HC expresses concern over ‘minor' lodged in regular jail, allows bail

Allowing bail to a minor boy languishing in a regular jail for a year, the Lucknow bench of the Allahabad high court has expressed concern over the trial court's delay in deciding his application claiming juvenility.
The applicant was lodged in Pratapgarh jail from March 2024 under several sections of the POCSO Act. The FIR was lodged with the Aasupur Deosara police station, Pratapgarh, on March 6, 2024.
He was accused of enticing the complainant's daughter aged around 13 years on the night of March 4, 2024.
On May 16, 2025, a single judge bench of justice Subhash Vidyarthi stated that the minor victim, aged around 13 years, has not levelled any allegations against the applicant who is aged around 16 years.
Therefore, the applicant is entitled to be released on bail, added the court.
The court also expressed concern over the Pratapgharh trial court's failure to decide the application of the applicant (accused boy) filed on April 8, 2024, claiming himself a juvenile.
'The approach of the trial court in not deciding the application (dated 08.04.2024) given by the applicant for declaring him a juvenile in conflict with law has compelled the applicant child to remain in jail with under-trial accused persons and convicts for more than one year,' said the court.
'In case the trial court ultimately comes to a conclusion that the applicant is a juvenile in conflict with law, the loss which has been caused to the applicant by making him spend a period of more than one year in regular jail with under-trial accused persons and convicts, cannot be made good by any means,' added the court.
The court added: 'The Juvenile Justice Act, 2015, provides that any person in whose charge a child in conflict with law is placed, shall, while the order is in force, have responsibility of the said child, as if the said person was the child's parent and responsible for the child's maintenance.'
'When the applicant was lodged in jail, it was the duty of the Jail authorities to have taken care of his interests as his parents and they should have taken appropriate steps to ensure that the benefits of the provisions of the Juvenile Justice Act were provided to the applicant,' asserted the court.
The court also directed the special judge, POCSO Court, Pratapgarh, to decide at the earliest whether the applicant is a juvenile or not.
The court also directed the registrar general of the high court to circulate a copy of this order to all the judicial officers in the state through the district judges of all the districts with the object of sensitising judicial officers to be more careful while dealing with criminal matters where the accused appears to be a juvenile or claims to be a juvenile.

However, once the news began surfacing in the media, he formed a special police team to trace the missing girls. Following the formation of the special team, the victims were traced to a hotel in the Calangute area. Police rescued the girls and detained two men present with them. During the investigation, the girls informed the police that they had gone to Calangute to celebrate a birthday. It was then discovered that the 15-year-old and the 11-year-old were sexually registered two separate cases under IPC Sections 137(2), 64(1), 74, 75(1), Section 8(2) of the Goa Children's Act, and Sections 4, 8, and 12 of the POCSO Act. The two men detained earlier were formally Wednesday night, the police also arrested the owner of the hotel where the incident occurred. Rajat Chavan, owner of Krishna Mahadev Hotel in Baga, was arrested by Calangute police for allowing the girls to enter the hotel without parental strict action, Rahul Gupta, Superintendent of Police, said, 'The police are applying for the sealing of the hotel and the cancellation of its license.' He added, 'If any man is given a room without the presence of their family members or relatives, hotel management and owners will not be spared. It is a violation of the Goa Children's Act.' Representative photo KANPUR: The police arrested the suspect, who had attempted to sexually assault and murder a six-year-old girl, on Wednesday night after shooting him in the right leg during an encounter. The accused was hiding in a forest alongside the Ramsari-sugar mill road. He fired at the police vehicle upon their arrival, prompting retaliatory fire that wounded his leg before his arrest. He was subsequently transported for medical treatment. On Tuesday evening, a six-year-old girl, whose father is a private worker, was discovered in a severely injured state. The victim's mother identified 28-year-old Shivam, locally known as Kallu, a neighbourhood resident, as the perpetrator who assaulted her daughter and attempted to end her life by striking her head with a brick. The incident occurred behind a shrine. Initially denying any knowledge of the girl's whereabouts during the family's search, Kallu later emerged carrying the injured child. She was first taken to Ghatampur CHC before being transferred to Kanpur. The accused accompanied the victim to the hospital, where the girl's father confronted and struck him, leading to his escape. The child was transported to Kanpur LLR Hospital through a green corridor. DCP South examined the crime scene that night. The authorities registered a case against the accused under relevant sections for rape, attempted murder of a minor, and POCSO Act violations. The ACP indicated that locating the suspect was challenging due to his mobile phone being switched off. Following intelligence received on Wednesday night about his presence in the Ramsari forest near the sugar mill road, police confronted the suspect, resulting in an exchange of gunfire. After being shot and apprehended, authorities recovered weapons and ammunition from his possession. The child, whilst regaining consciousness on Wednesday at LLR Hospital, remains unable to communicate. Dr. Shailendra, heading paediatrics, confirmed the child's head trauma but noted improvement, with oxygen support no longer required. Principal, Medical college, Dr Sanjay Kala confirmed ongoing monitoring by multiple specialists. CCTV footage from Ghatampur CHC captured the suspect arriving with the child, rushing her to emergency, and the subsequent confrontation with her father. DCP South Deependra Nath Chowdhary confirmed the suspect's arrest following the shooting incident. The child, though conscious, remains unable to speak. Investigations continue. CHENNAI: In a case of alleged sexual assault of a 16-year-old girl at Kalakattur in Kancheepuram, three youth, including two minors, were arrested on Wednesday. The men allegedly took the girl to a secluded spot in the locality and spiked her drink before assaulting her, the police said. According to the police, the victim had completed her Class X this year and was working part-time. A few months ago, she got acquainted with two boys, aged 15 and 14, in the locality and befriended 19-year-old Ajay through them. The four of them would usually meet to chat, the police said. On Monday, the three took the girl to a secluded spot behind a cooperative bank at Kalakattur. There they gave the girl a drink laced with alcohol and allegedly sexually assaulted her, the police said. The men later fled the scene. When the girl told her parents about the incident, she was taken to a hospital. Her parents then lodged a police complaint based on which a case was registered under sections 74 and 123 of BNS, 9(g) and 10 of the Pocso Act, along with relevant sections of the JJ Act. Based on an inquiry, the police arrested the trio on Wednesday. The minors were sent to an observation home and Ajay was sent to judicial custody.
