Utah bill to restrict, regulate zoning in newly incorporated areas sparks concern in Ogden Valley
A proposal to restrict zoning and require compensation for downzoning in newly incorporated areas is drawing the attention of some of the people behind the push to incorporate part of the Ogden Valley.
"This would create so many problems that are so unsolvable," said Brandi Hammon, who promoted the ballot question last November to turn the expanse around Eden, Wolf Creek and Liberty east of the Wasatch Back in Weber County into a new city. The incorporation measure passed by a wide margin, and the city is to formally come into being next January.
Sen. Calvin Musselman, the sponsor of SB322, though, isn't looking for immediate action on the proposal, meant to address downzoning, or implementation of zoning changes imposing new restrictions on land use. Rather, he introduced the bill so the topic could get attention during the legislative interim later this year. "I don't want this bill passed. I just want it to get to interim," he said at a meeting Thursday of the Senate Government Operations and Political Subdivisions Committee.
Officials ended up taking no action on the proposal, but its introduction earlier this week sparked a strong response from Ogden Valley incorporation proponents.
Hammon worries the proposed change could hamper leaders of the new city, to be elected later this year, as they're trying to get the new locale up and running. A message Wednesday on the Facebook page of the group that spearheaded the incorporation drive, Ogden Valley Incorporation, blasted the legislation and called on Ogden Valley residents to reach out to their representatives to voice opposition.
"These new rules DO NOT apply to the county or to other cities who make zoning changes — just our new city. SB322 is a blatant attempt to hobble our new city government," reads the text of a message Ogden Valley Incorporation is calling on city boosters to send to lawmakers.
Musselman didn't respond to a query seeking comment, but SB322, as written, would prohibit downzoning for at least a year after an unincorporated area is annexed into a city. It would also require a city to compensate a property owner whose property loses value due to downzoning after incorporation.
Incorporation boosters touted incorporation of the Ogden Valley as a way of helping assure local control amid increasing development and growth pressures. The area is home to three ski resorts and Pineview Reservoir and is an increasingly popular getaway draw.
But Hammon said downzoning hasn't been an intent of those who promoted incorporation. As is, the Weber County Commission governs the Ogden Valley area to be incorporated until the new city formally materializes in January 2026. "We're not looking at it at all because it's not our intention," Hammon said.
At any rate, given the year-plus period between last November's annexation vote and formation of the city next January, developers already have time to develop their land before incorporation becomes official. So many variables figure in determining the potential loss of a parcel's value due to downzoning, meantime, that such a task is incredibly difficult, she said, not that downsizing is contemplated.

Republican voters will have the choice between Heather Doyle, Clint Hollingsworth, Dan McWhorter and Cindy Myrex on July 15. The lone Democratic candidate, Matt Glover, will advance to the general election on Oct. 28 against the winner of the special election primary. If one Republican candidate does not receive 50% of votes, the special runoff election will take place on Aug. 12. Former Rep. Corey Harbison, R-Cullman, resigned in April after he was absent for much of the 2025 legislative session. All interviewed candidates said they are running for office for Cullman County representation in Montgomery. 'You didn't ask how anybody that lives there, how they felt about it,' Doyle said. 'This is our community, like we live there. This is going to affect us.' 'My plan is to represent the folks in this district like I have my constituents with the city,' Hollingsworth said. 'I'm gonna work hard for them, just like what I've done for the last 17 years on the city council, for the folks here that voted for me.' 'I didn't think we were getting much representation on the issues that I thought were important, so I figured I'd get involved,' McWhorter said. Efforts to schedule an interview with Myrex were not successful. Doyle, Glover and McWhorter also expressed opposition to SB 322, sponsored by Sen. Jabo Waggoner, R-Vestavia Hills. It was signed by Gov. Kay Ivey on May 7 and allowed the City of Cullman to annex a resort on Smith Lake in Cullman County, a dry county, for the resort to serve alcohol. 'I mean, there's nothing I can do about that, even though I know that's the main concentration for the election. I just think it's wrong,' Doyle said. 'We're exploring what it would take to rescind the legislation,' McWhorter said. Glover's first priority in his campaign is giving the people more power, which he said was not present when the legislation passed. The Republican primary Doyle, 43, is a former teacher and realtor in the Smith Lake area of Cullman County. She wants to reform the court system, inspired by an ongoing custody battle in her personal life that she declined to explain because of potential implications in the litigation. 'I think we just need a better system, like something for inmates to even go to rehab,' she said in an interview Monday. 'I just think we need to do something better.' She also wants to reduce wasteful spending and government overreach by reviewing where state taxpayer dollars are going. 'I think we need to look closer at the budget and what we're spending and the programs,' she said. Finally, she wants to improve education in the state and be a voice for children in education and in custody battles. 