
"The Disability Allowance Is Broken – And It's Hurting The People Who Need It Most" (Part 4)
The Disability Allowance was designed to help some of the most vulnerable people in Aotearoa – those living with ongoing physical or mental health conditions that incur regular costs. But ask anyone who has tried to access it recently, and you'll hear the same story: it's broken.
Every week, we speak to state care survivors, disabled people, and mental health service users who are trying to navigate this system. They're not asking for luxuries – they're asking for help with GP visits, counselling, transport, medication, gluten free products, or extra heating. Basic costs for daily survival, healing and wellbeing. Yet they are being met with suspicion, delays, inconsistent rules, and outright denials.
It's Not the Criteria – It's the System
The criteria for the Disability Allowance are already narrow: you must have a disability likely to last at least six months, and it must incur extra costs. But even when someone clearly meets these requirements, barriers are built into every stage.
GPs are asked to fill out complex forms, sometimes requiring detailed medical notes, verification and financial estimates for every item. For trauma survivors, this means reliving their experience over and over again. Some one receiving gluten free products, or unsubsidized medication or even simply gym visits, must provide copious amounts of evidence, stretching an already over-whelmed health system.
MSD staff apply inconsistent interpretations, with some clients being approved for support and others being told 'you don't qualify' – for the same medication, the same cost, depending on who they get.
Reviews are demanded regularly, with little warning. Clients are forced to re-prove their disability as if it might have magically disappeared.
We know of survivors whose claims were rejected because their trauma-related costs were not deemed 'essential,' despite being recommended by medical professionals. Our survivors know their healing, yet with the small amount extra a week, they have to provide so much, it isn't worth the hassle.. People with PTSD and chronic health issues produced by their abuse in state care have been told that they are not eligible for Disability Allowance, because they must first spend the money, they must first produce all the receipts, they must first get a specialist letter. And all of this happens while they are simply trying to survive. Why should someone go without food? Just to buy medication? That shows you how backwards the policy is.
A Patchwork of Postcode Policies
Perhaps the most insulting feature of the Disability Allowance system is how postcode-dependent it is. What's approved in Christchurch may be rejected in Porirua. What one case manager calls 'reasonable' may be dismissed as 'not covered' by another.
This is not just unfair – it's unlawful. The Ministry of Social Development is a public agency. It is bound by Te Tiriti o Waitangi, the Human Rights Act, and the principle of equity. Yet it is administering a benefit that delivers different results depending on where you live, who you talk to, and how much you know how to fight.
For State Care Survivors, It's Another Betrayal
Many of the people we support are survivors of state abuse. They were harmed by the very institutions that were meant to protect them. The state failed them once – and it is failing them again.
Being denied the Disability Allowance isn't just a bureaucratic inconvenience. For these survivors, it means going without counselling. It means deciding between heating and medication. It means staying isolated because they can't afford to travel to healing spaces. Every rejected form is a reminder that their wellbeing is still seen as a cost to be minimized, not a right to be protected.
If the government is so risk adverse why don't the put the costs on the green card? That way they ensure that the person's health costs are going to the place, directly to the provider.
What Needs to Change
We're calling on the Government to overhaul the Disability Allowance system with urgency. This includes:
Trauma-informed training for MSD staff;
Standardised national guidance to end postcode-based decisions;
Streamlined application processes, especially for those already in the healthcare or redress systems;
Guaranteed access to interpreters and alternative therapies for those with specialist needs;
And most of all, a shift in mindset – from gatekeeping to support.
People shouldn't have to fight for the basics. They shouldn't have to beg, prove, or relive trauma just to get the help they are entitled to. The Disability Allowance was meant to uphold dignity. Right now, it is doing the opposite.

