Muizenberg beach upgrades a major boost for Southern Peninsula property

The City of Cape Town is investing significantly in upgrades and refurbishment of the Muizenberg beachfront area, including improvements to the promenade, parking, Surfer's Corner, and heritage structures. These will have a significant impact on demand and further boost property in the area, according to Seeff Property Group.
Anton Liebenberg of Seeff False Bay says these will attract more tourists and increase the area's desirability for both residential and investment buyers. The area has experienced tremendous growth in sales and prices during the pandemic years, attracting a mix of residential and investment buyers, including Airbnb investors. New developments have also been popping up across the area.
The False Bay area is a popular weekend and holiday getaway. The train from Claremont to Kalk Bay is a key tourist attraction, as is the coastal drive that snakes around the peninsula to Cape Point. It is lined with eateries and quant art, antique and other boutique-styled stores. Other popular landmarks include Surfer's Corner in Muizenberg, the colourful beach huts of St James Beach, and the penguins of Boulders Beach in Simons Town.
The beaches are a big drawcard with both the Muizenberg and Fish Hoek being Blue Flag beaches. Residents are drawn to the laid-back coastal lifestyle and scenic location with the fynbos-covered mountains as a backdrop, and warmer sea, popular for swimming, surfing and paddling.
Liebenberg says the market has been good for sellers with properties selling quite fast as demand remains high, so much so that there is a shortage of properties for sale. He adds that there is in fact a waiting list of buyers wanting to relocate to the False Bay area, but sellers are seemingly holding onto their homes.

Property owners tend to stay for a long time, and most sellers only move for necessity such as downsizing due to empty nesting or relocating to retirement facilities, he says further.
Buyers, however, tend to be a mix, from young to old. These include families looking for a healthy lifestyle, or people moving from the Southern Suburbs to be closer to the sea. There has also been a notable uptick in international buyers according to Lightstone data, often because they have been exposed to the area as tourists, and they tend to stick to the tourist areas such as Kalk Bay, St James and Simonstown.
Liebenberg says that the area offers the perfect mix of an ideal seaside location and excellent value on offer. While some areas are becoming more expensive, you can still find good value in Muizenberg, Fish Hoek and Simons Town in particular, he says.
Apartments are a popular choice, often for holiday purposes or as Airbnb investments. These are priced upwards of R1.5m. Houses tend to be priced upwards of around R2m, but can go as high as R17m for a luxury home with stunning views in Fish Hoek.
False Bay is also very popular for rentals, often driven by school access and leisure attractions. Muizenberg is hugely popular with surfers looking for rental accommodation. Average rental rates are around R12,000 to R23,000 per month, but luxury homes and sea view properties can go well above this.
Tracey Reid-Daly, licensee for Seeff Southern Peninsula which covers Kommetjie, Noordhoek, Chapmans Peak and Scarborough, says these areas have also seen a notable uptick in demand and prices since the pandemic. Aside from locals moving here, there is also an influx of semigration buyers, as well as international buyers who fall in love with the area.
Noordhoek for example now boasts an average price of around R9m with most sales over R3m, according to Lightstone data. It is particularly scenic and renowned for its 8km Long Beach, one of the longest and widest in the Peninsula where horse riding is a popular sight. Most buyers tend to be in the 35-60 age group.
The average price for Kommetjie is around R6.3m, also with most sales over R3m, according to the Lightstone data, while 61% of buyers are under 50-years. Again, the scenic fynbos and mountain views, clean air, and laid-back lifestyle are key drawcards in the area.

