Pune Porsche crash: Court rejects temporary bail plea of juvenile's father
A Pune sessions court rejected the temporary bail plea of the father of the juvenile accused in the Porsche crash case, citing his 79-year-old mother's deteriorating health. The accused's 17-year-old son, allegedly under the influence of alcohol, rammed a Porsche into a motorbike, killing two software engineers. (FILE) In an order issued dated July 25 (uploaded on July 28), Additional Sessions Judge KP Kshirsagar observed that there were no justifiable grounds to grant temporary bail at this stage, citing the gravity of the offence, the seriousness of the allegations, and the reasonable apprehension that the accused may tamper with witnesses. The judge also stressed the need to consider the rights of the victims and the larger public interest. The accused's 17-year-old son, allegedly under the influence of alcohol, rammed a Porsche into a motorbike, killing two software engineers. Following the incident, the juvenile's parents, along with senior doctors and staff from Sassoon General Hospital, were arrested for allegedly attempting to manipulate the teenager's blood test reports to indicate sobriety. The accused is facing serious charges under Sections 304 (culpable homicide not amounting to murder), 120-B (criminal conspiracy), and 201 (causing disappearance of evidence) of the Indian Penal Code, relevant sections of the Prevention of Corruption Act, 1988, and the Motor Vehicles Act. While his wife is out on interim bail, he remains in judicial custody along with Sassoon Hospital doctors Ajay Taware and Shrihari Halnor, hospital staff, and alleged middlemen involved in the cover-up. The defence argued that the bail plea was based solely on humanitarian grounds. It stated that the man's mother suffers from a severe spinal condition requiring planned lumbar surgery, and as her only son, his presence was essential for making medical decisions and assisting in post-operative care. The defence also pointed out that his father is elderly, his sister lives in Delhi, and his wife is mentally distressed. However, the Special Public Prosecutor (SPP) opposed the application, contending that the ailment cited was age-related and not life-threatening. The surgery was elective and pre-scheduled, and other family members were available to assist. The court noted that he had already tried to interfere with the investigation and that his release would likely prejudice public interest and the justice process. The court stated, 'Considering the nature of surgery, the availability of other family members, and the fact that the applicant's mother is not in a critical condition, there is no just ground for the grant of temporary bail.'

Prosecution claims Porsche crash accused using delaying tactics in court
Accused persons in the 2024 Porsche car crash case involving a teenager driver are using delaying tactics to prolong legal proceedings by moving "frivolous" applications before a trial court in Pune, the prosecution argued on Wednesday. Currently, the court is hearing arguments for framing of charges against 10 accused involved in the swapping of blood samples of the 17-year-old juvenile, who fatally knocked down two IT professionals while driving a Porsche car allegedly under the influence of alcohol in May last year. The prosecution on Friday concluded its arguments seeking that charges be framed against all accused citing it has conclusive DNA evidence to prove the minor boy's blood samples were swapped with those of his mother at the state-run Sassoon General Hospital. All 10 accused, of whom nine are currently in jail, were equally involved in the conspiracy, it told the court. Defence lawyers representing the 10 accused, including the boy's father, were supposed to begin their arguments in the case on Wednesday. "A couple of accused have moved applications seeking a copy of the chargesheet. In my argument over their plea, I told the court the prosecution has already provided them a chargesheet copy. However, the defence told the court the prosecution has given them only a part (of the document) which is regarding the charges against them. But we told the court that a full chargesheet has been provided to all accused," said Special Public Prosecutor in the case Shishir Hiray. Such applications are "frivolous" in nature and the accused are deliberately using delaying tactics, he contended. Meanwhile, Sudhir Shah, a defence counsel representing Dr Ajay Taware, one of the 10 accused, while opening his argument on framing of charges, noted IPC sections 467 and 464 (dealing with forgery and making false documents) have been invoked against his client. These two sections were not applicable to Taware as he did not indulge in any forgery, Shah maintained. "Our client was not present at the Sassoon General Hospital when the blood samples were allegedly swapped and the report was tampered with. The section (related to forgery) is applicable to only those who have done forgery and not against the one who has instructed that person to do so," he argued. In the early hours of May 19, 2024, a Porsche allegedly driven by a 17-year-old boy, son of a well-known realtor, in an inebriated condition knocked down and killed two IT professionals, Anish Awadhiya and his friend Ashwini Costa, who were riding a two-wheeler in Kalyani Nagar. Currently, the juvenile's father, Sassoon Hospital doctors Ajay Taware and Shrihari Halnor, hospital staffer Atul Ghatkamble, two middlemen Bashpak Makandar and Amar Gaikwad, and three others are lodged in jail in connection with the alleged swapping of the juvenile's blood samples to conceal his intoxication at the time of the crash. The minor boy is facing separate proceedings before the Juvenile Justice Board.

