Colonel assault case: HC rejects Punjab Police inspector's anticipatory bail

Chandigarh, The Punjab and Haryana High Court on Friday rejected the anticipatory bail plea of Punjab Police inspector Ronnie Singh Salh in connection with the assault case of Army Colonel Pushpinder Singh Bath in Patiala more than two months ago.
Colonel Pushpinder Singh Bath had accused 12 Punjab Police personnel of assaulting him and his son over a parking dispute in Patiala outside a dhaba in March.
Bath had then alleged that the assailants four inspector-rank officers of Punjab Police and their armed subordinates attacked him and his son without provocation, snatched his ID card and mobile phone, and threatened him with a "fake encounter" all in public view and under CCTV camera coverage. The colonel suffered a broken arm, while his son had a cut on his head in the incident.
"This vile, uncivilised, pitiless and brutal way is not the manner in which a police force ought to behave with its people, anywhere, and especially, in a democratic country like ours," Justice Anoop Chitkara observed in his order.
This horrific, "gut-wrenching incident" showcases the complete misuse of police power by these officers, he said.
"...Even if it is hypothetically assumed that the victims had wrongfully parked their car on the roadside, still the job of a law enforcement officer is to issue a challan to that motor vehicle which has violated any such law.
"It is not the job of any trained law enforcer, skilled in the efficient use of force continuum to mete out unmerciful, furious beatings to a common man on the drop of the hat and disrespect civilians, wielding their authority to disregard and disrupt law and order themselves," Justice Chitkara observed.
It appears that this was an unfortunate case of gross misuse of emergency powers under the Police Act, the order reads.
The judge said in his order that the prime duty of the police is not to instil fear in the minds of public using unwarranted force but to secure observance of law and order and to bring that goal to fruition, a prerequisite is adherence to and respect for legal framework itself.
"It is common knowledge that the majority of the people, especially the poor, downtrodden, and illiterate, have been deeply conditioned to be afraid of the police, harbouring a fear of them in the hearts of hearts. It is behaviour like that as seen in the present case, exhibited by a thin minority of officials, which inspires such fear and terror and is exemplary of incidents fuelling such narratives," he observed.
On the contrary, the purpose of the police force is to impartially, without fear or favour, and without biases, take care of its people, with sensitivity, affection, empathy and kindness on the one hand; while being firm, honest and astute on the other, using reasonable force when it is inevitable to control hooliganism, he said.
The Punjab and Haryana High Court had in April directed Chandigarh Police to probe the case and also issued directions to complete the investigation within four months. Colonel Bath had sought transfer of the probe to the CBI or another independent agency.
Punjab Police lodged a fresh FIR based on Colonel Bath's statement a week after the alleged incident.
Justice Chitkara, in the order on Friday, observed that the complainant's case is that, despite informing the police officers of his identity as a colonel in the Indian Army and showing his identity card, the police officers did not stop with their thrashing, which further highlights the high headedness, cruelty, arrogance and lack of any empathy of the police team.
"Such conduct of the police team in brutally beating an individual, even after being made aware that he was a serving member of the armed forces reflects the mindset of some of the police officers in this part of the country.
"We must not forget so early that this region is closer to a hostile border, has a history of militancy, and is still battling cross-border narco terrorism," he observed.
The court also called for a thorough investigation by a senior-level officer not less than the rank of an SP into the delay in registration of an FIR on the victim's complaint.
"...If the police officers display such brutality, high handedness and disrespect towards the members who belong to our esteemed defense services, such a reprehensible conduct would certainly be against the whole nation and may even imply that such officers would be happy to serve any ruler, which defies the entire purpose for which a democracy would give them so much power in the first place".
There is no doubt that the petitioner and his accomplices were the aggressors who started assaulting the complainant and his son on a parking issue, simply because the manner in which they demanded complainant party's car to be moved was objected to by the latter, the order says.
"A perusal of the bail petition and the documents attached prima facie points towards the petitioner's involvement and does not make out a case for anticipatory bail. The impact of crime would also not justify anticipatory bail...", the judge observed, rejecting the anticipatory bail plea.

