
Rs 1.6 Crore Fee, 2G Spectrum Scam Clauses For Starlink's Entry To India

Elon Musk's satellite communication company Starlink will pay a non-refundable fee of Rs 1.6 crore and will likely be issued a licence by mid-June to begin its operations in India, sources have told NDTV Profit.
The venture is required to submit performance and financial bank guarantees totalling over Rs 1.20 crore and adhere to legal clauses focused on accountability and national security, the sources added.
The Letter of Intent (LoI) issued to Starlink in early May, has details of the terms and conditions as well as security guidelines that global Satellite communication companies must follow.
Sources also tell NDTV Profit that Starlink's Global Licensing Head, Parnil Urdhwareshe, is currently visiting Delhi for a meeting with top DoT(Department of Telecom) officials to review the final leg of their India project.
"The document (LoI) acts as a full-spectrum legal shield. Even if there's no direct link today, the government has left room to act if something surfaces later," a senior official said on condition of anonymity.
The LoI, issued by the Department of Telecommunications and reviewed by NDTV Profit, outlines a comprehensive set of obligations designed to ensure "control, accountability, and a loophole-free entry" into India's telecom ecosystem.
According to the document and sources, the non-refundable entry fee includes the company's authorisations under the Unified Licence for GMPCS, VSAT, and ISP-A services, to enable it to provide its services across India. Besides, the performance and financial bank guarantees will ensure the company meets its rollout and service obligation.
Failure to comply with the requirements will allow the government to invoke the guarantees and recover the amount directly from the bank, the document and sources said. The licence can also be revoked at any point if any disclosure is found to be false or misleading, they added.
Apart from financial conditions, the LoI has also listed several clauses for the deal with the satellite venture.
Starlink will need to clear all dues, not just for itself but for any affiliate, sister concern, or associated company that may have been connected to operators whose licences were cancelled under the Supreme Court's 2012 2G spectrum verdict, the sources said.
On February 2, 2012, the top court quashed 2G spectrum licences given to various firms during the tenure of A Raja as the telecom minister in January 2008. The Central Bureau of Investigation claimed there was a loss of Rs 30,984 crore to the exchequer during allocation of the licences.
Although, Starlink is yet to receive the final unified licence for operations in India, sources suggest the Musk-run company is likely to issue the document by mid-June, provided all conditions are fulfilled.
Starlink plans to roll out its first phase of infrastructure within six to seven months of obtaining government approval, including setting up over 27 ground gateways across three strategic locations in the country. A gateway is the bridge operating from an 'Earth station'; it links the user to the internet, enabling delivery of high-speed internet by connecting the satellites to the global internet infrastructure.
Earlier, sources said the satellite-based internet service provider will begin operations in India by offering 600 to 700 Gbps or gigabytes per second of bandwidth.
On Tuesday, Union Communications Minister Jyotiraditya Scindia said the country is eager to welcome players like Mr. Musk's Starlink.
"Just like in civil aviation, or in the telecom service provider space, or in the ISP space or the fixed wireless access space, my job is to ensure that I provide choice to the consumer. And India is ready for SATCOM service delivery. All players across the world are welcome. As long as they comply with our regulations, they check the boxes and are ready to perform business in India, all are welcome in India," he told NDTV Profit.

Piyush Jain case: Court dismisses accused application, hearing on July 4
1 2 Kanpur: Special chief judicial magistrate Kanpur Nagar Kumud Lata Tripathi on Friday dismissed the application of accused Piyush Jain and Sunil A Hirani in the much-publicised case in which the GST department had recovered approximately Rs 195 crore cash and gold bars weighing around 22 kgs. The DGGI Ahmedabad had raided perfume trader Piyush Jain's houses situated at Anandpuri Kanpur and Kannauj on December 21, 2021. The department had seized Rs 196 crore in cash and 23 kg gold from his possession. Piyush was ultimately arrested on December 27, 2021. He was bailed out after about eight months. The prosecution had made thirteen other persons accused apart from Piyush. All are currently on bail. Both accused had previously applied for the case diary and other documents as per provisions of the Cr PC which was strongly opposed by the prosecution. According to Ambrish Tandon, special prosecutor for DGGI Ahmedabad, the accused applicants pressed their demand on last date while he submitted that CD/DVD containing 479 to 11,455 pages of the charge sheet had already been provided to the counsel of Sunil A Hirani and the same had also been provided to Piyush Jain on October 20, 2023. Therefore, the court should dismiss the application of Hirani and Piyush Jain. The court, which had reserved its order on the previous date, delivered the verdict and dismissed the accused applicants' plea. The magistrate in her order observed that since all documents had already been delivered by the prosecution to the accused, there was no reason to deliver them again. The application was viewed as a tactic to delay the trial and thus was dismissed. The next date was fixed as July 4 for hearing. Tandon informed that the prosecution would now present its evidence. Under this campaign, farmers are being informed about the latest agricultural techniques, improved seeds, modern farming methods and govt schemes for Kharif crops. This campaign has been started on the initiative of the govt of India and is being operated with the cooperation of the institutes of Indian Council of Agricultural Research, Krishi Vigyan Kendras, Agricultural Universities, Horticulture, Animal Husbandry, Fisheries, and Cooperatives. Chief Minister Yogi Adityanath launched this campaign in UP on May 29. Lawyer bail plea rejected in 2.6cr cheating case
Mumbai: Observing that if this court exercises discretion in favour of applicant it will give a wrong message to society, a sessions court on Monday rejected the bail plea of advocate Vinaykumar Khatu, who is accused of defrauding a Delhi-based 74-year-old woman, a client, of Rs 2.57 crore by allegedly presenting her with forged orders purportedly issued by Bombay high court. "This court cannot ignore the antecedent of applicant. Admittedly, two offences were registered against applicant for misrepresenting himself as an IAS officer. If this court exercises discretion in favour of applicant, it will give a wrong message to society. The seriousness of allegations and antecedent of applicant prevent me from exercising discretion in favour of applicant," sessions judge VG Raghuwanshi said. The judge also said that if one decides to rely on WhatsApp chat then he cannot ignore that accused had stated about stay granted by honourable high court in his chat with the accountant and it is also clear that huge amounts were transferred to the accounts of his friends, associates and him after the date of fabricated orders. The accused was a lawyer of the woman, Urmila Talyarkhan, who was involved in a property dispute relating to a land in Alibaug. After a lower court ruled against her, Talyarkhan appealed the decision to the district court. Her advocate failed to appear for the hearing, leading to the dismissal of the appeal on Mar 13, 2018. Residing in Delhi at the time, she remained unaware of this dismissal until 2022, as her advocate did not inform her. Khatu allegedly charged an exorbitant fee of Rs 10 lakh per case. She allegedly transferred Rs 2 crore from her friend's account to those associated with the accused. Following Khatu's advice, she filed a second appeal in Bombay high court, with applications for condonation of a four-year delay and a stay order. Denying the allegations, the accused said that he was arrested on Oct 19, 2024. "Nothing needs to be seized from him. There is no possibility of tampering evidence," the lawyer submitted.