Enough proof to show Taware's involvement in blood test manipulation in Porsche case: Prosecution to court
Pune: There is sufficient evidence relating to criminal conspiracy to prove the involvement of Dr Ajay Taware, suspended head of Sassoon General Hospital's forensic science department, in the Porsche Taycan car crash case, the prosecution told a special court on Thursday. Opposing Taware's discharge plea, special public prosecutor Shishir Hiray argued that the doctor claimed he was on leave on the day of the incident, but an examination of his call detail records showed that he was in touch with the suspended employees and influenced them to manipulate the blood alcohol tests of the three at the behest of their parents. Hiray submitted that witnesses gave statements and recorded confessional statements under section 164 of the Criminal Procedure Code (CrPC) before a magisterial court and these showed that Taware played a key role in the conspiracy. On the claims made by Taware that his arrest was illegal, the prosecution said that the chargesheet, remand reports, and case diary showed that he was communicated the reasons behind his arrest in writing and that his signature was also obtained on the arrest memo. The investigating officer, at the time of arresting the doctor, complied with the mandatory provisions of CrPC, he said. Judge K P Kshirsagar posted the hearing on June 10 when Taware's lawyer will argue the matter. Taware was also arrested in the kidney swab transplant case on May 28, the prosecutor told the court, adding that the state health department and Sassoon hospital received complaints against him.

Need time to question Taware on 10 kidney transplants cleared by panel he headed: Cops to court
Pune: The prosecution on Monday told a magisterial court that police needed sufficient time to question Dr Ajay Taware, the suspended Sassoon General Hospital doctor, in custody in relation to the 10 kidney swap transplants that were cleared by regional authorisation committee for organ transplant in 2022 when he was heading it. Assistant commissioner of police (crime) Ganesh Ingale and his team produced Taware before the court at the end of his initial police remand. Prosecutor Digambar Khopade submitted that police had already secured the relevant papers, video evidence of interviews of donors and receivers in these 10 transplant cases from Sassoon hospital, bank details, and related documents. Taware has so far not cooperated with police, he said. Defence lawyer Sudhir Shah said that his client had been wrongly implicated in the case. After hearing both sides, judicial magistrate first class S R Badave extended Taware's police custody till June 4. Taware headed regional authorisation committee as well as Sassoon authority committee and was medical superintendent of the hospital at the time when the transplant process took place and was completed at Ruby Hall Clinic. On Monday, Khopade submitted that police needed time to determine if any other person from the medical field or any other individual was involved in the crime. He said that Taware has so far given vague and misleading replies when asked to explain on what basis regional authorisation committee granted permission to the donors and recipients when there were discrepancies in the documents, such as their age and their movements, which were also found to be suspicious. They could not provide satisfactory replies to the questions posed by the committee, he submitted. There were discrepancies in the statements of a man and a woman, who were shown as organ donor and recipient, pertaining to the sale of their agricultural land, the prosecutor said. Police are in the process of analysing Taware's bank accounts to determine if he received any pecuniary benefits from the crime. His call detail records are also being analysed for the purpose of collecting evidence, he added.

Sassoon hospital's suspended senior doctor held in 2022 kidney racket case in Pune
Pune: Police on Wednesday night arrested Dr Ajay Taware, the suspended head of Sassoon General Hospital's forensic science department, in the 2022 kidney transplant case at Ruby Hall Clinic after securing his custody from Yerawada central jail earlier in the evening. Taware, who had been in jail since his arrest on May 27, 2024, as a co-accused in the blood sample swap case linked to the Porsche Taycan car crash on May 19 last year, was the head of the Regional Authorisation Committee (RAC) for organ transplant as well as the Sassoon Authority Committee and was the medical superintendent at the time when the transplant process took place and was completed at Ruby Hall Clinic. RAC is responsible for scrutinising organ transplant papers related to the proposed donor and the receiver, sent by the hospital where the transplant is to be performed, and clearing them on establishing all credentials. "We arrested Taware based on a five-member state health department inquiry committee's report of May 2022 that has indicted him and four others in RAC for misusing their position to aid kidney swap transplant based on bogus persons and forged documents," investigating officer ACP Ganesh Ingale told TOI. "The health department's then deputy director for Nashik region, Dr Raghunath Bhoye, headed the panel."
