
Amid 'Overreach' Row, Supreme Court Dismisses Petition On High Court's Powers
New Delhi:
The Supreme Court on Tuesday dismissed a plea which sought the power of the top court under Article 142 of the Constitution to be granted to the high courts.
Article 142 empowers the top court to pass 'any decree or order necessary for doing complete justice in any case or matter pending before it' within the country.
A bench of Justices Abhay S Oka and Ujjal Bhuyan wondered how could it allow such a plea and said, "How can we grant such prayer? It requires an amendment to the Constitution. You go to Parliament. Prayer made in this petition is completely misconceived. Power conferred under Article 142 of the Constitution is only on this court and not the high courts. Therefore, we cannot allow high court to exercise power of this court under Article 142."
The top court was hearing the plea filed by NGO Abhinav Bharat Congress.

She and her fellow protesters were seen signing the letters from the footpaths in Salt Lake, Kolkata, where they have been protesting for the past 34 days demanding the restoration of their jobs. The situation follows the April 3 Supreme Court order upholding a Calcutta High Court decision to cancel the recruitment of nearly 26,000 teachers and non-teaching employees in the State-run schools due to irregularities in the 2016 selection process conducted by the West Bengal School Service Commission. The apex court subsequently allowed the 'untainted' teachers to continue working until year-end. On April 24, the State government released lists of 'untainted' teachers. The top court asked the 'untainted' candidates, many of whom have seven to eight years of experience, to appear for fresh exams for reinstatement. 'I earnestly and solemnly appeal to you, the head of the state and the highest constitutional authority... That I be spared from this punishment,' read the common draft of the letter. In the event their request was turned down, the teachers sought permission for 'voluntary euthanasia' for themselves and their family members. The teachers also urged Ms. Murmu to issue a directive 'for a fair reconsideration of the judgment that has deprived us of our rightful livelihood'. Backwardness only criteria for OBC classification, says Bengal CM Mamata Banerjee
West Bengal CM Mamata Banerjee on Tuesday told the assembly that OBC classification hasn't been done on religion, the only benchmark for it being the backwardness of a community. "A high court division bench order led to the exclusion of several groups from the OBC category. The West Bengal government took the matter to the Supreme Court," Banerjee said. In compliance with the HC order, a public notification was issued, she said. All action was taken, abiding by the law, and it has been submitted to court, she said. There were a total of 140 recognised groups among OBCs. Banerjee said out of 140, around 61 are from the majority Hindu community and 79 from the minority community.

1 2 3 Jamshedpur: The Scheduled Tribes (STs) community living on the periphery of the Jamshedpur Notified Area Committee (JNAC), Mango Notified Area Committee (MNAC), and Jugsalai Municipal Council (JMC) staged a demonstration at the DC office on Tuesday opposing the govt's proposal to extend the command limits of the three municipal bodies and include the panchayat areas. Representatives of different social and religious outfits, besides panchayat heads and traditional village heads, among others, said that the culture, customs, and rural lifestyle of the adivasis would be compromised with the inclusion of the panchayats in the municipal limits. "Several tribal families in the villages own 10 bighas of ancestral land on average. The holding tax of the municipality will cause a heavy financial burden on the modest earning families," said Mukhiya Sangh general secretary, Kanhu Murmu. Further, the agitating crowd claimed that the whole of Jamshedpur comes under the Fifth Scheduled Area of the Constitution, and in the past, a large part of the land was acquired by the govt for the purpose of setting up industries and developing a planned city without taking into confidence the heads of gram panchayats of that time. Presently, the process of determining the extended boundaries of the municipal areas of Jamshedpur and Jugsalai is ongoing ahead of submitting the report to the urban development department. "The purpose is to provide better municipal facilities to the people living in the areas identified for inclusion in the municipality," said a senior JNAC official, requesting anonymity in the wake of the increasing protest against the proposal.
