[UPDATED] Bung Moktar, wife fail in final bid to challenge corruption charges [WATCH]

PUTRAJAYA: Datuk Seri Bung Moktar Radin and his wife, Datin Seri Zizie Izette Abd Samad, failed in their final bid to challenge the Court of Appeal's decision ordering them to enter their defence on corruption charges amounting to RM2.8 million.
This is after a three-judge Court of Appeal panel led by Datuk Che Mohd Ruzima Ghazali unanimously dismissed the couple's leave application to review the decision today.
The court said the appellants failed to meet the threshold of proving any exceptional circumstances or miscarriage of justice that would warrant a review of the earlier decision.
On Nov 18 last year, the Court of Appeal ordered Bung Moktar and Zizie Izette to enter their defence on three corruption charges after allowing the prosecution's appeal against the couple's acquittal by the Kuala Lumpur High Court on Sept 7, 2023.
On Sept 2, 2022, Sessions Court judge Rozina Ayob ruled that a prima facie case had been established against the accused at the close of the prosecution's case and ordered them to enter their defence on all three charges.
On May 3, 2019, the Kinabatangan member of Parliament was charged with two counts of accepting bribes amounting to RM2.2 million and RM262,500 as an inducement to secure Felcra's approval to invest RM150 million in Public Mutual unit trusts.
He was alleged to have accepted the bribes from Madhi, an investment agent with Public Mutual Bhd, through Zizie Izette at Public Bank's Taman Melawati branch here between 12.30pm and 5pm on June 12, 2015.
Zizie Izette was charged with three counts of abetting her husband at the same location, date, and time.

Judge Musli Ab Hamid convicted Tony Kuswadi Martin, 42, on his own guilty plea to a charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39C(1)(b) of the same Act. The Section provides for imprisonment of not less than five years and not more than seven years, and whipping of up to three strokes, upon conviction. Tony was also ordered to undergo two years of police supervision upon his release from prison. He was tested positive for the two drugs at the Kuching Narcotics Criminal Investigation Division office at around 2pm on June 2, 2025. It was informed that the accused has two prior convictions, in 2017 and 2022, for the same offence. Md Khairul Rosli, 32, pleaded guilty before Judge Musli Ab Hamid to a charge under Section 392 of the Penal Code, which provides for imprisonment of up to 14 years, and a fine or whipping, upon conviction. He committed the offence by the roadside near Lorong Semariang Batu 12, Kampung Semariang Pinggir here at about 12.04am on May 29, 2025. According to the facts of the case, the victim and a friend had arranged to meet a man, later identified as Md Khairul, for the purpose of selling a used mobile phone. At the scene, the victim was coerced into surrendering not only the phone intended for sale but also his personal mobile phone. The victim believed that the accused had pressed a sharp object against his lower back to threaten him into handing over the items. A police report was subsequently lodged, leading to the arrest of the accused the next day. Investigations revealed that the accused had committed the robbery without the use of a weapon. Although the victim initially believed a sharp object was pressed against his back, it was later determined that the accused had used his finger to simulate the threat. An identification line-up was conducted and the victim positively identified the accused. The victim also identified the stolen phone, which was recovered and accessible using the correct password. He further recognised a blue jacket worn by the accused when executing the crime. Eyewitness testimony corroborated the victim's account and confirmed the accused's identity. The witness also identified the clothing worn by the accused, which matched the items seized during the investigation. KOTA KINABALU (June 6): A 51-year-old man was sentenced to nine years behind bars plus two strokes of the cane by a Sessions Court here for committing physical sexual assaults against his daughter. Judge Marlina Ibrahim imposed the sentence on the accused when his case came up for sentencing. He had pleaded guilty to his charge on April 3 but his sentencing was put off pending preparation for the facts of the case by the prosecution. The accused was jailed for seven years plus two strokes of the cane for touching the victim's private parts at a house in Menumbok, Beaufort on December 18, 2024. She was 13 years old at that time. The accused was convicted under Section 14(a) of the Sexual Offences Against Children Act (SOACA) 2017 which provides for a jail term of up to 20 years and whipping, upon conviction. However, due to the relationship with the victim, he received another two years' imprisonment as an additional punishment under Section 16(1) of the SOACA. The section provides for a jail term of up to five years and whipping.