Rights Aotearoa Demands Urgent Re-evaluation Of Regulatory Standards Bill's Human Rights Impact
WELLINGTON, 4 June 2025 – Rights Aotearoa, New Zealand's leading NGO devoted to promoting and defending universal human rights, today called on Attorney-General Judith Collins KC to urgently instruct the Ministry of Justice to comprehensively re-evaluate its advice on the Regulatory Standards Bill's consistency with the New Zealand Bill of Rights Act 1990. The Ministry's advice concluded that the Bill "appears to be consistent with the rights and freedoms affirmed in the Bill of Rights Act." Rights Aotearoa has delivered a detailed letter to the Attorney-General demonstrating that this conclusion represents a grave failure of constitutional analysis that ignores the Bill's fundamental threat to human rights, democracy, and Te Tiriti o Waitangi. "The Ministry of Justice has failed in its constitutional duty to assess this Bill's impact on human rights properly," said Paul Thistoll, CEO of Rights Aotearoa. "Their analysis acknowledges that the Bill departs from how rights and freedoms are expressed in the Bill of Rights Act, yet inexplicably concludes it has no impact on those rights. This is constitutionally incoherent." Rights Aotearoa's analysis identifies multiple critical failures in the Ministry's assessment. The Ministry examined only one right superficially—freedom of expression—while ignoring clear conflicts with electoral rights, freedom from discrimination, minority rights, and the right to life. The advice fails entirely to consider how the Bill's mechanisms will create "regulatory chill," deterring future governments from enacting essential protections. Advertisement - scroll to continue reading Of particular concern is the Ministry's failure to analyse the Bill's complete exclusion of Te Tiriti o Waitangi, despite the Waitangi Tribunal's findings that the Crown breached Treaty principles through inadequate consultation with Māori and its recommendation for an "immediate halt" to the Bill's progress. The organisation highlighted how the Bill's emphasis on property rights and narrow economic efficiency will systematically undermine anti-discrimination protections. Essential measures like disability accommodations, pay equity legislation, and protections against discrimination could be challenged as "impairing" property rights. "This Bill creates a competing quasi-constitutional framework that elevates property rights above all other human rights," the letter states. "It attempts to lock in a narrow ideological worldview that will bind future Parliaments." Rights Aotearoa has committed to filing an action in the High Court, should the Bill pass in its current form, seeking a declaration that it is inconsistent with the Bill of Rights Act. The organisation calls on the Attorney-General to instruct the Ministry of Justice to conduct a comprehensive re-evaluation that accurately analyses the Bill's downstream effects on all rights, considers its practical operation, examines the constitutional implications of creating a parallel rights framework, evaluates the exclusion of Te Tiriti, and assesses the impacts on anti-discrimination protections. Beyond the pool: rethinking disability aid
Is New Zealand's approach to supporting the disabled actually solving anything, Graham Redding asks. In a time of deepening inequality, a Gospel story from John 5 offers a necessary reflection for Aotearoa. Jesus encounters a man who has waited 38 years by the pool of Bethesda — a place believed to offer healing. But healing, here, is conditional: only the quickest, strongest, or most fortunate are helped. "I have no-one to help me," the man tells Jesus. "Someone else always gets there ahead of me." Jesus does not wait for the waters to stir or for institutional permission. He simply says: "Get up. Pick up your mat and walk." The man is restored — not just physically, but socially. He is no longer invisible. This story is often treated as a healing miracle. But it is more than that. It is a critique of systems that neglect the vulnerable. The pool becomes a symbol of exclusion, where only a few benefit, and many are left waiting. In 2022, the creation of Whaikaha — the Ministry of Disabled People — was welcomed as a breakthrough response to long-standing fragmentation. Disabled people had been shuffled between agencies, often receiving inconsistent and inadequate support. Whaikaha promised a new era — one focused on human dignity rather than bureaucratic boundaries. But in 2024, the government announced a restructuring. Whaikaha was stripped of its service delivery role, which was transferred to the Ministry of Social Development. The rollout of Enabling Good Lives — a programme promoting greater choice and control — was put on hold. Cost and efficiency were cited. But the consequences have been stark. Early this year, the New Zealand Medical Journal warned that these changes, alongside budget cuts and funding freezes, were harming disabled people and their families. Residential care was scaled back. In-home support became harder to access. Families and carers were under pressure, and mental distress was rising. The May 2024 "A Thousand Cuts" report from the Fairer Future Coalition documented the cumulative impact of recent government policies — from the return of prescription fees and higher transport costs, to changes in welfare and education. It estimated that families with a disabled member now face up to $5500 more in annual costs. This is not just a policy failure. It is a moral one. In response, the May 2025 Budget committed $1.1 billion over five years to stabilise disability support services. This investment is widely welcomed. The government says it will help ensure access to essential equipment, services, and support for those in need. But it comes with caveats. Whaikaha will now focus solely on advocacy, while the Ministry of Social Development oversees delivery. Some see this as a pragmatic division of roles. Others worry it further marginalises the voices of disabled people from decisions that affect them. Meanwhile, services like Enabling Good Lives are operating under tighter budgets, and residential care funding remains frozen. So, while the investment signals a welcome shift, it does not yet signify transformation. At best, it may stabilise a strained system. This raises an unsettling question: are we merely managing a crisis, or working towards justice? Theologically, Jesus' action at Bethesda disrupts the logic of worth. The man is not asked to prove his eligibility or moral standing. He is seen, addressed, and restored. This act affirms that dignity is not earned by productivity or independence, but by being known and included. Yet in Aotearoa, support too often remains conditional — on diagnosis, funding, and the ability to navigate complex systems. Needs are rationed. Voices go unheard. People feel