Canada needs a wartime competition policy

The changes to Canada's competition laws over the past 2½ years marked a notable consensus across the political spectrum. Politicians of all stripes agreed that Canada's competition laws were out of step with those of global counterparts and contained gaps when it came to wage fixing, drip pricing and anti-competitive agreements.
Parliament made it easier to challenge mergers by removing the 'efficiencies defence' that allowed those for which the cost savings exceeded the anticipated negative effects. It put the onus on the parties to show why their merger would not prevent or lessen competition substantially when their combined market share would exceed 30 per cent.
The Competition Bureau recently released its annual plan called 'Strengthening competition in a changing economy.' While the plan notably focuses on using the new enhanced enforcement powers given to the bureau by Parliament to stop anti-competitive activity, it does not recognize that Canada needs to be on a war footing when it comes to regulatory enforcement.
New Industry Minister Mélanie Joly said it herself: We need a 'wartime philosophy,' and this philosophy should be reflected in the bureau's enforcement plans.
As a first step, the bureau should revise its approach to 'Made in Canada' claims so Canadian consumers can more readily support domestic companies when they shop. The current guidelines are too onerous for businesses and limit the ability of manufacturers to make 'Made in Canada' claims when they import raw materials that we don't produce locally. Companies that manufacture products here should be able to say their products are 'Made in Canada' without fear of prosecution.

Prioritizing investigations of anti-competitive conduct that makes life less affordable for Canadians is an important objective. What's missing from the bureau's plan is a commitment to direct enforcement activity against firms whose conduct is undermining industry and diverting profits outside of the country. Several of Canada's key industries are being fundamentally disrupted by foreign competition, including news and media. The bureau has a role to play in helping to protect these important industries, including meeting with key industry leaders and prioritizing enforcement.
Much ink has been spilled over how the efficiencies defence has saved otherwise anti-competitive mergers. While the defence was invoked only in rare cases, Canada may have overstepped by removing it entirely. There should be a relief valve to allow some mergers that enhance productivity but might temporarily result in higher prices.
Competition Bureau investigating proposed merger of companies that make medical isotopes
There is a growing consensus that Canada needs to build its domestic industrial capacity in the face of global threats. The government imposes tariffs to help do this. Until our international trade situation calms down, the bureau should consider a relief valve in the application of the merger law in exceptional cases where mergers are needed for productivity enhancement to better align Canada's trade and competition policy.
Finally, there is an important role for the bureau to play in advocating for policies that prioritize the construction of infrastructure in other areas of government. Again, this is about balancing short-term affordability and long-term resiliency.
In the telecom sector, for example, the bureau should be pushing for rules that limit incumbents from reselling each other's networks. Canadian investment in network infrastructure supports jobs and investment, enhances productivity and promotes resiliency.
The steps taken recently to modernize Canada's competition laws were laudable. Now we need to see those tools deployed to ensure that Canada succeeds in the face of increasing threats to our economy.

