A Special Protection of Children from Sexual Offences (POCSO) court in Mehsana district on Friday sentenced a 51-year-old man to rigorous imprisonment for life for repeatedly raping and impregnating his 17-year-old daughter by threatening to kill her and the rest of the family. Awarding the punishment to the accused in the case, the court held that the POCSO Act legislature could 'also not have a reason to think that any father can be an accused' under the Act.
Stating that the crime is 'unique and serious', the court said, '…this is a very unfortunate moment that this court had to try this case where an accused under POCSO Act is the father of the victim girl… This court has no words to describe its anguish against the heinous act of this accused… During the whole period of trial the body language of the accused was also observed by this court… no sign of sorrow or (repentance) was there… This court is speechless and really shocked to come across such a case.'
The prosecution's case was that in April 2024, the brother of the victim approached the Mehsana district police to lodge an FIR as the victim, who had been taken to a hospital after she complained of stomach pain, was found to be pregnant. The complainant informed the police that the victim had confided in him that her father had raped her and threatened to kill her and the rest of the family members if she complained about the incident. Accordingly, the accused was booked under Indian Penal Code sections for rape, criminal intimidation and under relevant sections of the POCSO Act.
'During deposition of the victim … she repeatedly said that she couldn't believe that her own father had raped her… Accused had threatened the victim. This court is really worried for the future of this victim girl.'
The court also awarded a compensation of Rs 5 lakh to the victim under the Gujarat Victim Compensation Fund.

Police arrested four persons for allegedly raping two minor cousins after luring them from a marriage function, in Odisha on Saturday. The accused abducted the minors on June 3 from the function and held them captive till June 4, after which they abandoned the victims in a secluded area. Police said that the victims returned on their own on June 5, following which their family members lodged a complaint. A case was registered under BNS Section 70 (gang rape) and Section 11 of the Protection of Children from Sexual Offences (POCSO) Act, that deals with sexual harassment. Following this, a manhunt was launched to arrest the accused. Berhampur SP Saravana Vivek M said that the four accused — all belonging to one village — were arrested when they were trying to leave the state. 'One of the victims was in touch with an accused through her mother's mobile phone. He lured the victims to an isolated place and gangraped them along with his three friends for two days,' said the SP. The police have recorded the statements of the victims and sent them to the child welfare committee for the necessary counselling. 'We will thoroughly investigate the case. We will request the court to expedite the trial and ensure maximum punishment to the accused,' the SP said.

Ahmedabad: An accused in a Pocso case escaped from police custody while being taken for a medical check-up at LG Hospital in the Maninagar area of the city on Saturday. The accused, identified as Jaysukh Vaghela, fled when a crowd gathered at the hospital following the death of another patient. Taking advantage of the chaos, he managed to slip away unnoticed. According to police, Vaghela was arrested on Thursday along with another accused, Valji Solanki, in connection with a Pocso case registered at Amraiwadi police station on May 31. Two more co-accused, both women, were arrested later. All four were to be produced in a special Pocso court after a mandatory medical check-up. On the day of the escape, the police team — a head constable, a male constable, and a female constable — took the accused to LG Hospital. While one constable went to park the vehicle, the remaining officers escorted the accused inside the trauma ward. During the check-up, a patient in the ward died, leading to an emotional outburst and crowding by relatives. In the commotion, Vaghela quietly moved away from the group and fled. A complaint in this connection was registered at Maninagar police station. A search operation was launched in and around the hospital premises, but the accused remains untraceable. Meanwhile, the remaining three accused have been sent to the jail. Senior officers have taken note of the incident and internal inquiries are underway to assess the lapse. Teams from Amraiwadi police and the City Crime Branch have been mobilised to locate and rearrest the absconding accused.

1 2 3 Kendrapada: Police detained a 15-year-old boy on Saturday for allegedly molesting a five-year-old girl in Jajpur district. The incident occurred on Friday evening when the minor was alone at her house. Investigation officer Anshumala Das said the accused, who lives in the girl's neighborhood, allegedly entered her house and sexually assaulted her. Hethreatened to kill her if she revealed the incident to anyone. The matter came to light when the girl informed her parents about her ordeal. The girl's mother subsequently filed an FIR at the local police station. "During interrogation, the juvenile confessed to the crime," said Das. The accused has been booked under various sections of BNS, including 329(4) (house trespass), 296 (obscene acts), and 351(3) (death threats). He has also been charged under Section 12 of the Protection of Children from Sexual Offences (Pocso) Act, 2012. The accused was produced before the Juvenile Justice Board (JJB) on Saturday, which rejected his bail petition and remanded him to the observation home in Angul. Legal expert Subash Nayak said that under the Juvenile Justice (Care and Protection of Children) Act, 2015, offenders below 18 years are treated with an emphasis on rehabilitation rather than punishment.
