SC set to revisit PTI reserved seats verdict

The Supreme Court has fixed for hearing the review petitions filed against its July 12 ruling that awarded reserved seats to the Pakistan Tehreek-e-Insaf (PTI) in a major legal victory for the beleaguered party, setting the stage for a major constitutional re-examination this week.
A 13-member larger bench, led by Justice Aminuddin Khan, will hear the case on May 6, according to a cause list issued by the apex court.
The expanded bench includes Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar, Justice Ayesha Malik, Justice Hasan Azhar Rizvi, Justice Musarrat Hilali, Justice Naeem Akhtar Afghan, Justice Aqeel Abbasi, Justice Shahid Bilal Hassan, Justice Hashim Kakar, Justice Salahuddin Panhwar, Justice Aamer Farooq and Justice Ali Baqar Najafi.
However, contrary to SC rules, Justice Mansoor Ali Shah, who authored the July 12 majority judgment, has not been included in the new bench. Under prevailing judicial norms, a judge who authored or participated in the original decision is typically included in any subsequent review hearing.
On July 12, 2024, an eight-member bench had ruled in favour of granting reserved seats to PTI through a majority decision authored by Justice Mansoor Ali Shah.
The bench included Justices Munib Akhtar, Muhammad Ali Mazhar, Ayesha Malik, Athar Minallah, Hasan Azhar Rizvi, Shahid Waheed and Irfan Saadat Khan.
The original case had been filed by the Sunni Ittehad Council (SIC), which sought allocation of reserved seats following PTI-backed independents joining its platform. However, the top court ultimately ruled that the reserved seats should be allotted directly to PTI.
The ruling has since been challenged through review petitions by the Election Commission of Pakistan (ECP) and political parties including the Pakistan Muslim League-Nawaz (PML-N), Pakistan Peoples Party (PPP) and Jamiat Ulema-e-Islam-Fazl (JUI-F).
Meanwhile, in Lahore, the Lahore High Court (LHC) heard a separate petition seeking implementation of the SC's reserved seats verdict. Justice Khalid Ishaq presided over the hearing of the plea filed by a citizen, Munir Ahmed.
The petitioner's counsel argued that the top court's decision in the PTI reserved seats case had not yet been implemented. The lawyer urged the court to issue directions compelling authorities to act on the ruling and to formally allocate the seats to PTI.
"The Supreme Court's verdict is being ignored," the counsel submitted, requesting the court to issue binding instructions to enforce the ruling.
The petitioner also requested that the president and prime minister be removed from the list of respondents, suggesting they were not necessary parties in the current implementation plea.
Issuing notices to the ECP, the LHC adjourned further proceedings until May 16.

The shooting deaths were the latest reported near the aid centre run by the Gaza Humanitarian Fund (GHF) in the southern district of Rafah and came after it resumed distributions following a brief suspension in the wake of similar deaths earlier this week. An aid boat with 12 activists on board, including Swedish climate campaigner Greta Thunberg, was meanwhile nearing Gaza in a bid to highlight the plight of Palestinians in the face of an Israeli blockade that has only been partially eased. Civil defence spokesman Mahmud Bassal told AFP that at around 7:00 am (0400 GMT), 'six people were killed and several others wounded by the forces of the Israeli occupation near the Al-Alam roundabout'. Gazans have gathered at the roundabout almost daily since late May to collect humanitarian aid from the GHF aid centre about one kilometre (a little over half a mile) away. AFP is unable to independently verify the tolls compiled by the civil defence agency or the circumstances of the deaths it reports. US-backed Gaza aid group says all distribution sites closed after shootings The Israeli military told AFP that troops had fired 'warning shots' at individuals that it said were 'advancing in a way that endangered the troops'. Samir Abu Hadid, who was there early Saturday, told AFP that thousands of people had gathered near the roundabout. 'As soon as some people tried to advance towards the aid centre, the Israeli occupation forces opened fire from armoured vehicles stationed near the centre, firing into the air and then at civilians,' Abu Hadid said. The GHF, officially a private effort with opaque funding, began operations in late May as Israel partially eased a more than two-month aid blockade on the territory. UN agencies and major aid groups have declined to work with it, citing concerns it serves Israeli military goals. In a special operation in the Rafah area on Friday, Israeli forces retrieved the body of Thai hostage Nattapong Pinta, Defence Minister Israel Katz said. 'Nattapong came to Israel from Thailand to work in agriculture, out of a desire to build a better future for himself and his family,' Katz said. He was 'brutally murdered in captivity by the terrorist organisation Mujahideen Brigades', the minister charged. The Mujahideen Brigades is an armed group close to Hamas ally Islamic Jihad that Israel has also accused over other deaths of hostages seized from Kibbutz Nir Oz near the border. The military said Nattapong's family and Thai officials had been notified of the operation to recover his body. Listen to article Senior-most judge of the Supreme Court, Justice Syed Mansoor Ali Shah, took oath as the Acting Chief Justice of Pakistan on Saturday, in an unprecedented ceremony held on Eid day at the Supreme Court's Lahore Registry. The oath was administered by Justice Ayesha A. Malik, marking a rare event where the swearing-in of the country's top judicial office took place outside the federal capital and on a public holiday. The ceremony was attended by Supreme Court judges Justice Shahid Waheed, Justice Aamer Farooq, Justice Shahid Bilal Hassan, and Justice Ali Baqar Najafi. Advocate General Punjab Amjad Pervez, along with several senior members of the legal fraternity, was also present. Justice Mansoor Ali Shah will serve as Acting Chief Justice until June 10, during the absence of Chief Justice Yahya Afridi, who is currently in Saudi Arabia to perform Hajj. Justice Isa is expected to resume his duties upon his return next week.