Canadian Wildfire Smoke Shrouds Parts of American Midwest, Reaches Europe
Smoke from Canadian wildfires-that have forced more than 27,000 Canadians in three provinces to flee their homes-carried another day of poor air quality south of the border to the Midwest, where conditions in parts of Minnesota, Wisconsin and Michigan were rated "very unhealthy" on Tuesday. The smoke has even reached Europe, reports The Associated Press. The smell of smoke hung over the Minneapolis-St. Paul area on Tuesday morning despite rain that obscured the full measure of the dirty air. Minnesota's pollution control agency issued an alert for almost the entire state into Wednesday, but the Twin Cities area got the worst of it in the Midwest on Tuesday. The Iowa Department of Natural Resources recommended that people avoid long or intense activities and to take extra breaks while doing strenuous actions outdoors. Smoky conditions that have reached the U.S. periodically in recent weeks extended as far east Tuesday as Michigan, west into the Dakotas and Nebraska, and as far to the southeast as Georgia. The U.S. Environmental Protection Agency's AirNow map showed a swath of red for "unhealthy" conditions across the eastern half Minnesota into western Wisconsin and northern Iowa. The map also showed purple for "very unhealthy" across much of the Minneapolis-St. Paul metropolitan area, where the Air Quality Index numbers of 250 and were common, though conditions started to improve slightly by late morning. The Air Quality Index-AQI-measures how clean or polluted the air is, focusing on health effects that might be experienced within a few hours or days after breathing polluted air. It is based on ground-level ozone, particle pollution, carbon monoxide, sulfur dioxide, and nitrogen dioxide. Particulates are the main issue from the fires. The index ranges from green, where the air quality is satisfactory, to maroon, which is considered hazardous. That level comes with health warnings of emergency conditions, according to AirNow. View our latest digests There were a few scattered locations in the Twin Cities area that temporarily hit maroon on Tuesday morning. But by midday Tuesday, most of the remaining maroon spots in the region were on the Upper Peninsula of Michigan. Hennepin Healthcare, the main emergency hospital in Minneapolis, has seen a slight increase in visits by patients with respiratory symptoms aggravated by the dirty air. Dr. Rachel Strykowski, a pulmonologist, said there is usually a bit of a delay before patients come in, which is unfortunate because the sooner those patients contact their doctors, the better the outcome. Typical symptoms, she said, include "increase in shortness of breath, wheezing, maybe coughing a bit more, and flares of their underlying disease, and that's usually COPD and asthma." The fine particulate matter from the wildfire smoke triggers more inflammation in patients' airways, aggravating their underlying medical conditions, Strykowski said. This is usually a time those patients can go outside and enjoy the summer weather because there are fewer triggers, so the current ones forcing them to stay inside can feel "quite isolating." People can protect themselves by staying indoors or by wearing N95 masks, Strykowski said. The cloth masks many people used during the COVID-19 pandemic don't provide enough filtration. Canada is having another bad wildfire season, and more than 27,000 people in three provinces have been forced to evacuate. Most of the smoke reaching the American Midwest has been coming from fires northwest of the provincial capital of Winnipeg in Manitoba. The Canadian Press reported that Winnipeg hotels were opening up Monday to evacuees. More than 17,000 Manitoba residents have been displaced since last week, including 5,000 residents of the community of Flin Flon, nearly 645 kilometers northwest of Winnipeg. In neighboring Saskatchewan, 2,500 residents of the town of La Ronge were ordered to flee Monday, on top of more than 8,000 in the province who had been evacuated earlier. In Saskatoon, where the premiers of Canada's provinces and the country's prime minister met Monday, Saskatchewan Premier Scott Moe said all of Canada has come together to help the Prairie provinces, The Canadian Press reported. Two people were killed by a wildfire in mid-May in Lac du Bonnet, northeast of Winnipeg. Canada's worst-ever wildfire season was in 2023. It choked much of North America with dangerous smoke for months. Canada's wildfires are so large and intense that the smoke is even reaching Europe, where it is causing hazy skies but isn't expected to affect surface-air quality, according the European climate service Copernicus. The first high-altitude plume reached Greece and the eastern Mediterranean just over two weeks ago, with a much larger plume crossing the Atlantic within the past week and more expected in coming days, according to Copernicus. "That's really an indicator of how intense these fires are, that they can deliver smoke," high enough that they can be carried so far on jet streams, said Mark Parrington, senior scientist at the service. The fires also are putting out significant levels of carbon pollution-an estimated 56 megatonnes through Monday, second only to 2023, according to Copernicus. Pornhub threatens to pull out of France
The adult content platform has accused Paris of compromising user privacy Pornhub, one of the world's largest adult content platforms, has threatened to cease operations in France in protest against stringent age verification regulations, which it claims could leave users' private data vulnerable to bad actors, hacks, and leaks. The platform's parent company, Aylo - which also operates popular adult sites like RedTube and YouPorn - has expressed concerns over the feasibility of complying with the French requirements by the June 7 deadline. Starting Wednesday, French users will be greeted by a message denouncing the age verification demands, aiming to explain directly "how dangerous, how potentially privacy-infringing, and how ineffective the French law is," a company representative told AFP. The French regulatory body, Arcom, mandated that adult websites implement robust age verification systems to prevent minors from accessing explicit content under a law passed in 2023. Non-compliance could result in significant fines or blocking of the website within France. The legislation envisions the use of third-party verification technologies that would confirm a user's age without collecting personal data. However, Aylo has argued that the current technological solutions either infringe on user privacy or are not sufficiently reliable. The company insists it supports age verification - but calls for more secure, device-level solutions. "Google, Apple, and Microsoft all have the capability built into their operating systems to verify the age of the user at the operating system or device level," said Solomon Friedman, vice president for compliance at Canadian private equity firm Ethical Capital Partners, which owns Aylo. "I understand that those three entities are large and powerful, but that is not an excuse for France to do what they have done." The French government maintains that these measures are essential for protecting minors online. Culture Minister Aurore Berge accused Pornhub, YouPorn, and RedTube of refusing to "comply with our legal framework" and deciding to leave "for the better." "There will be less violent, degrading, and humiliating content accessible to minors in France. Bye," Berge wrote on X on Tuesday. France's Digital Minister Clara Chappaz added that "requiring pornographic sites to verify the age of their users isn't stigmatizing adults, but rather protecting our children."
