US Rep. LaMonica McIver to be arraigned on assault charges stemming from immigration center visit
U.S. Rep. LaMonica McIver is set to be arraigned on federal charges Wednesday, accused of assaulting and interfering with immigration officers outside a New Jersey detention center during a congressional oversight visit at the facility. She has said she plans to fight the charges.
McIver, a Democrat, was charged in a complaint by interim U.S. Attorney Alina Habba, a Republican appointed by President Donald Trump, following the May 9 visit to Newark's Delaney Hall, a privately owned, 1,000-bed facility that Immigration and Customs Enforcement uses as a detention center.
This month she was indicted on three counts of assaulting, resisting, impeding and interfering with federal officials. Habba said two counts carry a maximum sentence of up to eight years in prison. The third has a maximum of one year.
McIver's lawyer, former U.S. Attorney for New Jersey Paul Fishman, said in a statement that she would challenge the allegations 'head-on' in court.
The indictment is the latest development in a legal-political drama that has seen the Trump administration take Democratic officials from New Jersey's largest city to court amid the president's ongoing immigration crackdown and Democrats' efforts to respond. The prosecution is a rare federal criminal case against a sitting member of Congress for allegations other than fraud or corruption.
During the same visit to the detention center, Newark Mayor Ras Baraka was arrested on a trespassing charge that was later dropped. Baraka is suing Habba over what he called a malicious prosecution.
A nearly two-minute video clip released by the Homeland Security Department shows McIver at the facility inside a chain-link fence just before Baraka's arrest on other side of the barrier, where other people were protesting. McIver and uniformed officials go through the gate, and she joins others shouting that they should circle the mayor.
The video shows McIver in a tightly packed group of people and officers. At one point her left elbow and then her right elbow push into an officer wearing a dark face covering and an olive green uniform emblazoned with the word 'Police.'
It is not clear from police bodycam video if the contact was intentional, incidental or the result of jostling in the chaotic scene.
The complaint alleges that she 'slammed' her forearm into an agent and then tried to restrain the agent by grabbing him.
The indictment also says she placed her arms around the mayor to try to stop his arrest and says again that she slammed her forearm into and grabbed an agent.
Democrats including New Jersey Reps. Bonnie Watson Coleman and Rob Menendez, who were with McIver at the detention center that day, have criticized the arrest and disputed the charges.
Members of Congress are legally authorized to go into federal immigration facilities as part of their oversight powers, even without notice. Congress passed a 2019 appropriations bill spelling out that authority.
McIver, 39, first came to Congress in September in a special election after the death of Rep. Donald Payne Jr. left a vacancy in the 10th District. She was then elected to a full term in November.
A Newark native, she was president of the Newark City Council from 2022 to 2024 and worked in the city's public schools before that.

