Fremont slapped with lawsuit over homeless camping ban

(KRON) — A coalition of homeless people, advocates, the California Homeless Union, and religious organizations filed a federal civil rights lawsuit against the City of Fremont. The lawsuit challenges a new city ordinance that 'criminalizes homelessness,' according to the coalition.
Fremont's ordinance bans camping on public property, outlaws possessing camping gear, and allows the city to fine people who help establish encampments. Public property includes city streets, sidewalks and parks.
The City Council approved the ordinance in February.
'With this anti-camping law, Fremont has made it illegal for its unhoused residents to exist within city limits,' said Jason Serris, president of Marin Housing for All Foundation. 'Even possessing something as essential as a sleeping bag is now a crime.'
More than 800 homeless people live in Fremont, according to the city's latest count in 2024.
The lawsuit was filed Wednesday in the U.S. District Court for the Northern District of California. The suit claims that the anti-camping rules mark an 'ugly chapter' in the city's history.
Several plaintiffs named in the lawsuit are homeless. Kent Eaton has been homeless for 22 years and lives off $670 in monthly welfare checks, the suit states. Eaton lives inside a tent that's wrapped by a tarp, and both items were given to him by a local church. He relies on local churches for essentials like blankets, water, and food.
Coalition leaders said Fremont plans to now punish churches and nonprofits that help people like Eaton.
The ordinance targets anyone who is 'causing, permitting, aiding, abetting or concealing' an encampment. Fremont Mayor Raj Salwan said the city will not punish people who are trying to support the homeless by giving them resources like water, but it will punish those who try to help set up encampments and makeshift wooden structures.
Andrea Henson, co-counsel for the California Homeless Union, said, 'The City is not only criminalizing poverty but also attacking those who live out their faith through service. This ordinance is an assault on compassion, community, and justice.'
Another plaintiff, Corrine Griffith, is a homeless woman who suffers from multiple personality disorder and epilepsy. She has been a victim of violent crime and terrorized by an East Bay street gang that killed her husband, the suit claims. Griffith recently suffered a life-threatening seizure and she was rescued by friends who live in her encampment. She claims that she became homeless after a landlord embezzled rent payments.
The lawsuit states that Griffith and Eaton are 'involuntarily homeless.'

Without resources from churches, charities, and nonprofits, the city's homeless population will suffer from being exposed to the elements, illness, and premature death, the coalition claims.

NEW YORK CITY - Seven Democratic candidates for New York City mayor took the stage on Thursday night to debate each other for the second and final time. What they're saying "Experience matters and I think inexperience is dangerous," former New York Gov. Andrew Cuomo said. Zohran Mamdani, a 33-year-old Democratic socialist, found himself the target of jabs, along with Cuomo. "He's never dealt with the City Council. He's never dealt with the Congress. He's never dealt with the State Legislature. He's never negotiated with a union. He's never built anything. He's never dealt with a natural emergency. He's never dealt with a hurricane, with a flood, et cetera. He's never done any of the essentials. And now you have Donald Trump on top of all of that," Cuomo said. "I have never had to resign in disgrace," he said. "I have never cut Medicaid. I have never stolen hundreds of millions of dollars from the MTA. I have never hounded the 13 women who credibly accused me of sexual harassment. I have never sued for their gynecological records, and I have never done those things because I am not you, Mr. Cuomo." Mamdani continued, chiding Cuomo for mispronouncing his name: "And furthermore, the name is Mamdani. M-A-M-D-A-N-I." "The problem is we do not get to address the issues that New Yorkers care about because we're talking about his past." State Sen. Zellnor Myrie City Comptroller Brad Lander also hammered Cuomo over the sexual harassment allegations that drove him from office. Meanwhile, state Sen. Zellnor Myrie lamented the fact that the debate had devolved into a referendum on Cuomo's history. "The problem is we do not get to address the issues that New Yorkers care about because we're talking about his past," Myrie said. The race appears to be between Cuomo and Mamdani, but former City Comptroller Scott Stringer says – don't forget about me. "My experience and my vision, when you combine it, is the third lane to win this race," Stringer said. Former hedge fund executive Whitney Tilson criticized not Cuomo, but Mamdani, and predicted that his plan to raise taxes would have dire consequences: "Lead to an exodus of businesses and jobs and crush our city." At one point, moderators allowed the candidates to ask questions of each other. Adrienne Adams, the speaker of the New York City Council, directed her question at Mamdani, first detailing her long work experience and then asking: "Given what I've just laid out, do you think you're more qualified than me to lead the city?" Mamdani smiled and praised Adams' leadership, but said he believed he was the most qualified "because I believe the most pressing crisis we're facing here is one of affordability, and that is something that my campaign has been laser-focused on," before touching on some of his policy points. (KRON) – A woman was arrested after shoplifting jewelry and designer perfumes, according to the San Mateo Police Department. Recently, Macy's loss prevention officers alerted the department to a woman shoplifting. According to San Mateo police, the suspect stole two perfumes, one called Bad Boy by Carolina Herrera and the other called Gucci Guilty. San Mateo police referred to the irony of the perfume's name on its social media. The female suspect also shoplifted a cubic zirconia ring.
