BMC to set up 3 more ODA courts to resolve building plan disputes
Bhubaneswar: For expedited disposal of disputes arising from building plan approvals under Bhubaneswar Municipal Corporation (BMC) limits, three more Odisha Development Authority (ODA) courts will be set up in under the civic body, where designated officers will hear and resolve cases.
At present, there is only one ODA court that deals with thousands of minor and major disputes, creating a huge backlog. An estimated 7,000 disputes are pending for disposal, BMC officials said.
The court is empowered under the ODA Act, 1982, to decide on the violation of building rules. Earlier, the court functioned under the Bhubaneswar Development Authority (BDA). It started operating under BMC from Nov 2016.
BMC officials said that as per the initial plan, the cases will be distributed among the zones according to allotted disputes of a respective zone.
"Three additional commissioners, one in each zone, will be designated as authorised officers to hear the cases," said BMC additional commissioner Suvendu Sahu.
He made the statement on the sidelines of a recent discussion in a corporation meeting where BMC commissioner Rajesh Patil expressed the view that opening of more ODA courts will reduce the burden on a single court.
When the ODA court started functioning, 1,034 pending cases were transferred from BDA.

BMC officials said that because of the court, people are able to file complaints directly without having to run from officer to officer. The court also takes cases from the BMC's enforcement squad.
"The enforcement squads keep receiving complaints of encroachments. The ODA court has helped to take up encroachment cases and conducts their hearing expeditiously," said a BMC officer.
BMC officials said most of the cases relate to carrying out construction beyond the approved plan or minor and major deviations. "Since BMC is now dealing with building plan approval, we find out whether an individual has used space beyond the permissible area shown in the plan. If we find a violation, we transfer it to the ODA court," an officer said.
Sources said if applicants don't find the court's direction satisfactory, they can move the appellate authority. In the case of ODA court, the appellate authority is secretary of the housing and urban development department.

He also confirmed raising the issue with the CMO and pointed to the Centre's affidavit in the Supreme Court, which clarified that existing boards need not be dissolved immediately, nor should the Waqf-by-user clause be enforced rigidly at this stage. In response, Asadullah maintained that, as the statutory convener of the Waqf Board, he acted in accordance with protocol. He said that the amended Act had received Presidential assent and was thus in force, and that his letter to the govt merely sought procedural clarity. "The state govt advised me to await legal opinion before calling the meeting," he said. On the question of eligibility under the revised Act, Asadullah acknowledged the requirement for a joint secretary–level officer to serve as CEO and stated that he would comply with any direction issued by the govt on the matter. The state govt is expected to review the issue once Tafseer Iqbal, special secretary of the minorities welfare department, returns from leave on June 16.

BMC moves to phase out plastic bags with cotton alternatives
Bhubaneswar: An ambitious plan to tackle plastic pollution will be launched by Bhubaneswar Municipal Corporation (BMC) on Thursday on World Environment Day . BMC officials said that as per the plan, they will begin phasing out plastic carry bags, replacing them with cotton alternatives at the Unit II market, where several vendors will participate in the inaugural programme. The vendors will also take a pledge, "Say no to single-use plastic carry bags". The campaign aligns with this year's environment day theme, 'Right Up Your Alley — Ending Plastic Pollution'. Instead of merely penalising vendors for using plastic bags, BMC officials will provide cotton bags as substitutes, promoting a sustainable solution to reduce plastic waste. "The occasion will be used to promote our plan to eliminate plastic carry bags from markets through the gradual promotion of cotton bags during enforcement activities. On Thursday, some vendors will be provided cotton bags for free on the occasion, but that is only for once. As per our strategy, we will carry out enforcement," said BMC additional commissioner Suvendu Sahu. Additionally, the celebration venue at Unit II will have an awareness kiosk. Ease of business: No registration for hiring up to 20 helpers in Punjab; Bhagwant Mann cabinet amends 1958 Shop Act
Chandigarh: The Punjab cabinet on Wednesday approved an amendment to the Punjab Shops and Commercial Establishments Act, 1958, aimed at reducing compliance burdens on 95% small businesses and enhancing the ease of doing business in the state. Punjab chief minister Bhagwant Mann later said, "The business owners had to face 'inspector raj' and resulted in corruption or blackmailing. They were asked to furnish records of even a single helper. To get rid of such practices, the Act that dates back to 1958 will be amended. Now no registration would be required for hiring up to 20 helpers. The criterion for overtime paid to the labour has also been revised." An official spokesperson added that the move is expected to directly benefit lakhs of shopkeepers across the state. However, such establishments would still be required to submit relevant information to the labour department within six months of the Act coming into force or the commencement of their business. As part of the amendment, all establishments employing up to 20 workers will be exempted from all provisions of the Act.
