This Glitchy, Error-Prone Tool Could Get You Deported—Even If You're a U.S. Citizen

Juan Carlos Lopez-Gomez, despite his U.S. citizenship and Social Security card, was arrested on April 16 on an unfounded suspicion of him being an 'unauthorized alien.' Immigration and Customs Enforcement kept him in county jail for 30 hours 'based on biometric confirmation of his identity'—an obvious mistake of facial recognition technology. Another U.S. citizen, Jensy Machado, was held at gunpoint and handcuffed by ICE agents. He was another victim of mistaken identity after someone else gave his home address on a deportation order. This is the reality of immigration policing in 2025: Arrest first, verify later.
That risk only grows as ICE shreds due process safeguards, citizens and noncitizens alike face growing threats from mistaken identity, and immigration policing agencies increasingly embrace error-prone technology, especially facial recognition. Last month, it was revealed that Customs and Border Protection requested pitches from tech firms to expand their use of an especially error-prone facial recognition technology—the same kind of technology used wrongly to arrest and jail Lopez-Gomez. ICE already has nearly $9 million in contracts with Clearview AI, a facial recognition company with white nationalist ties that was at one point the private facial recognition system most used by federal agencies. When reckless policing is combined with powerful and inaccurate dragnet tools, the result will inevitably be more stories like Lopez-Gomez's and Machado's.
Studies have shown that facial recognition technology is disproportionately likely to misidentify people of color, especially Black women. And with the recent rapid increase of ICE activity, facial recognition risks more and more people arbitrarily being caught in ICE's dragnet without rights to due process to prove their legal standing. Even for American citizens who have 'nothing to hide,' simply looking like the wrong person can get you jailed or even deported.
While facial recognition's mistakes are dangerous, its potential for abuse when working as intended is even scarier. For example, facial recognition lets Donald Trump use ICE as a more powerful weapon for retribution. The president himself admits he's using immigration enforcement to target people for their political opinions and that he seeks to deport people regardless of citizenship. In the context of a presidential administration that is uncommonly willing to ignore legal procedures and judicial orders, a perfectly accurate facial recognition system could be the most dangerous possibility of all: Federal agents could use facial recognition on photos and footage of protests to identify each of the president's perceived enemies, and they could be arrested and even deported without due process rights.
And the more facial recognition technology expands across our daily lives, the more dangerous it becomes. By working with local law enforcement and private companies, including by sharing facial recognition technology, ICE is growing their ability to round people up—beyond what they already can do. This deputization of surveillance infrastructure comes in many forms: Local police departments integrate facial recognition into their body cameras, landlords use facial recognition instead of a key to admit or deny tenants, and stadiums use facial recognition for security. Even New York public schools used facial recognition on their security camera footage until a recent moratorium. Across the country, other states and municipalities have imposed regulations on facial recognition in general, including Boston, San Francisco, Portland, and Vermont. Bans on the technology in schools specifically have been passed in Florida and await the governor's signature in Colorado. Any facial recognition, no matter its intended use, is at inherent risk of being handed over to ICE for indiscriminate or politically retaliatory deportations.
At state and local levels, however, there is a way to fight back. For example, there is a package of 'Ban the Scan' bills in the New York State Legislature and New York City Council to curb the use of facial recognition: by police (S5609/A1045), by landlords (A6363 and Intro. 425), by public accommodations (A6211 and Intro. 217), and to make permanent the ban on its use in schools (S3827/A6720). And while New York, the most surveilled city in the country, has the opportunity to lead the way, legislative protections against the risks of facial recognition must proliferate nationwide to fully protect our communities. The only way to completely prevent Trump—or any future authoritarian—from allowing this tech to do his and ICE's bidding is to prevent the use of facial recognition in the first place.
Because of the immense power of facial recognition to target political enemies and indiscriminately deport any of us, and because the system's racially biased inaccuracy is already causing wrongful arrests, banning facial recognition is an essential step toward preventing authoritarian overreach. The New York State Legislature can and should pass the Ban the Scan package of facial recognition bills, and the rest of the country should follow suit in protecting communities from this force multiplier for tyranny.

