Man fined RM10,000 for illegal taking subsidised LPG out of Sarawak
LAWAS: A 55-year-old man from Ba'kelalan has been fined RM10,000, in default 10 months' imprisonment, for illegally attempting to transport subsidised liquefied petroleum gas (LPG) out of Sarawak.
Dison Sakai pleaded guilty before the Limbang Sessions Court on Thursday (May 22) to an amended charge under Section 20(8) of the Distribution of Gas Ordinance 2016.
The offence was committed on April 22 at around 1:30pm at a premises in Kampung Punang Kelalan, near the international border in Ba'kelalan.
Dison was caught attempting to transport 30 cylinders of subsidised 14kg LPG without a licence issued by the Gas Supply Sarawak director.
He had been operating the business using only a general trading licence issued by the Lawas district office.
Defence counsels Eunice Ding and Joshua Baru told the court that this was their client's first offence and that he was remorseful.
He had also expressed commitment to apply for the necessary licences in compliance with the ordinance, noting that the issuance of such licences had previously been under the purview of the Domestic Trade and Cost of Living Ministry.
Deputy public prosecutor Ronald Felix Hardin submitted that Dison's actions had undermined Sarawak's regulatory control over its oil and gas industry, particularly with the sale of subsidised LPG to foreign nationals.
Several enforcement officers from the Sarawak Premier Department and the Sarawak Utility and Telecommunication Ministry were present during the court proceedings.
Judge Monica Linsua imposed the sentence after considering public interest factors. Dison paid the fine.
Separately at the same court, Judge Monica also granted an application for the disposal of four seized LPG cylinders.
The application, filed by the Utility and Telecommunication Ministry Sarawak under Section 23A of the Distribution of Gas Ordinance 2016, was in relation to cylinders confiscated on 22 April 22 near the Ba'kelalan border. No claims had been made for the items since the seizure.
Earlier this year, reports emerged of subsidised LPG being sold for as much as RM90 in Sarawak's highlands and up to RM150 across the border.

In a joint statement today, DAP chairman Gobind Singh Deo and secretary-general Loke Siew Fook also urged Dusuki to review the decision by the Attorney-General's Chambers to classify the investigation into Teoh's 2009 death as requiring no further action, or NFA. Advertisement 'The attorney-general, and no one else, has the discretion to prosecute under the Federal Constitution,' they said. 'He must explain why he is unable to do so in this case, particularly in light of the decisions of the Court of Appeal and civil proceedings in the High Court.' Gobind and Loke said DAP has been consistent in its call for action to be taken against those responsible for Teoh's death. The statement follows a letter dated May 30 from Dusuki to the family's legal representative, Ramkarpal Singh, seeking to explain the AGC's rationale for classifying the case as NFA. Advertisement In the letter, Dusuki said there was 'insufficient evidence' to support a criminal prosecution. Teoh died on July 16, 2009 at the fifth floor of Plaza Masalam in Shah Alam after being questioned for hours by the Selangor Malaysian Anti-Corruption Commission headquarters. Last month, police informed Teoh's family that their latest investigation into the case had been classified by the AGC as NFA. On Nov 21 last year, the High Court directed the police to complete their long-delayed investigation into Teoh's death. At an inquest, the coroner returned an open verdict. However, the Court of Appeal ruled in 2014 that the death was caused by 'one or more persons unknown', including MACC officers. In 2019, police launched an investigation under Section 342 of the Penal Code for wrongful confinement. Before 2018, two special investigation teams had been set up – one in 2011 and the other in 2015 – to look into the incident, but both cases were classified as NFA by the public prosecutor. Gobind and Loke noted that DAP assisted Teoh's family in a civil suit which resulted in the government and the MACC admitting liability for negligence leading to Teoh's death. An award of RM600,000 was made to the family, with costs of RM60,000. They said both the findings of the Court of Appeal and the civil court provided a basis for the police to conduct further investigations into the search for the perpetrators behind Teoh's death. 'While the duty to investigate the case and to identify those responsible in this case is with the police, it is for the attorney-general to decide his next step based on the police's investigations,' they said. Noting that Teoh's family is considering challenging the NFA in court by way of judicial review, Gobind and Loke said they support the action. TH Travel denies link with fake haji package programme
TH Travel & Services Sdn Bhd (TH Travel) has denied it's connection with a fake programme known as 'Program Haji Infaq Masyarakat' which allegedly offers TH Travel-managed hajj packages priced at RM123,990 with an initial payment of as little as RM10,000. TH Travel, in a statement, said the company has never appointed any individual, external company or business entity to promote, manage or receive payment on behalf of TH Travel for any hajj or umrah packages. The statement said that as a hajj and umrah travel agency registered and fully regulated by the Lembaga Tabung Haji (TH), all payments related to registration and deposits for hajj packages operated by TH Travel can only be made through TH's official account. 'TH Travel does not offer subsidised or externally sponsored packages that require pilgrims to pay into unofficial or individual accounts. 'TH Travel is not involved in any form of fundraising through cleaning companies, cake businesses or third party intermediaries,' the statement said. TH Travel takes seriously the misuse of the company's name and reputation to deceive Muslims intending to perform the Hajj pilgrimage. DAP backs judicial review on NFA over Teoh Beng Hock case
KUALA LUMPUR: DAP has voiced its support for the family of the late Teoh Beng Hock in seeking a judicial review against the Attorney General's decision to classify the case as 'no further action' (NFA). In a joint statement posted on the party's Facebook page on Sunday (June 8), DAP national chairman Gobind Singh Deo and secretary-general Anthony Loke said Attorney General Tan Sri Mohd Dusuki Mokhtar must explain in detail why he believes there is insufficient evidence to prosecute anyone over Teoh's death. 'We have been informed that action is being considered to challenge the decision of the NFA in court by way of judicial review by the family of Teoh Beng Hock. 'We support this action and also call upon the Attorney General to review his decision and push ahead with charges against those responsible for Teoh Beng Hock's death without further delay,' it said. According to the statement, the Attorney General had classified the case as NFA on May 21, following the submission of investigation papers by the police, and later wrote to the family's lawyers on May 30 explaining the decision. The party also noted that the Court of Appeal had earlier found Teoh's death to be the result of 'an unlawful act or acts of persons unknown, inclusive of Malaysian Anti-Corruption Commission (MACC) officers who were involved in the arrest and investigation of the deceased.' In a related civil suit, the government and MACC had admitted liability for negligence leading to Teoh's death, and a compensation of RM600,000 with costs of RM60,000 was awarded to the family. DAP stressed that while the responsibility to investigate lies with the police, it is the Attorney General alone who holds the constitutional discretion to prosecute. 'He must explain why he is unable to do so in this case particularly in light of the decisions of the Court of Appeal and civil proceedings in the High Court,' it added. Teoh, the political secretary to former Seri Kembangan assemblyman Ean Yong Hian Wah, was found dead at the age of 30 after giving a statement at the MACC office on the 14th floor of Plaza Masalam in Shah Alam, Selangor on July 16, 2009.
