Teacher claims trial to sexually assaulting male student, 11

(Facaebook pic) PETALING JAYA : A primary school teacher has been charged in the Seremban sessions court with two counts of sexually assaulting a male student two years ago. Abdul Halim Ismail, 37, pleaded not guilty after the charges were read before judge Hazeelyah Muhammad, Berita Harian reported. He was charged with committing physical sexual assault on the student, who was 11 at the time, at a hotel in Port Dickson at around 10pm on June 28 and 29, 2023. The charges were framed under Section 14(a) of the Sexual Offences Against Children Act 2017, read with Section 16 which deals with offenders who have a relationship of trust with the victims. Under Section 14, the accused faces up to 20 years in jail and a whipping if convicted. Section 16 provides for an additional jail term of up to five years and at least two strokes of the rotan. Deputy public prosecutor Norazihah Asmuni noted that Halim had also been slapped with charges of sexual assault on children at the sessions courts in Pahang, Perak, and Melaka since 2023. Lawyer Aliff Aiman Rusli appealed for a lower bail amount, saying Halim had been suspended from his duties without pay since 2023. The court allowed Halim to post bail at RM10,000 for both charges but ordered him to surrender his passport and report to the nearest police station every month. Case mention has been fixed for June 9.

Teacher charged with sexually assaulting 11-year-old
SEREMBAN: A primary school teacher has pleaded not guilty to two counts of sexually assaulting an 11-year-old student two years ago. The accused, Abdul Halim Ismail, 37, made the plea after the charges were read out to him before Judge Hazeelyah Muhammad. According to the charge, Halim is accused of sexually assaulting the boy, then 11, on the nights of June 28 and 29, 2023 at a hotel in Port Dickson, Negeri Sembilan. The charges were framed under Section 14(a) of the Sexual Offences Against Children Act, read together with Section 16(1) of the same Act, which carries a penalty of imprisonment of up to 20 years and whipping, upon conviction. Under Section 16(1) of the Act, a person may be sentenced to imprisonment of not more than half the maximum jail term for the offence attempted, and may also be subjected to whipping. Deputy public prosecutor Norazihah Asmuni did not propose bail but requested that it be set at a high amount should the court allow it. She told the court that since 2023, Halim has faced charges of sexual assault against children at the Raub, Ipoh and Melaka Sessions Courts. Halim's lawyer, Aliff Aiman Rusli, appealed for a low bail, citing his client's lack of income due to his suspension since 2023. The court set bail at RM5,000 for each charge. Halim was also ordered to report to the nearest police station every month, surrender his passport to the court, and stay away from the victim and witnesses. The court set 9 June for case remention.

Teacher claims trial to sexual assault charges in Seremban
SEREMBAN: A 37-year-old male teacher has claimed trial at the Sessions Court here for two charges of committing physical sexual assault against an 11-year-old pupil. Abdul Halim Ismail pleaded not guilty after the charges were read to him before Judge Hazeelia Muhammad. For the first charge, he allegedly committed the offence against the boy at a hotel room in Port Dickson at around 10pm on July 28, 2023. He was charged with committing the second offence at the same place and time the following day. For both offences, he was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, read with Section 16(1) of the same legislation. Offenders can be jailed for up to 20 years and whipped upon conviction. Deputy Public Prosecutor Norazihah Asmuni told the court the prosecution was not offering bail to the accused. However, if the court allowed it, she requested a high amount. Norazihah said the accused was also facing similar charges in Raub, Melaka, and Ipoh. She asked the court to order the accused to report monthly at the nearest police station until the case is resolved, to stay away from the victim and prosecution witnesses, and to surrender his passport, if he had one, to the court. The accused's lawyer, Aliff Aiman Rusli, said his client, a government servant, had no income as he had been suspended since 2023. He added that the accused could not afford a high bail amount as he faced similar charges elsewhere. "The accused, who also cares for his 78-year-old father, has been attending his other cases in court without fail since 2023. "We have been informed that the alleged victim is no longer interested in pursuing the case, so we propose a bail of RM5,000 for both charges," he said, adding that his client was not a flight risk and had not violated any other laws. DPP Norazihah said the prosecution had not received any information that the victim was no longer keen to pursue the case. Judge Hazeelia set bail at RM10,000 with one surety, allowed the other applications by the prosecution and fixed June 9 for re-mention.
