Another Day, Another Attack On Workers' Rights - Employers Can Dock Pay Of Workers Who Take Partial Strike Action

The Government's anti-worker agenda has stepped up with the passing into law last night the right for employers to dock the pay of workers who take low level strike action.
The Employment Relations (Pay Deductions for Partial Strikes) Amendment Bill allows employers to deduct 10% of a worker's wage for partial strike action such as not performing a task.
"It's clear what the agenda is here, this Government wants to give employers even more tools and power to keep wages down and profits high," said Fleur Fitzsimons National Secretary Public Service Association Te Pūkenga Here Tikanga Mahi.
"The new law is all about weakening the position of workers when involved in collective bargaining that becomes difficult to settle.
"There are already only a small range of tools available to workers when negotiations fail. "Every time the Government takes away one of those tools, or puts a price on using them, the power imbalance gets worse, and workers pay the price.
"The vast majority of collective agreements are settled without industrial action as employers and working people agree on pay and conditions but when that agreement is difficult to find, there are tools that both sides can use help to find agreement. This includes mediation or facilitation ordered by the Employment Relations Authority.
"If that fails, low level strike action, agreed by union members through a ballot, is a tool workers can use to make their concerns loud and clear to employers.
"If the Government keeps raiding the toolkit as they are here, they actually risk opening the door to escalating strike action and longer stoppages when the only tool left is a sledgehammer.
"This is another win for employers, the latest in a long series of extreme anti-worker policies - cancelling pay equity rules, axing of fair pay agreements, the 90 day fire at will law, tightening personal grievance rules, low minimum wage increases and the prospect of cutting sick pay for part-time workers now on the radar.
"This government has no shame in pursuing an agenda that is blatantly all about giving more power to employers and beating down on workers - the PSA will continue to resist strongly."

The Government has sent a warning signal to regional councils, suggesting they may be abolished following the replacement of the Resource Management Act later this year. Last week, Regional Development Minister Shane Jones told the Local Government Forum there was "less and less of justifiable purpose maintaining regional government". "After the upcoming changes to the RMA, I doubt – well, certainly in the party I belong to – that there's going to be a compelling case for regional government to continue to exist.' There are currently 11 regional councils across the country responsible for the management of natural resources, flood control, and biosecurity. Working at a more local level are more than 60 city and district councils which look after a wide range of matters from local roads, sewage and refuse collection to libraries and parks. ADVERTISEMENT In some areas, all those responsibilities come under one organisation such as Tairāwhiti, which has a sole Gisborne District Council which manages everything. Meanwhile, some regions, such as Hawke's Bay, have four local councils and a regional council. 'Still incredibly unsatisfied' Some Hawke's Bay residents who struggled with regional council decisions following Cyclone Gabrielle agreed with the Government's position, saying the idea of amalgamation could make life easier. Among them is local man Daniel Gale, whose campground was labelled by the Hawke's Bay Regional Council as category 3 with an intolerable risk to life. Gale has fought that for more than two years and said he could mitigate that risk with sufficient flood warnings. "Still incredibly unsatisfied with the actions and/or lack of actions from Hawke's Bay Regional Council in regards to our land categorisation and its process," he told 1News. "We have put it in formal complaints about the lack of process and our resolving category which doesn't align with other areas." ADVERTISEMENT While the regional council sets the land categories, the district council enforces them. Gale said going back and forth between the two has made the tough cyclone recovery process more difficult. "I'd describe it as poor lack of engagement, no individual site assessments, and lack of willingness to properly engage and have a grown-up conversation," he said. 'I'd like to see it all rolled together into one so you're only dealing with one organisation." 'Focused on vanity projects' - Luxon Prime Minister Christopher Luxon speaking in Brussels. (Source: 1News) Speaking to media in Brussels, Prime Minister Christopher Luxon said there were too many layers of government in New Zealand that drove too much bureaucracy. "Some councils are doing an exceptional job, some are doing a very poor job. We want to focus on the must-do stuff, not very nice to do stuff. We don't want them focused on vanity projects – we want to make sure they're getting good value for their ratepayers." ADVERTISEMENT Speaking on behalf of regional councils nationwide, Greater Wellington Regional Council chairman Daran Ponter believed they were the solution, not the problem. 'When people talk about getting rid of regional councils, they're really talking about reallocating the functions that regional councils do, and we're up for that conversation." Ponter said regional councils could be seen as the "building blocks for local government reform". "The idea that we have more than 70 local authorities in New Zealand when we could have somewhere to 16 to 20 means that regional councils really provide the nucleus for what local government reform could look like in the future." He added that while local government has been calling for reform "for some time" and is "certainly up for the conversation", the dialogue has been "sort of knee-jerk". "'Shoot the regional council' or 'shoot the district councils' or whatever. It is not particularly helpful." Ponter said it would be more constructive to have an "understanding from the Government about what they actually want to achieve in this space, rather than saying what they don't want". ADVERTISEMENT "That would be really good to have a Government that says what they do want and how they think local government might be structured in the future to better meet the needs of the community and the environment." Ponter planned to meet with Jones to discuss further concerns. How do other councils feel? Gisborne Mayor Rahette Stoltz told 1News that for them, having one council has 'worked well', but it 'might not work and it might not be fit for purpose for everyone across the country'. Meanwhile, Wairoa Mayor Craig Little said recent weather events have highlighted the downfalls of the current structure. 'When it's costing regions like Wairoa a hell of a lot of money to do things that it shouldn't be, that's when I question the regional council big time.' Local Government New Zealand told 1News councils are having conversations about how to improve the structure of local government and said a strategic approach is needed, rather than reacting to individual pieces of government reform. 'Not Kiwi, nor Christian': Minister condemns Destiny Church rally