Election observers at the OAS voice serious concerns about Mexico's contentious judicial elections
MEXICO CITY (AP) — Electoral watchdogs at the Organization of American States expressed concern Friday over the low turnout in Mexico's historic and contentious judicial elections, recommending that countries in the Americas not follow its path. In a report, the electoral mission said the June 1 election was 'extremely complex' and 'polarizing,' and was marked by a 'widespread lack of awareness' among voters about what they were voting for and who the thousands of candidates were. In Sunday's vote, Mexicans elected 881 federal judges and another 1,800 state judges as part of a complete overhaul of the judiciary. The process was carried out following a constitutional reform approved last year by a Congress with a ruling-party majority. The overhaul fueled protests and criticism within Mexico and by the American and Canadian governments, which warned of a potential loss of judicial independence and the politicization of justice in Mexico. Mexican President Claudia Sheinbaum and her mentor and architect of the overhaul, former President Andrés Manuel López Obrador claimed they want to root out corruption in the judiciary, which most Mexicans agree is broken. Mexico's electoral authority said this week that voter turnout was 13%, significantly lower than the 60% turnout in last year's general elections. In the Friday report, the OAS mission — led by former Chilean Foreign Minister Heraldo Muñoz Valenzuela — expressed concern over 'the low level of citizen participation' and noted that 'this is one of the lowest turnout levels in the region.' Observers also pointed to the 'high percentage' of null and unmarked ballots, which exceeded 10%. 'It's necessary to carry out a comprehensive reflection on the nature of the (electoral) process and how it was conducted,' the report concluded. The OAS's 16-member observation mission also raised concerns about the nine candidates elected to join Mexico's Supreme Court who 'were promoted in physical and digital 'cheat sheets.'' While parties were not allowed to advocate for candidates, pamphlets known as 'accordions' guiding voters on which candidates to vote for were widely distributed. Mexican electoral authorities investigated complaints against the ruling Morena party and other opposition groups that distributed the voter guides in communities across the capital and other cities in the weeks leading up to the vote. The agency also ordered that a website featuring a digital cheat sheet with Morena-aligned candidates for the Supreme Court and other top tribunals be taken down. OAS observers also noted that six of the nine candidates elected to the high court had been nominated by the government controlled by Morena, and the remaining three were justices appointed by López Obrador, 'which raises reasonable doubts about the autonomy and independence of the highest court in relation to the Executive.' Given the findings, the mission concluded that 'it does not recommend this model of judge selection be replicated in other countries in the region.' Officers in Minneapolis raid wore distinct patches. One was authorized, another wasn't, feds say.
A patch referencing St. Paul on an ICE agent's uniform was authorized, but that wasn't the case for an ATF agent's patch that people noticed during a federal law enforcement operation in Minneapolis this week, the agencies said Friday. A U.S. Immigration and Customs Enforcement officer wore a circular patch on the arm of his uniform reading 'St. Paul Field Office Special Response Team.' Each of the 25 ICE Enforcement and Removal Operations Special Response Teams across the U.S. has a unique patch, an ICE spokesperson said Friday. The St. Paul patch is intended to depict an 'ancient Scandinavian warrior and a Vegvisir, or 'wayfinder,' and ties into the regional identifiers for Minnesota including a nod to the Scandinavian heritage of many of the early European settlers in Minnesota,' the spokesperson said in a statement. The imagery raised questions for some people. Brandon Schorsch, who took video of the patch and posted a photo of it on social media, wrote: 'I am deeply concerned about this patch.' The vegvisir has been co-opted by some far right extremist groups, according to a senior research analyst with the Southern Poverty Law Center's Intelligence Project, though more information has to be known about a person's intentions to determine the significance of the image in a particular use. The ICE patch 'is in no way an affiliation to an extremist group,' the agency spokesperson said. On Tuesday, a large federal law enforcement presence drew protests in South Minneapolis from people concerned it was an immigration raid. Officials from the FBI, ATF and the Department of Homeland Security gathered with tactical vehicles at the corner of Lake Street and Bloomington Avenue late in the morning. Minneapolis Mayor Jacob Frey said it 'was related to a criminal search warrant for drugs and money laundering and was not related to immigration enforcement.' It was one of eight search warrants 'for a transnational criminal organization,' according to Hennepin County Sheriff Dawanna Witt. He had an audible, 'Ohhh,' reaction on the video when he saw it. 'In my job, I do look out for things like this,' said Schorsch, who works as the combatting hate organizer for Jewish Community Action, though he was not there in his work capacity on Tuesday. The Southern Poverty Law Center says there are Neo-Völkisch groups that 'rely on a romanticized Viking aesthetic and mythos — imagery they use to perpetuate their belief in white racial superiority. This adaptable and covert messaging, anchored by a nationwide network of 'kindreds,' has allowed these groups to grow in recent years.' More people are on the lookout for symbols that may have nefarious meanings, Schorsch said. An ICE agent was seen last week in Martha's Vineyard, Mass., with a tattoo of a Valknot on his arm. The symbol is used in Norse mythology. 'Some white supremacists, particularly racist Odinists, have appropriated the Valknot to use as a racist symbol,' according to the Anti-Defamation League. Schorsch also saw two ATF agents on Tuesday with a small patch on their uniforms that said, 'The Others,' and he photographed one of them. The agent seen in the photo is an ATF special agent assigned to a sheriff's office taskforce, said Ashlee Sherrill, a spokeswoman in the ATF's St. Paul Field Division, in response to a reporter's questions. 'The patch in question is not an authorized part of the ATF uniform and has been addressed internally,' Sherrill said, adding that she couldn't provide further information on personnel matters. Ukraine hopes for Trump-Zelensky meeting in Canada during G7
President Volodymyr Zelenskyy intends to hold a meeting with U.S. President Donald Trump during the Group of Seven (G7) summit in Canada, Head of the Presidential Office Andriy Yermak said on air on June 6. The summit is scheduled to take place from June 15 to 17 in Kananaskis, Alberta. Yermak said the Ukrainian delegation's recent trip to Washington was aimed in part at arranging the high-level meeting between Zelensky and Trump. The Ukrainian delegation, led by First Deputy Prime Minister and Minister of Economy Yulia Svyrydenko, arrived in the U.S. on the morning of June 3. The delegation included senior officials from the Defense Ministry and the Presidential Office. During their visit, the Ukrainian officials are expected to engage with American counterparts on a wide range of critical issues, including ongoing negotiations in Istanbul, sanctions policy against Russia, and continued support for Ukraine amid Russia's full-scale war.
