completed on March 1, 2027, the reference date for Census," it said. The Ministry reiterated that budgetary constraints have never been a hurdle for conducting the Census, as adequate funding is consistently ensured by the government. The MHA said, "Budget has never been a constraint for Census as fund is always ensured by the Govt. Home Minister Amit Shah has clarified on many occasions that in the delimitation exercise, concerns of southern states will be taken care of and discussed with all concerned at an appropriate time". Notably, the government on Wednesday announced that Population Census-2027 will be conducted in two phases along with enumeration of castes and the reference date will be March 1, 2027. UNI RBE SSP

Hyderabad, June 5 (UNI) Telangana Chief Minister A Revanth Reddy will release the Autobiography ' Prajala Kathe Naa Atmakatha' ( the story of the people, Telangana is my Autobiography) authored by Haryana Governor Bandaru Dattatreya at a special ceremony to be held at Shilpakala Vedika here on Sunday. The CM will hand over the first copy to the former President Ramnath Kovind and Telangana Governor Jishnu Dev Varma, according to Alai Balai Foundation Chairperson Bandaru Vijaya Laxmi.
