Actor Ajaz Khan has approached the Bombay High Court seeking anticipatory bail in a rape case after a sessions court rejected the same. The actor is accused of raping a woman under the false promise of marriage and professional to the FIR filed by the complainant, Khan, 40, who is the host of a reality show "House Arrest", allegedly lured the woman, who is also an actress, by offering her a role in the also known as Ajaz Shafi Mohammad Guliwala, filed his plea through advocate Ashok Saraogi, contending that the FIR is 'bad in law' and his custodial interrogation is not required for any purposes. The Bombay High Court has directed the State government to respond to the pre-arrest bail application submitted by actor Ajaz Khan. This relates to a case registered by the Charkop police station earlier this month involving allegations of rape under the pretense of marriage and work in the film industry, as reported by a struggling actress. Justice Shyam Chandak, serving as the vacation judge, instructed the state on May 22 to submit its reply by June 2, while denying interim urgent relief to the actor. Khan sought pre-arrest bail from the High Court after the sessions court in Dindoshi rejected his application the previous week. The sessions court dismissed Khan's claim that his relationship with the actress was consensual, observing, 'The material on record shows that the applicant is married and an actress by profession. Though the victim is major, considering allegations it appears that consent is not free and unequivocally within the meaning of law." Furthermore, the sessions judge noted the necessity of Khan's custodial interrogation for medical examination, evidence collection, recovery of his mobile phone, and verification of WhatsApp chats and call recordings, as well as the acquisition of other digital evidence including voice samples. The complainant, an aspiring actress, accused Khan of leveraging his celebrity status and position as a reality show host to gain her trust. A Mumbai court has refused anticipatory bail to actor Ajaz Khan in a rape case. Additional sessions judge (Dindoshi court) Datta Dhoble on Thursday denied relief to Khan, ruling that "considering the nature and gravity of the allegations, there is need for custodial interrogation of the applicant". The prosecution has alleged that the victim, also an actor, was induced into a relationship by Khan. He allegedly misused his position as a celebrity and host of a reality show to gain the victim's confidence, the prosecution said. The FIR alleged that on the false pretext of marriage, promises of financial help and professional advancement, Khan established physical relations with the victim on multiple occasions "without her free and unequivocal consent". Khan has been booked under relevant provisions of Bharatiya Nyaya Sanhita sections concerning rape and physical relationship obtained through deceitful means. Pressing for anticipatory bail, Khan's advocate submitted that his client has been falsely implicated in the case. "The informant (victim) was well aware that the actor was already married. Both are majors. The prosecution, on the other hand, contended that Khan's custodial interrogation was necessary for recovery of his mobile phone, verification of WhatsApp chats and call recording. It submitted that the applicant has a prior criminal record and he may tamper with evidence or influence the victim and witnesses if granted anticipatory bail. The court after hearing both the sides noted that the FIR discloses specific dates, locations and circumstances under which the incident occurred, including the assurances allegedly given by the applicant, not just of marriage, but also professional help and financial assistance for the victim's family. "Prima facie, this cannot be brushed aside as a simple case of consensual relationship. The consent appears to be obtained by fraud or under misrepresentation of facts," the court noted. Though the victim is a major but considering allegations it appears that consent is not free and unequivocally within the meaning of law, it said. The court held that Khan's custodial interrogation was necessary for his medical examination and "collection of other digital evidence". "The risk of tampering with evidence or influencing witnesses cannot be ruled out, if the pre-arrest bail is granted," the court said while rejecting his plea. A sessions court on Thursday rejected the anticipatory bail application of actor Ajaz Khan booked on a complaint of rape. The complainant, an actress, has alleged that Khan induced her into a relationship by promising marriage. The FIR filed by Charkop police on the woman's complaint alleged that Khan misused his position as a celebrity and host of a reality show and had sexual relations with her multiple times under the pretext of marriage and providing financial help in April. Khan in his anticipatory plea said that the woman was aware he was already married and their intimate relationship was consensual. He also claimed that he had proof through WhatsApp chats and videos, alleging that the woman sought money to the tune of Rs 10 lakh to withdraw the complaint against him. The police opposed the anticipatory bail plea stating that investigation was necessary to recover Khan's phone and to probe the case further since the allegations were grave. 'The FIR discloses specific dates, locations and circumstances under which the incident occurred, including the assurances allegedly given by the applicant, not just of marriage but also professional help and financial assistance for the victim's family. Prima facie, this cannot be brushed aside as a simple case of consensual relationship. The consent appears to be obtained by fraud or under misrepresentation of facts. Therefore, there is no substance to contend that no offence can be made out at all,' additional sessions judge D G Dhoble said in the order. The court further said that a probe was required into the allegations and purported WhatsApp chats do not seem to show that the victim had demanded money. 'From the allegations levelled against the applicant, the custodial interrogation is necessary for medical examination of applicant to collect evidence, recovery of the applicant's mobile phone, verification of WhatsApp chats, call recordings and collection of other digital evidence including to obtain voice samples, etc. If the applicant is granted anticipatory bail the risk of tampering with evidence or influencing witnesses cannot be ruled out,' the court said. The police had also opposed his plea citing Khan's previous cases, including a drugs case.