'They don't get like issues that are going on with the court system, with kids, it's just not a man thing. They're not worried about kids, and they're not worried about women,' she said. 'And I just think we've got a lot of things going on with juveniles in the court system that I think just needs to be handled differently.' The first-time candidate said she is the best for the job because she will not rely on the politics of lawmaking to pass legislation. 'Nobody's going to be able to bribe me, I don't owe anybody a favor,' she said. 'I really think this is how politics work.' Hollingsworth, 47, owns a used car dealership in Cullman. He said in an interview on May 27 that he is prioritizing education and work force development. 'Investing in public education and job training programs is vital to prepare our students for future employment opportunities,' he said. He also said he wants the state to support volunteer fire departments more. There are 983 volunteer fire departments in the state, 23 of which are in Cullman County, according to the Alabama Forestry Commission. 'There's 17 in this district that I'm running for, and I want to help with funding and training and just trying to get people willing to serve and help their community,' Hollingsworth said. He also said he wants to improve transportation infrastructure. 'Reliable transportation is essential for employment, education and our health care,' he said. 'Not just the county roads, but even 65 and interstate highways just need upgrades for sure.' The former Cullman County City Councilman said he is the best candidate because of his tenure on city council, which he has served on since 2008. 'It's a new challenge for me, but it encompasses areas that I'm already kind of used to,' he said. 'I'm just looking forward to helping and serving more people.' McWhorter, 68, has been a sales manager for Innovative Analytical Solutions in Bremen, Alabama, for a decade. McWhorter said in an interview on May 21 that his main priority is to implement a property tax cap for property owners who are at least 65 years old. 'Property ownership is either a right or it's a privilege,' McWhorter said. 'So if it's a right, we don't tax free speech, right? So why are you taxing my property?' Aside from that, McWhorter also wants a 'clean lottery bill' that would fund two years of tuition at technical colleges. The legislature failed to pass a comprehensive gaming bill in 2024, and the House rejected any attempts at another from the Senate this year. 'The second one is a clean lottery bill that'll fund two-year college tuition, or two years of college tuition for any high school graduate with a C average,' he said. Lastly, McWhorter wants to completely eliminate the tax on overtime, which is set to expire on June 30. He also mentioned eliminating daylight savings time as a goal. House Speaker Nathaniel Ledbetter, R-Rainsville, an original supporter of the bill, has said the exemption created a larger hole in the Education Trust Fund (ETF) than expected. President Donald Trump has advocated for a national exemption in his second term. The lone Democrat Glover, 40, served on the Good Hope City Council from 2012-2016. He wants to prioritize local power. 'Returning power to local communities, like just trying to wrestle away some of the power that the state government has taken from like local cities and towns, which plays in with SB 322,' Glover said in an interview on May 23. He also said he opposes HB 445, sponsored by Rep. Andy Whitt, R-Harvest, which was signed into law on May 14. The bill requires testing and labeling for all consumable hemp products and caps at 10 milligrams per individually wrapped product and 40 milligrams per package. It will require the Alcoholic Beverage Control (ABC) Board to license retailers of these products, restrict retail establishments selling hemp products and impose an excise tax on consumable hemp products. 'With the amount of jobs that I think that's going to cost, and the amount of like, government overreach that is involved with it is pretty disgusting,' he said. Finally, Glover wants to advocate for direct ballot initiatives in order for Alabamians to have a say in a state lottery. Nineteen states have direct ballot initiatives, which allow citizens to propose constitutional amendments. 'A lot of that goes back to us not being able to get the lottery amendment on the ballot, like sports gambling, any number of things, but where they just won't pass it in Montgomery to allow the citizens to vote,' he said. Glover said he is running for office to show the people of the district that there are Democrats and that they deserve to be represented. 'We still exist. And I think there's just a lack of enthusiasm and motivation,' he said. 'When you see a statewide ballot with no Democrats running, it makes people less likely to turn out, and then it looks like that they're just not there.' DeSantis, business groups in Sarasota tout new law for stricter anti-squatting enforcement
