Uphaar Cinema fire tragedy: 28 years on, families demand justice

'We have a parallel criminal justice, one for the rich and powerful and one for the poor,' remarked Neelam Krishnamoorthy, the face of the campaign seeking justice for the victims of the 1997 Uphaar Cinema fire tragedy, in a prayer meeting held Friday at Smriti Upvan. This year marks the 28th anniversary of the fire accident that broke out on June 13, 1997, claiming 59 lives due to asphyxiation and leaving hundreds injured in the ensuing stampede. Families of the 59 people who died meet annually to remember their loved ones. Neelam and her husband, Shekhar Krishnamoorthy, lost their children — 17-year-old Unnati and 13-year-old Ujjwal — in the blaze. 'I have kept these pictures for 28 years, the irony is many family members have died since,' Neelam said while she took down photos of the deceased pinned on a soft board post the ceremony. As president of the Association of Victims of the Uphaar Tragedy (AVUT), she and her husband have led a long struggle for justice. 'The courts are testing my patience too, but I've not given up because I have promised my children that we will get justice for them,' she added. Commenting on the Air India plane crash in Ahmedabad, which claimed 241 lives yesterday, she said, 'A whistleblower had already raised that there were problems with Boeing, but nobody listened. Similarly, the cinema also ran for years despite violations of norms. When greed overtakes a company, it's ordinary people who are availing the services.' Questioning a city court's decision to reduce the jail term of the accused brothers and owners of the cinema hall, Gopal and Sushil, Neelam said, 'The judge said that the accused also suffered, but how can they compare it with the pain of a mother who lost both of her children? Had it been an ordinary citizen, he would've been languishing behind bars.' In July 2022, a Delhi court granted relief to the brothers, ordering their release from jail by asking them to serve only the sentence already undergone, in a case of tampering with evidence in the case. The court observed that a trial court had earlier passed a sentence that was 'punitive and retributive in nature' to teach them a lesson. In 2015, the Supreme Court imposed a Rs 60-crore fine on the accused brothers in lieu of a custodial sentence. The amount was deposited with the Delhi government and was earmarked for building a second trauma centre, in memory of the victims, as an extension of AIIMS in Dwarka. However, this project has remained stalled. 'They (the Supreme Court) actually awarded the government for its failure. They were given Rs 60 crores to build a second trauma centre, but there's no sign of it so far,' she said. Neelam has since approached the apex court enquiring about the trauma centre. Amidst calls for justice, the Uphaar cinema in Green Park stands bearing the marks of the blazing tragedy, with a warning sign that reads 'stay away.'

Mumbai court grants bail to NCLT deputy registrar booked by CBI for accepting Rs 3 lakh bribe

A special court on Friday granted bail to the deputy registrar of National Company Law Tribunal (NCLT), Mumbai bench, who was arrested by the Central Bureau of Investigation for allegedly accepting a bribe of Rs 3 lakh from a person for getting a case at NCLT settled in his favour. The central agency had on May 29 arrested deputy registrar Charan Pratap Singh and another person, Karsan Ahir, after they were caught by the CBI officials while allegedly accepting the bribe. The CBI registered a case on May 14 on the allegations of the complainant, a hotel owner. As per CBI, the said complainant was involved in a dispute with his brothers, regarding the ownership of the said hotel and frauds done by his brother and his associates. Singh, through Advocate Shalabh Kunwar Saxena, had argued that the allegations against him were vague and lacked concrete evidence and he shall be released on bail. The special court on Friday allowed bail application of Charan Pratap Singh on executing a personal bond of Rs 1 lakh along with surety and directed him to appear in CBI's office twice every week till chargesheet is filed in the case. The special Judge A V Kharkar, among other bail conditions, also asked Singh to cooperate with the investigation officer and that he shall not leave Mumbai and Thane district without obtaining prior permission from the special court. He is asked to attend every date of trial in the court. The court added that Singh shall not tamper with the evidence and shall not directly or indirectly threaten or induce any person acquainted with the facts of the case to dissuade him or her from disclosing such facts from court or probing agency. The judge also directed Singh to submit details related to his residence along with contact details of two relatives/acquaintances residing in Mumbai.

Court awards over Rs 27 lakh compensation to man injured in 2019 road accident

In an order dated June 4, the tribunal said it was established that the accident occurred 'on account of the speedy and rash driving' by its driver named Shankar Yadav. Presiding Officer Shelly Arora noted the claimant or injured Prahalad Rai's statement, according to which he was riding his two-wheeler from Kalindi Kunj to Madanpur Khadar when a rashly driven truck rammed into his vehicle on July 9, 2019. New Delhi, Jun 13 (PTI) Underlining that medically determined permanent disability cannot be mechanically applied to find the loss of earning capacity because of functional disability, a motor accident claims tribunal here has awarded Rs 27.07 lakh as compensation to a man injured in a 2019 road accident. It noted that according to Rai, he suffered a grade-III fracture of both bones of his left leg and underwent surgeries, and prolonged medical treatment, which rendered him 63 per cent permanently disabled, leading to substantial loss of income because of an adverse impact on his earning capacity. The court said, according to the precedents established by the Supreme Court and high courts, medically determined permanent disability cannot be equated with loss of earning capacity because of functional disability, as it would result in a non-objective and absurd compensation. It said, 'There, however, might be certain cases where the two would correspond to each other, but it cannot be mechanically applied; rather, it requires evaluation of applicable factors independently in each case to reach a fair quantification of loss of earning capacity.' The court noted that the claimant, who was employed as a delivery boy, endured substantial disability, including deformity in the left lower limb. 'This impairment significantly restricts mobility, a critical requirement for his prior employment, which heavily relied on driving and physical activity. The nature of his injury directly impacts his ability to perform essential job functions, particularly those involving extensive fieldwork and continuous driving, which are indispensable for a delivery boy,' the court said. It said that the 'psychological and emotional consequences' of the injury further diminished Rai's capacity to adapt to alternative employment, which compounded the overall effect on his earning ability. 'Given the substantial impact on his ability to undertake field-oriented work, his functional disability is assessed as 50 per cent concerning his earning capacity,' the court said. It computed a total compensation of around Rs 27.07 lakh, payable to Rai under various pecuniary and non-pecuniary losses. The court directed the insurer, United India Insurance Company Ltd, to pay the entire compensation along with interest. PTI MNR AS AS This report is auto-generated from PTI news service.
