Kuching man pleads not guilty to attempted murder after allegedly trying to ram cops with 4WD
KUCHING, April 23 — A 41-year-old man pleaded not guilty in the Magistrates' Court here today to the attempted murder of two policemen using a four-wheel-drive (4WD) vehicle last month.
Magistrate Mason Jaro Lenya Barayan fixed May 26 for pre-trial case management before releasing Mark Lionel Micheal on RM3,000 bail with one surety.
Mark allegedly committed the offence framed under Section 307 of the Penal Code at Jalan Green here between 3.30am and 3.40am on March 29.
According to the investigation, Mark allegedly drove his 4WD vehicle at speed towards policemen on duty on the road.
In a separate courtroom, Mark was also charged under Section 186 of the Penal Code for obstructing policemen in the discharge of their public functions.
Magistrate Ling Hui Chuan ordered for him to be released on RM2,000 cash bail with one surety after fixing May 27 for pre-trial case management.
According to the charge, Mark allegedly obstructed policemen on duty by refusing to stop his vehicle when asked to and instead attempting to escape from police on pursuit at a Jalan Green bus stop.
Mark was represented by defence counsel Andrew Winston Kaya, while the prosecution was handled by Insp Nur Shafiqa Nyaie Ilin.
On April 7, passengers Rogers Diana, 42, and Desmond Naud, 35, who were Mark's passengers in the 4WD vehicle, were each sentenced to eight months in jail after they pleaded guilty to obstructing policemen from discharging their duties.
In a statement on March 30, Kuching acting police chief Supt Merbin Lisa said three men, aged 39, 41, and 43, were arrested after attempting to flee from a police chase in a 4WD vehicle on Green Road during the wee hours of March 29.
He said the driver of the 4WD attempted to ram a patrol vehicle with three police officers inside, prompting one of the officers to fire a shot at the vehicle and causing it to crash.
Merbin said the gunshot hit the 41-year-old suspect and he was sent to hospital to receive treatment.
According to him, all the suspects, two of whom had prior drug-related criminal records, tested positive for drugs. — The Borneo Post

Lorry driver fined RM6,000 for reckless driving, causing property damage
JOHOR BARU: A sand lorry driver was fined RM6,000 after pleading guilty in the Johor Baru magistrate's court today to driving recklessly and causing damage to several public properties along Jalan Johor Baru–Gelang Patah Pendas, in Iskandar Puteri, last Tuesday. The accused, Chew Ah Sing, 69, entered the plea before Magistrate Nur Fatin Mohamad Farid after the charge was read out in Mandarin by the court interpreter. According to the charge sheet, Chew had driven the sand lorry on a public road without due care and attention, with the rear bucket left raised, causing it to strike overhead electrical cables. The incident resulted in damage to the cables, three electricity poles, a traffic light pole, a closed-circuit television (CCTV) camera, and a bus stop. The offence was committed at Kilometre 30.7 of Jalan Johor Baru–Gelang Patah Pendas at around 3.20pm on June 10. The charge was framed under Section 43(1) of the Road Transport Act 1987 (Amendment 2020), which carries a penalty of up to 12 months' imprisonment and a fine of not less than RM5,000 and not more than RM10,000. For a second or subsequent offence, the punishment may include up to 12 months' imprisonment and a fine of not less than RM10,000 and not more than RM15,000. In such cases, the offender's driving licence will be endorsed by the court, and a probationary licence may be revoked upon conviction. Deputy Public Prosecutor Amirah Tasnim Saleh prosecuted the case. In mitigation, the senior citizen, represented by lawyer Sharmaine Fairuz Mohd Zulkifli from the National Legal Aid Foundation (YBGK), pleaded for a minimum sentence, citing his monthly income of RM2,000 and financial responsibility for his wife, mother, and school-going child. However, Amirah Tasnim urged the court to impose a fitting sentence, as the accused's actions had caused damage to multiple public properties. The court imposed a RM6,000 fine, in default four months' imprisonment, and endorsed Chew's driving licence. On the day of the incident, media reports stated that a sand lorry with its rear bucket still raised struck overhead power lines, causing three electric poles to fall near a school. A video of the incident, recorded around 3.20pm and widely shared on social media, showed the lorry hitting the cables before the poles came crashing down. Iskandar Puteri district police chief Assistant Commissioner M. Kumarasan was quoted as saying that the driver claimed he was unaware that the rear bucket had not been lowered.

Trader allegedly assaulted by royal family member at Kuantan nightclub
KUALA LUMPUR: Police are investigating a case involving a trader who was allegedly assaulted by an individual believed to be a member of the Pahang royal family at an entertainment outlet here last month. Kuantan district police chief, Assistant Commissioner Wan Mohd Zahari Wan Busu, said a report was lodged on June 5, although the incident is believed to have occurred in May. He said police have recorded statements from all parties involved. "The case is being investigated under Section 324 of the Penal Code for voluntarily causing hurt with a weapon. The investigation paper will be referred to the Deputy Public Prosecutor soon," he said. A police report, which has since gone viral, alleged that a 30-year-old trader was assaulted by a bodyguard, and that the royal figure also stabbed him. The incident allegedly took place at a nightclub on Jalan Gambut here on May 8.