Airbnb scams: New book explores thriving criminal activity on big tech platforms

Image: Freepik Big tech sharing economy platforms like Airbnb and Uber are marketed as trustworthy, but a new book by a South African media scholar argues that they are highly vulnerable to scammers who spread delusive speech (a form of disinformation, designed to deceive by criminal intent). Julie Reid draws from first-hand accounts and over 600 cases from around the world of victims lured into scams or physical danger by fake Airbnb reviews and listings, providing a detailed case study. How do the scams work? Airbnb is the world's largest accommodation-sharing platform. It connects property owners who want to rent out their homes with travellers looking for alternatives to traditional hotels. The company recently expanded its offering and now facilitates the booking of other services like personal trainers or caterers along with accommodation rentals. Airbnb scams happen in several ways. The most obvious is the phantom listing scam. The scammer constructs a fake but attractive listing on Airbnb and accepts payments from unsuspecting guests. It's only when guests arrive at the address that they discover the property doesn't exist. Scammers have also learnt to navigate around Airbnb's review system. Fake positive reviews are produced by scam host networks, making them appear to be authentic. Bait and switch scams are also common. Here the scam 'host' contacts the guest on check-in day claiming the reserved property is suddenly unavailable. They offer alternative accommodation, which the guest later discovers is not as good as the original property they've paid for (which is often fictional). The guest pays for a premium rental but is forced to stay in a property that might be unsafe, unclean, or missing amenities. Scam hosts use misleading, plagiarised, or AI-generated property images and fake descriptions along with fake personal profiles and aliases. Delusive tactics also redirect guests away from the secure Airbnb payment portal to alternative payment methods. The scammer disappears with the money. But the danger isn't limited to financial crimes. The platform's business model is premised on staying in a stranger's private property, which can put guests' personal safety at risk. Criminal hosts can lure targets into dangerous environments. Once checked in, guests are isolated from public view, housed in a property to which the host has access. I've assessed multiple cases where Airbnb guests were assaulted, robbed with no signs of forced entry, raped, murdered, made victims of sexploitation, extortion or human trafficking, or held hostage. I consider delusive speech a subset of disinformation because it presents intentionally misleading content at scale. But it differs from disinformation in its intentions. It isn't done to promote a particular cause or gain ideological, military, or political advantage. Delusive speech is motivated purely by criminal intent or nefarious financial gain. Delusive speech works by hiding in plain sight on platforms we think we can trust, like Airbnb, Uber and others. Often, it's indistinguishable from honest and genuine content. When users browse Airbnb listings for holiday accommodation, they're presented with numerous options. A fake property listing looks, sounds and feels exactly the same as a genuine one. This happens on a platform that has built its brand narrative around the concept of trust. Scammers exploit these digital contexts of pre-established trust. When users log on to popular e-commerce or sharing economy platforms, they're already primed to pay for something. It becomes relatively easy for scammers to delude targets into parting with their money. What can Airbnb do about it? Airbnb already has several trust and safety mechanisms in place. They include rapid response teams, an expert Trust and Safety Advisory Coalition and travel insurance for guests. The company claims to be trying to stop fake listings with machine learning technology. Sadly, none of these mechanisms work perfectly. While Airbnb promises to verify properties and host identities, my analysis exposes flaws in these systems. Scammers easily bypass verification tiers through aliases, forged documents and AI-generated material. Airbnb has admitted it needs to address the failures of its verification processes. My analysis uncovered how scammed guests are routinely denied the opportunity to post reviews of problematic rentals. Opaque terms of service and content policies allow Airbnb customer service agents and executives to justify censoring negative but honest guest reviews. This means dangerous and fraudulent activity goes publicly unreported and unreviewed, leaving future guests vulnerable. I argue that Airbnb's review curation mechanisms should be revamped according to internationally recognised human rights frameworks that protect freedom of speech. This would allow for more honest accounts of guest experiences and create a safer online environment. Perhaps the most common complaint I encountered was that Airbnb doesn't remove offending listings from its platform, even after a scammed guest provides evidence that the listing was posted by a fraudster. Airbnb must develop an urgent protocol for swiftly removing offending listings when discovered, to protect future guests from falling victim to the same scam trap. What can users do to protect themselves? Travellers can protect themselves by being extra cautious. Ask around. Seek recommendations from people you know and trust, and who can verify that the property you are booking actually exists and that the host is trustworthy. If that isn't an option, consider an established hotel instead, but book directly with the hotel and not via third party sites like where listings can easily be faked. Check on Google Street View to make sure the property is where it claims to be. Either way, have a Plan B in case things go wrong. Prepare ahead of your trip by deciding what you will do if you find yourself in an unsafe situation. And always, always, buy travel insurance.