Jaipur: In a shocking incident, Army Havildar Vikram Singh (40) was allegedly beaten to death by two youths in Palota Ka Bas village, under Surajgarh police station limits in Rajasthan's Jhunjhunu district. The incident was reported late Tuesday night as the jawan was leaving home to rejoin duty. According to police, Vikram Singh, who was serving in the 18 Raj Rifles and posted in Abohar, Punjab, had come to his native village on leave on June 7. As per the complaint filed by his brother Vinod Kumar, Vikram left for duty on Tuesday night, but was intercepted on the way by two local youths in a Scorpio SUV. The accused allegedly forcibly took Vikram to their house, where they brutally assaulted him. Later, they dumped him outside their home in a critical condition. Upon receiving information, the victim's family rushed to the spot and took Vikram to the hospital, where doctors declared him dead. Station Officer Hemraj Meena confirmed that a case of murder has been registered based on the family's complaint. Two suspects were detained on Wednesday for questioning, and police are currently analysing their mobile locations, call records, and other electronic evidence to ascertain the motive behind the killing. Sources indicate that Havildar Vikram Singh was nearing retirement, with just one year of service left. The incident has sent shockwaves across the village and armed forces community, as the police continue their probe to ensure justice for the slain soldier. Police station officer Hemraj Meena said that a case of murder has been registered on the complaint of the family, and two youths have been detained and are being questioned. Mobile location, call details, and other electronic evidence of the accused are also being investigated regarding the murder.

Punjab & Haryana HC grants bail to man accused of rape on pretext of marriage

Chandigarh, The Punjab and Haryana High Court has granted bail to a man accused of rape on the false promise of marriage observing "a no strings attached" equation between him and the complainant couldn't be ruled out. Justice Vinod S Bhardwaj's bail order noted that the man and the woman worked in the same company and the transcript placed on record by the petitioner indicated a "long standing cordial relationship" aside from the possibility of the "relationship being without any commitment and with no strings attached" couldn't be ruled out. The Badshahpur Police Station in Gurugram booked the man on February 21 under Sections 69 and 351 of the Bharatiya Nyaya Sanhita, 2023. It came on record that the man was the woman's senior at work and they met in April 2024. The petitioner was alleged to have promised to marry the women and lured her to have sexual relations with her. In January, when the woman reportedly asked him to marry, he declined, prompting the her to approach the police. It also came on record that she had conceived during their relationship and suffered a miscarriage due to stress and weakness. The petitioner's counsel argued his client was "maliciously" accused of rape and claimed before the registration of the FIR, an investigating officer was appointed on the woman's complaint made on January 15. The statements of the parties were recorded by the inquiry officer, who recorded a finding that they were "co-workers" and "good friends" for the last 10 months and were in a consensual relationship and no coercion was used to establish sexual relations, the counsel argued. It further came on record that the complainant made a second complaint before the ACP Gurugram in February which became the basis of the FIR following which the man was arrested on April 17. Interestingly, the man's counsel argued that the complainant was aware of the fact that his client was already in a 12-year relationship with another woman and there was no assurance, commitment or allurement on his part to enter into any matrimony with the former. He placed on record a purported conversation between the petitioner and the complainant in which she acknowledged their relationship began with no assurance, allurement, inducement or promises. Relaying on the recording, the counsel claimed she threatened him of not leaving him till she married to somebody else. "It is also noticed from the transcripted conversation that the complainant has expressed her obsession about the petitioner and has threatened that she would not allow him to marry anybody else till such time she herself gets married to anybody else and settle in her life," the court noted. As seen from the recording, the court said, the woman was aware of the man's relationship with another woman with whom he had contemplated to tie the knot, but threatened to expose him in front of the other woman. "Even though it is a selective extraction of the conversation that had taken place between the petitioner and the prosecutrix complainant, it shows that the allegations as levelled by the complainant may prima facie give strength and force to the suggestion of the petition that there was an element of free volition and no commitment," the court said. The court further referred to the initial police inquiry concluding that it was a consensual relationship and did not attract the rigors of the offence of rape. "Even if the allegation of the complainant getting pregnant as a result of relationship with the petitioner is prima facie accepted, it is not disputed that there was no role of the petitioner in termination of the foetus. Be that as it may, the pregnancy may at best be a proof of physical intimacy between the parties, which such fact is also not disputed or denied by the petitioner herein," the order said. The judge added, "The criminality in the instant case is not due to physical intimacy but as to whether such sexual relationship was sought on the deceitful premise of getting marriage or not." The offence required to be established, the court held, must precede the relationship between the parties. "The contemporaneous evidence does lean to some extent in favour of the petitioner as well, however, the actual assessment thereof is to be done at the stage of trial," the order read. Refraining from commenting further, the court said the investigation was complete and had culminated into a chargesheet whereas the trial would take considerable time. "The petitioner has also undergone an actual custody of 1 month and 16 days and does not suffer from any criminal is ordered to be admitted to regular bail subject to his furnishing bail/surety bonds..," the court said.
