
Woman Sues Husband For Defamation Over Adultery Charge. What Court Ruled

A Delhi Court has recently declined cognisance of a defamation complaint filed by a woman against her husband. The man had filed a divorce petition in Karnataka on the grounds of cruelty and adultery.
While declining cognisance, the court observed, "A crucial element for completing the offence of defamation is that the imputation (allegation) must have been made with the requisite mensrea (intention) to cause harm to the reputation of the concerned person."
A woman had alleged that her husband had falsely alleged in the divorce petition that she was having an affair with her gym trainer, used to meet her secretly, used to invite him to their house in the absence of the accused and used to frequent hotels with him.
It was further alleged that during cross-examination in the divorce proceeding, the husband could not substantiate his allegations and failed to justify the ground of adultery. As per the admitted case, the divorce was eventually granted in the matter on the ground of cruelty.
Judicial Magistrate First Class (JMFC) Yashdeep Chahal refused to take cognizance of the complaint.
"I have no hesitation in observing that the version of the complainant fails to disclose the ingredients and nexus necessary for proving the offence of defamation against the accused herein, and thus, no prima facie case is made out for taking cognisance. Accordingly, cognisance is declined under Section 223 of BNSS and the complaint is disposed of," JMFC Chahal said in the order passed on May 16.
The court also pointed a finger towards making Delhi a jurisdiction for filing a complaint.
"It is also apparent from how the cause of action has been created in Delhi. To keep the pot boiling is a method which the Courts must be circumspect about. I need not say more," JMFC Yashdeep Chahal said.
The complainant had alleged that when she was in Delhi to meet her friend she was having the affidavit filed by her husband. Her husband caught hold of the affidavit and read it. Her friend asked her the question about the allegations. She alleged that the false Allegations levelled in the affidavit defamed her in the eyes of her husband.
The court also said that it has been observed by the Constitutional Courts, time and again, that the tendency to misuse the criminal machinery for settling monetary/civil scores must be nipped in the bud.
" Without expressing much, I may only note that the prayer on behalf of the complainant to keep this complaint pending, for no reason whatsoever, till settlement talks are going on
outside the Court, only points in the direction alleged by the accused to keep the pressure points on," the judge observed.
The couple got married on 28.04.2008. As the relationship went sour, the accused husband filed a divorce petition in 2020 before the Family Court in Bengaluru.
In the said petition, the husband filed his affidavit of evidence wherein, the accused pleaded
for divorce on the twin grounds of cruelty and adultery. To substantiate his ground of adultery, the accused allegedly levelled certain allegations against the complainant.

'Victims' can challenge acquittal under Sec 372 CrPC: Supreme Court
NEW DELHI: Referring to provision of Section 372 of CrPC which was amended in 2009 on recommendation of Law Commission to allow a victim to file appeal, Supreme Court has held that a "victim" of an offence like in cheque bouncing cases has the right to challenge the order of acquittal of the accused under CrPC and corresponding Section 413 of BNSS. Differentiating between Sec 372 & Sec 378 (which allows a complainant to file appeal), a bench of Justices B V Nagarathna and Satish Sharma said Section 378 circumcised the right to file an appeal which is not the case with Section 372. "The proviso to Sec 372 of CrPC was inserted in statute book with effect from 31.12.2009. The object and reason for such insertion must be realised and must be given its full effect to by a court. In view of the aforesaid discussion, we hold that the victim of an offence has the right to prefer an appeal under the proviso to Section 372 of CrPC, irrespective of whether he is a complainant or not. Even if the victim of an offence is a complainant, he can still proceed under the proviso to Section 372 and need not advert to sub-section (4) of Section 378 of CrPC, SC said victim of a crime must have an absolute right to prefer an appeal which cannot be circumscribed by any condition and the right of a victim of a crime must be placed on par with right of an accused who after being convicted has a right to file an appeal under Section 374 of CrPC. MCH intern held for rape, forced abortions
Kolkata: A 24-year-old Calcutta Medical College student from Malda was arrested by Patuli Woman PS cops in connection with allegations of sexual assault and forcing multiple abortions on his girlfriend without her consent or knowledge. A formal complaint had been filed at the police station by a 27-year-old woman, who resides outside Kolkata and is not involved with the health sector. Cops have gathered medical reports and CCTV footage. According to cops, the case was registered under sections 69/89 of the BNS Act, pertaining to sexual intercourse by employing deceitful means and causing miscarriage without the woman's consent. If convicted, the accused intern can face 10 years in prison. "The woman alleged the accused, who was her boyfriend, engaged in sexual intercourse with her on multiple occasions, resulting in three pregnancies. She said he subsequently forced her to undergo abortions," said joint CP (crime) Rupesh Kumar. The duo reportedly met in 2022. The first abortion was carried out in 2022 and the other two in 2024. The accused allegedly facilitated the abortions by administering pills to the woman. An officer said the woman's statement was recorded under Section 183 of the BNSS. "We conducted primary and medico-legal examinations of the woman. Witnesses were examined and relevant documents seized," an officer said. The accused, a resident of the New Boys Hostel GTD, was sent to judicial custody. Cops are probing whether his medical knowledge was misused in the alleged forced abortions. One more arrest in Rahiman murder case
Mangaluru: Dakshina Kannada district police arrested one more person in connection with the Abdul Rahiman murder case on Wednesday. The arrested individual is Ravi Sanjay,29, a resident of Bettagere in Sringeri. He was produced before a court, and the investigation is ongoing, police said. Rahiman,32, a driver and secretary of the local Juma Masjid, and Kalandar Shafi were brutally attacked in Irakodi, Kuriyala village, under the jurisdiction of the Bantwal Rural police station on May 27. While Rahiman succumbed to his injuries, Kalandar is undergoing treatment at a private hospital in Mangaluru. Police arrested eight in connection with the case so far. Body found The body of Ramesh Rai,54, a resident of Kasba village in Puttur, was found on the banks of the Nethravati River in Panemangaluru, Bantwal taluk, on Thursday. Complainant Vinesh Rai, son of Ramesh Rai, received information about his father's mobile phone and two-wheeler lying near the old bridge at Panemangaluru. Following this, residents and the fire and emergency personnel carried out a search and found the body. Bantwal Town police registered a case under Section 194 of the BNSS.