McIver heads to court as watchdog group files complaint against Alina Habba
Rep. LaMonica McIver (D-N.J.) is expected to appear in federal court for the first time Wednesday morning on a trio of charges following a May scuffle outside a federal immigration facility. At her arraignment in Newark, McIver will plead not guilty, spokesperson Hanna Rumsey said. McIver is accused in a three-count indictment of slamming a federal agent with her forearm, 'forcibly' grabbing him and using her forearms to strike another agent. Allegations of physical violence by a sitting member of Congress are rare, with a handful of incidents including the pre-Civil War caning of a senator by a member of the House. McIver's allies, including two other Democrats who were with her during the incident, have decried the charges as political and have said she was roughed up by federal agents. Her allies are also trying to turn the tables on the federal prosecutor bringing the case, the interim U.S. Attorney for New Jersey, Alina Habba. The Campaign for Accountability, a liberal watchdog group, filed a complaint this week against Habba with the New Jersey Office of Attorney Ethics. The complaint alleges Habba has acted improperly since becoming a prosecutor and cites her actions in the McIver case, along with comments about turning 'New Jersey red' and announcing investigations into its Democratic governor and attorney general over immigration. A spokesperson for Habba did not respond to a request for comment. 'In an atmosphere where other oversight bodies are caving to political influence, the bar's duty to independently enforce these rules is ever more important,' the group's executive director, Michelle Kuppersmith, said. Habba, who represented Donald Trump in court between his presidencies, is already facing a lawsuit brought against her by Newark Mayor Ras Baraka, who was arrested for trespassing at the detention facility before the charges were dropped and a judge questioned Habba's judgment. When she first announced charges against McIver, Habba said she had 'made efforts to address these issues without bringing criminal charges and have given Rep. The watchdog group's complaint alleges it was improper to say the charges were contingent on McIver taking actions ordered and approved by Habba. Campaign for Accountability filed a similar complaint in New York against another federal prosecutor, Emil Bove, after he moved to drop charges against New York City Mayor Eric Adams. The New York attorney grievance committee declined to act and instead transferred the complaint to the Department of Justice. The charges against McIver are an extraordinary stress-test for the separation of powers at a time in which Trump is seeking to maximize executive branch dominance. In recent weeks, New York City mayoral candidate Brad Lander was handcuffed and arrested by federal agents while escorting migrants from immigration hearings and Sen. Alex Padilla (D-Calif.) was forcibly removed from a Department of Homeland Security press conference. Neither Lender nor Padilla have been charged with anything. The two Democrats who were with McIver outside the immigration facility — Reps. Bonnie Watson Coleman and Rob Menendez — have also not been charged. The three New Jersey Democrats have said they were at the immigration detention facility exercising their oversight duties and were roughed up by federal agents. Since their oversight visit, several detainees escaped and there were reports of poor conditions inside the facility, which the private company that runs the facility has denied. McIver appeared virtually at a previous hearing in May, after charges were filed but before a grand jury returned an indictment. She was allowed to appear remotely from Washington because Congress was in session. Since then, the indictment has put her case in front of U.S. District Court Judge Jamel Semper.

FIFA probes racism allegations by Real's Rüdiger at CWC match
FIFA has launched an investigation against Pachuca player Gustavo Cabral on suspicion of having made a racist remark against Real Madrid defender Antonio Rüdiger during the teams' match at the Club World Cup in the United States. The FIFA protocol has been activated and we support him. It's unacceptable and we believe what he said," Real coach Xabi Alonso said post-match. Cabral, 39, was quoted by Argentinian media as dismissing the allegations: "There was nothing racist. I called him a bloody coward, as we say in Argentina. That's all."

Crews scale back search for swimmer who went missing in a Knoxville quarry
The Knoxville Fire Department has scaled back its search for the swimmer who went missing June 14 at Augusta Quarry in Fort Dickerson Park. KFD transitioned the operation from a search to a recovery mission after five days. For over 80 hours, crews from KFD, the Knoxville Volunteer Rescue Squad, Tennessee Wildlife Resources Agency and the Blount County Rescue Squad coordinated their efforts, KFD spokesman Mark Wilbanks said. Teams used advanced underwater remotely operated vehicles, boats, sonar technology and shoreline sweeps to find the missing person. Knoxville police officers investigated the incident as well. 'We remain dedicated to doing everything we can to bring resolution to this situation,' Wilbanks said in a news release. Team are working to determine their next steps. The search began around 9 p.m. June 14, after the Knoxville Fire Department received reports of a swimmer who went underwater and did not resurface. The quarry was closed at the time for major upgrades, and KFD reminded anyone tempted to swim that it is "illegal and dangerous." The quarry is scheduled to open with a new pier and bathrooms at the end of the month. The Augusta Quarry is made up of two deep pits with a shallower saddle connecting them. It is especially deep, making it challenging for even expert divers to search. To reach the bottom of Augusta Quarry, a diver needs technical training with a breathing gas called trimix, a mixture of oxygen, helium and nitrogen.