The Minister for Ethnic Communities says he was "appalled" by a Destiny Church march on Saturday which was neither "Kiwi, nor Christian". Church followers marched down Auckland's Queen St on Saturday against "foreign religions", with leader Brian Tamaki saying the church was building a "Commonwealth crusade" to "reclaim Christian nations". A number of flags were also set on fire but were put out before firefighters arrived. In a post to Facebook, Minister Mark Mitchell said everyone had a right to freedom of speech and protest. "That does mean, however, that New Zealanders are free to condemn behaviour that is not in keeping with our values as a country and as a wider community. ADVERTISEMENT "I am proud to be the Minister of Ethnic Communities in a multicultural and diverse New Zealand, which has had a proud history of welcoming people from all walks of life." Destiny Church said the march was to take "a bold public stand for Christian values, Kiwi identity and the future of this nation". Mitchell said behaviour that incited discrimination or violence was "damaging" and condemned the "vile rhetoric and behaviour" of the Church and its associates. "The behaviour I saw was not Kiwi, nor Christian. "The use of taiaha, which is a culturally sacred weapon, to overtly stab at flags representing minority groups in our country, while being torn to pieces and burnt is not acceptable." Mitchell said the Government had a strong focus in public safety. "Anything that threatens or disturbs the public's right to go about their lives free from threat of violence is something I take very seriously. The actions I saw from Destiny Church this weekend in my view are not welcome in New Zealand." On Saturday, Acting Prime Minister David Seymour denounced the marching, saying it was "un-Kiwi". "What it means to be Kiwi is people come from all over the world, and so long as they come peacefully to build a better world, then they're welcome," Seymour said. "Brian Tamaki's various attitudes have all sorts of problems, but at their heart they're un-Kiwi attitudes because they're intolerant and uninclusive. (Source: 'Despicable event' - faith and ethnic communities ADVERTISEMENT Faith and ethnic communities have urged the Government to get moving on hate speech legislation in response to a Destiny Church march on the weekend. The Federation of Islamic Associations of New Zealand, the Combined Sikh Association of NZ, and the New Zealand Buddhist Council say the event was "despicable" and New Zealand needed a strategy for social cohesion. In a letter to the Government, all MPs and public sector agencies, the groups said there were "elements" in New Zealand who exploited the lack of effective hate speech legislation to gain notoriety through "racist stunts". "With the rapid rise of hate incidents reported to the NZ Police, we now have similar conditions which gave rise to the terror attacks of 15 March. In an increasing diverse multi-faith and multi-ethnic Aotearoa New Zealand, there needs to be in place a sustained strategy for social cohesion." "This was clearly outlined and specified in detail in the Royal Commission, which have now been mostly abandoned."