While much is made of the high property prices in Cape Town, there are in fact still many areas where you can purchase below R1m. Properties below R1.21m are also exempt from transfer duty, thus providing a considerable saving, especially for first home buyers, according to the Seeff Property Group. The northern suburbs of Cape Town is a great area to look for affordability, says Susan McCarthy, manager for Seeff Brackenfell. These neighbourhoods offer good access to transport networks, schools, and general amenities. This combines with the affordability factor, making it easier for first time buyers to get onto the property ladder, securing their own home, and building wealth. If at a later stage they need to move on to a bigger property, it always leaves the option to retain the property as an investment, given the high demand for rentals, or they could sell it at a profit to use as a deposit for their next property purchase. She says neighbourhoods such as Kraaifontein and Kuils River are a good choice for good value as you can find sectional title property in the R700,000 to R1.2m price range. In Eerste River for example, the new Chardonnay Court offers two bedroomed units with modern finishes, a solar geyser, private outdoor braai area, and a parking bay for just R949,900. It is also a neighbourhood with good amenities and access to major routes with transport such as buses, taxis, and a train station on hand. There are schools, shopping centres, medical care, places of worship, a police station, sport grounds and more. The area is popular with first-time buyers. Lightstone data shows that 37% of recent buyers are under 35-years, and a further 44% between 36-49 years. Property values increased by around 70% over the last ten years, with a significant growth spurt during the high-demand Covid boom period, thus making these a good investment. She says they are also great for rental investments. Overall, first home buyers make up a considerable portion of total home sales across the country. According to mortgage originator, ooba, there has been a slight uptick in first-time buying in the first quarter, accounting for some 46.5% of home loan applications. The survey also shows that favourable mortgage lending conditions continue to support first-time buyers, and most banks still offer full bonds to qualifying buyers, depending on the property. Young buyers are not only purchasing for their own use, but there is a growing appetite to invest in property for the rental market. Choosing a family member as an executor can lead to conflicts of interest and mismanagement of an estate. And this is what often happens when a family member has a role to play when it comes to devolving assets for a deceased estate when they have been appointed as executors. Several court cases deal with misdeeds or conflicts of interest by family members of someone who has died and are then in a position of power when it comes to wrapping up the dead person's estate. In one, a gentleman called Ronnie died and appointed his life partner, Susanna, and his tax practitioner as co-executors. Ronnie's son, Sean, and Susanna were set to inherit his estate in accordance with Ronnie's will. This is not illegal. Capital Legacy explained that it is possible for someone to both be a beneficiary and executor of a will and, in fact, there are times when this makes practical sense. It said that, however, when family or friends are appointed, a co-executor is also appointed. Appointing a professional also means there's a safety net because, if they become incapable of doing their duties, should they, for example, also die, there will be a contingency plan in place as someone else from their business can take over. Sean felt the estate was being mismanaged and, so, went to the Cape Town High Court asking that the executors be removed and the Master replace them. He argued that the two executors, especially Susanna, had a conflict of interest because she couldn't be fair when she was set to benefit. According to Sean, he had been trying for some time to get the relevant financial documents from the executors and hadn't received them. He also told the court he had asked the Master of the High Court for assistance, without success. The Master of the High Court is meant to ensure that the process is carried out according to the Administration of Deceased Estates Act and the will's stipulations. Detailed in the ruling is a key matter: a dispute between Sean and Susanna as to whether an AirBnB was part of Ronnie's estate. Susanna argued, with the tax practitioner supporting her, that Ronnie intended her to have the AirBnB so she could generate income and 'cease her 30-year-long transcription services work which had become increasingly burdensome,' as the ruling said. The rather lengthy court ruling concludes with granting Sean an order that Susanna and the tax practitioner are 'hereby removed as executors of the deceased estate' and the Master had 30 days to appoint a new executor. As part of the ruling, the judge said that Susanna and the tax practitioner had to provide detailed documentation regarding their administration of the estate, including income and expenses, as well as assets. Wayne Mostert, MD of ASI Wealth, explained that 'the court found that Susanna, being both a beneficiary and executor, was in a position where her personal interests unduly influenced her ability to act impartially in administering the estate. This conflict of interest, coupled with concerns about transparency and documentation, contributed to her removal.' What also concerned the court, said Mostert, was that 'the tax practitioner aligned herself with Susanna,' which 'undermined her objectivity and cast doubt on her ability to act in the best interests of all beneficiaries'. As PM Attorneys explained in a blog, executors could 'make decisions that personally benefit them'. Mostert said this had also been ASI's experience. The sad reality is that cases like these are not isolated, said Mostert. 'Emotions run high during the winding up of estates, and appointing family members as executors often leads to tension, suspicion, or outright disputes, particularly where significant assets or families are involved,' he said. PM Attorneys advised that executors who are beneficiaries should be cautious to maintain impartiality and fairness in estate administration. 'Executors must act in good faith, following the instructions in the will and in accordance with South African law,' it said. To mitigate such issues, the law firm advocates for the executor to be transparent, a viewpoint with which Mostert concurs. Or better yet, appoint an independent professional. Independent executors are held to fiduciary standards and are legally obligated to act in the best interest of the estate, said Mostert. 'They have systems in place, the necessary experience, and no emotional involvement, which allows them to carry out their duties objectively and in line with legal requirements,' he said. Transparency is crucial in estate administration, noted Mostert. 'It builds trust, reduces the likelihood of disputes, and ensures that beneficiaries feel respected and informed throughout what is often a very difficult time,' he said. Mostert explained that estate planning is not just about writing a will: 'It's about putting the right structures in place to protect your legacy and ensure a smooth transfer of assets.' Aspects that could lead to a conflict of interest: Disagreements among beneficiaries Other beneficiaries might think the executor is making decisions in their own favour rather than equally considering everyone's interests, which is especially common with larger estates. 2. Allegations of mismanagement or fraud Claims of mismanagement or fraud can result in extended legal proceedings, to the detriment of all parties. 3.