invisible. Disability theology calls us to see differently. The Gospel challenges us to move beyond transactional care towards communities grounded in justice and relationship. It asks: who still lies by the pool? Who is passed over? Who is told to wait? Real healing requires more than medical intervention. It demands systemic change. It calls for policies that prioritise dignity over dollars and inclusion over convenience. It urges us to see disabled people not as burdens or recipients, but as neighbours, kin, and co-builders of a just society. We need more than restored funding—we need restored trust. That means honouring lived experience, enabling choice, and redesigning systems that currently reinforce exclusion. The Gospel does not promise a world without suffering. But it does promise that no-one should suffer unseen or alone. In Aotearoa today, that means ensuring equitable access to healthcare, housing, education, and community — not as acts of charity, but as marks of justice. When Jesus says, "Pick up your mat," he gives the man back his agency — and calls the community to carry the weight of shared responsibility. Crown Withdraws Only Witness & Evidence Ahead Of Urgent Waitangi Tribunal Hearing Into Māori Health Reforms
Māori health claimants Lady Tureiti Moxon and Janice Kuka are sounding the alarm over what they describe as the Crown's systematic dismantling of Māori-led health reform. They warn that the calculated repeal of Te Aka Whai Ora — the Māori Health Authority — has triggered widespread confusion, inefficiencies, and the quiet erosion of kaupapa Māori structures ultimately impacting whānau. Back in 2023 they tried to bring the matter urgently before the Tribunal before the Government's repeal deadline, procedural delays meant the Tribunal lost jurisdiction to intervene in time. Now the priority Waitangi Tribunal hearing is scheduled from Monday 26 May to Friday 30 May 2025. 'The disestablishment of Te Aka Whai Ora has removed the one structure that responded to those historical breaches. It has brought back the same patterns I described twenty years ago. This isn't a system failing by accident — it is a conscious decision to return to Crown control and institutional racism,' said Lady Tureiti Moxon, Managing Director of Te Kōhao Health. But in a last-minute development late this afternoon, the Crown formally withdrew its only witness and the brief of evidence of Mr John Whaanga — who had been scheduled for cross-examination — from the upcoming urgent Waitangi Tribunal hearing starting on Monday. The Crown also indicated that the Minister of Health is currently reviewing system settings within the public health sector, particularly the Pae Ora (Healthy Futures) Act 2022. Crown Law advised that the details of this work programme remain confidential, with Cabinet yet to make any final decisions. Advertisement - scroll to continue reading The Crown said in a Memorandum: 'This means that the Crown's participation in this part of the priority inquiry is now constrained as Crown officials are not authorised to talk about how present settings might be changed.' The Waitangi Tribunal replied immediately confirming that the hearing will go ahead next week, allowed the Crown to remove the evidence from their only planned witness, John Whaanga, and advised new evidence can be filed by the Crown by 9am on Monday. The hearing will start by discussing this last-minute change and then decide how the rest of the week will run. The priority hearing is due to investigate: What are the Crown's alternative plans to address Māori health in lieu of a Māori Health Authority, and what steps were taken in developing such plans? Was the Crown's process in developing those plans consistent with Te Tiriti o Waitangi and its principles? Are the Crown's alternative plans themselves consistent with Te Tiriti o Waitangi and its principles? The onus is on the Crown to demonstrate the existence, integrity, and Treaty compliance of these alternative plans. 'The Crown must prove what their alternative plans are — and that those plans are genuine, Treaty-compliant, and effective,' said Lady Tureiti. In their evidence submitted to the Tribunal, the claimants — both pivotal figures in the original WAI 2575 Inquiry that led to the landmark 2019 Hauora Report recommending a Māori Health Authority — described a dramatic sector-wide shift since the disestablishment. They cite a return to rigid bureaucracy, heightened auditing and surveillance, and the marginalisation of Māori voice and leadership. 'Right now, we see a system forcing us to translate whakapapa-based, whānau-centred work into endless tick-box reports that change every few weeks. It's exhausting and undermines real outcomes,' said Janice Kuka, Managing Director of Ngā Mataapuna Oranga. Health New Zealand Chair Rob Campbell, former Health New Zealand Chair is one of the expert witnesses in support of the claim. The claimants evidence highlights how kaupapa Māori providers have lost the visibility and prioritisation they once held under Te Aka Whai Ora. 'When Te Aka Whai Ora existed, we were seen. We were contacted. We were valued as Māori providers,' Kuka said. 'Now, it's back to open-market tendering on GETS. The result? Contracts are being lost to large, non-Māori organisations with Māori-sounding names or enrolment numbers — not whakapapa connections to our people.' Lady Tureiti also submitted where providers like her organisation, Te Kōhao has exceeded its contractual targets — such as in maternity and early childhood through the Kahu Taurima programme — it's still being asked to re-report, re-code, and defend its success. The claimants assert that the Crown's current approach represents a return to the very inequities and systemic discrimination Te Aka Whai Ora Māori Health Authority was created to address. 'Te Aka Whai Ora Māori Health Authority gave us the tools to commission services by Māori, for Māori — free from the racism and excessive scrutiny we faced under the old regime,' said Lady Tureiti. When the Government announced its plan to repeal Te Aka Whai Ora in November 2023 — less than 18 months after the Authority was formally established under the Pae Ora Act — it marked a significant reversal of progress. The Waitangi Tribunal had previously found the Crown in breach of Te Tiriti o Waitangi for failing to design a health system that addressed Māori health inequities or upholds tino rangatiratanga. Establishing a Māori Health Authority was one of its core recommendations. 'We warned that the Crown was deliberately rushing through this repeal of Te Aka Whai Ora Maori Health Authority to avoid scrutiny. This isn't just administrative change — it's a calculated rollback of Māori rights and progress,' said Janice Kuka. 'We will continue to hold the Crown to account for its obligations under Te Tiriti. Māori deserve a health system that works — not one that works against us.