Florida Gov. Ron DeSantis spoke from behind a lectern that read 'No Tolerance for Squatting' in Sarasota on Monday as he met with local business leaders and politicians to sign two new anti-squatting bills into law. On the sixth floor of the bayfront Westin hotel, DeSantis said the measures would allow for more consistent law enforcement against squatters and illegal tenants in residential businesses − such as motels. Some advocates have criticized a flurry of such legislation around the country as damaging to poor and homeless communities. 'This provides those property owners with a streamlined process to regain possession of the property that is rightfully theirs,' he said. The two bills – SB 322 and SB 606 – are designed to make it easier for local law enforcement to remove people who are staying on a property they don't own (against the owner's wishes) and for those who haven't been paying their rent or residential fee to be evicted. SB 322's bill analysis says it would create a procedure outside of the courts for the county sheriff to remove 'an unauthorized person from commercial real property.' Both laws will go into effect on July 1. The House sponsor of SB 322, Highland Beach Republican State Rep. Peggy Gossett-Seidman, told the Herald-Tribune that it wasn't designed to prosecute homeless people who are staying on an empty estate out of necessity. As long as they comply with law enforcement, they won't be charged, she said. Florida's homeless population has fluctuated since DeSantis took office, but since 2021 it has increased by nearly 49% – from 21,141 to 31,462 − according to Florida Health. This has come amid skyrocketing rent and mortgage rates across the state. Gossett-Seidman tentatively said its possible that the state's affordable housing crisis exacerbates squatting, but there wasn't enough hard data on the topic. 'There aren't a lot of numbers and it's hard to keep track of this issue,' Gossett-Seidman said. 'It's all possibly conjecture since this has been an under-the-radar issue.' She referenced a survey by the National Rental Home Council that said Orlando had the third-highest rate of squatters in the state. The National Housing Law Project, an advocacy group of poor communities, criticized anti-squatting laws by state legislatures in a 2024 report. 'Key dangers include the improper removal of rightful occupants from their homes, the potential for arrest or violent interaction between tenants and police, and a heightened ability of landlords to intimidate tenants by threats of non-judicial police eviction," the report said. The group also criticized the council survey for a lack of transparency and called its findings 'unclear beyond what appears in media reports.' The press conference was filled with DeSantis' usual law and order rhetoric, making comparisons between Florida and states like California and New York. One man several rows of chairs back held a t-shirt in his lap that read 'Don't California My Florida.' Attendees included area state lawmakers such as Sens. Jim Boyd, R-Bradenton, and Joe Gruters, R-Sarasota; State Reps. Fiona McFarland, R-Sarasota, and Danny, R-Englewood; former Sarasota City Commissioner Erik Arroyo, Sarasota Police Chief Rex Troche, and Sarasota County Sheriff Kurt Hoffman. 'I'm not surprised the Legislature and Governor have turned to the sheriffs to be able to enforce this,' Hoffman said to the audience. 'We're up to the task, and we're certainly going to do that.' Governor DeSantis signs anti-squatting bills, focused on commercial properties
The Brief Florida Gov. Ron DeSantis signed two anti-squatting bills Monday aimed at strengthening property owners' rights over commercial and temporary lodging properties. Senate Bill 322 allows sheriffs to immediately remove unauthorized occupants from commercial properties, while Senate Bill 606 updates eviction and billing rules for hotels and food establishments. The legislation builds on a 2024 law targeting residential squatters and was prompted by local complaints from business owners. ORLANDO, Fla. - Florida Governor Ron DeSantis signed two anti-squatting bills into law Monday in Sarasota. What we know Both bills will increase penalties for squatters found inhabiting commercial properties and hotel/temporary housing properties. During the press conference, Governor DeSantis stated, "We are not going to let the law create roadblocks for property owners to exercise their rights". The governor signed Senate Bill 322 which states: "Property Rights; Authorizing a property owner or his or her authorized agent to request the sheriff in the county in which the owner's commercial real property is located to immediately remove persons unlawfully occupying the owner's commercial real property if specified conditions are met; authorizing the sheriff to arrest an unauthorized person for legal cause; prohibiting a person from unlawfully detaining or occupying or trespassing upon commercial real property and intentionally causing a specified amount of damage, etc." And Senate Bill 606 which states: "Public Lodging and Public Food Service Establishments; Revising notification requirements for removing guests from public lodging and public food service establishments; requiring public food service establishments that charge an operations charge to provide specified notice; requiring bills and receipts to contain certain information, etc." State Representative Peggy Gossett-Seidman, the House of Representatives sponsor of SB 322, spoke during the press conference Monday, "This bill is proof that when we listen to residents, good things happen." Representative Gossett-Seidman stated that the bill was filed after a resident reached out to her asking for help because people inhabited their family owned restaurant, "The rightful owners have spent alot of money and time trying to have these persons evicted from the property with no success." The backstory In 2024, Governor DeSantis signed House Bill 621, which authorized "property owners or authorized agents to request assistance from the sheriff for immediately removing unauthorized occupants from residential dwellings under certain conditions". This law created harsher penalties for residential squatters. "That is not going to fly in the State of Florida, we are not going to let people's residences…be commandeered by people who aren't paying to be there", DeSantis stated Monday. The governor stated that the success of the 2024 law led to the signing of Senate Bill 322 and Senate Bill 606.
